Stat. tit. 69, § 69-656","heading":"Bridge or construction projects on county primary road","body":"system.\n\nA. The county commissioners in each county shall designate a\n\ncounty primary road system as provided for in Section 654 of this\n\ntitle, and upon completion, the board of county commissioners in any\n\ncounty may program bridge or roadway projects located on the county\n\nprimary road system in accordance with the provisions of this\n\nsection.\n\nB. Any bridge or roadway construction project which materially\n\ncontributes to improving the adequacy of the county primary road\n\nsystem which meets accepted design standards may be considered\n\neligible.\n\nC. Design standards for projects to be constructed under this\n\nsection shall be developed cooperatively between the Oklahoma\n\nCooperative Circuit Engineering Districts Board and the Department\n\nof Transportation; provided however, any such standards so developed\n\nmust meet the minimum criteria required to assure federal\n\nparticipation in the project if such participation is to be used for\n\nsuch project.\n\nD. The Department of Transportation shall be the administering\n\nagency, and, in cooperation with the Oklahoma Cooperative Circuit\n\nEngineering Districts Board, shall develop and promulgate\n\nregulations for the carrying out of the provisions of this section.\n\nProvided however, any such administrative procedures so developed\n\nshall be subject to the approval of the State Transportation\n\nCommission.\n\nE. The county shall be responsible for plans, surveys and other\n\nnecessary engineering to prepare the project for contract letting;\n\nhowever, construction engineering shall be performed by the\n\nDepartment of Transportation.\n\nF. The county shall be responsible for the acquisition of all\n\nrights-of-way required to construct the project including relocation\n\nassistance payments and the costs associated with necessary utility\n\nrelocations or adjustments. All right-of-way acquisition activities\n\nshall be carried out in accordance with applicable state statutes.\n\nAssistance in the preparation of deeds and easements, in the actual\n\nacquisition of real property, and in the relocation of families and\n\nbusinesses shall be provided by the Department of Transportation\n\nupon written request of the county.\n\nG. Projects shall be let to contract by the State\n\nTransportation Commission through competitive bidding procedures,\n\nprovided however, force account projects may be awarded to the\n\ncounty by the Transportation Commission based upon agreed unit\n\nprices, if deemed in the best public interest.\n\nH. Counties constructing projects under provisions of this\n\nsection shall enter into an agreement with the Department of\n\nTransportation that the county will adequately maintain any bridge\n\nor road built under this section. Funds provided to support the\n\naccomplishment of this section shall be withheld from any county not\n\nproviding adequate maintenance for projects built under its\n\nprovisions.\n\nI. While the intent of the Legislature is that any funds\n\nutilized under this section be directed primarily toward the\n\nreplacement of inadequate bridges on the county primary road system,\n\nemphasizing those portions of that system serving as school bus\n\nroutes, it is also recognized that other critical road needs may\n\nexist in the various counties; therefore, projects in an amount not\n\nto exceed One Hundred Thousand Dollars ($100,000.00) may be approved\n\nunder this section for these other critical needs in those instances\n\nwhere such approval can be justified by the county. It is further\n\nthe intent of the Legislature that this be a continuing program so\n\nthat significant improvement in the overall adequacy of Oklahoma's\n\ncounty road system may be realized.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1ada7669891aacc9cbcf1abfee84a2842c984f5d3790a3961afb87b941483c3b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-655","next":"us-ok/okla.-stat.-tit.-69-69-657"},"notice":"GroundRules: Original legal text.
