Any county leasing road machinery and equipment from the\n\nDepartment of Transportation shall use and care for said machinery\n\nand equipment in a careful and prudent manner and shall pay all\n\noperating and maintenance expenses including any and all repairs\n\nduring the time said machinery or equipment is in its possession.\n\nB. The leasing county assumes all risk and liability for and\n\nshall hold the Department of Transportation and its agents harmless\n\nfrom all damages to property and injuries and death to persons\n\narising out of the use, possession or transportation of said road\n\nmachinery or equipment.\n\nC. When road machinery or equipment is returned to the\n\nDepartment of Transportation prior to the payment in full of the\n\ncontract purchase price the county must notify the Department of\n\nTransportation and request an inspection and appraisal of any such\n\nunit of equipment or machinery. At the appointed time of inspection\n\nof equipment or machinery being returned, a county commissioner, a\n\nDepartment representative and an independent appraiser will\n\ndetermine the fair market value of said equipment and machinery.\n\nShould the appraised value not meet or exceed the balance\n\nremaining on the contract for lease-purchase, the county shall be\n\nassessed the difference and shall not be permitted to participate in\n\nthe County Road Machinery and Equipment Revolving Fund until such\n\ndifference is paid in full. The extent of the financial obligation\n\nby the county will be based on the appraisal of equipment and road\n\nmachinery at the time of inspection.\n\nThe county may elect to remedy any deficiencies noted at the\n\ninspection meeting and request a subsequent inspection and appraisal\n\nafter the deficiencies are corrected.\n\nD. All risk physical damage insurance shall be carried on all\n\nequipment and road machinery purchased through the County Road\n\nMachinery and Equipment Revolving Fund. The Department is\n\nauthorized to arrange such coverage and include the cost of premium\n\nin the lease-purchase contract.
