Stat. tit. 69, § 69-708.2","heading":"Consultant list - Solicitation - Review - Negotiations -","body":"Demand service contracts.\n\nA. The Department of Transportation and the Oklahoma Turnpike\n\nAuthority shall each compile a list of all persons and entities\n\ninterested in and capable of performing construction management and\n\ndesign consultant services specific to the transportation industry.\n\nThe consultant list shall include, but shall not be limited to,\n\nqualified construction managers and design consultants capable of\n\nperforming such services as solicited from the Office of Management\n\nand Enterprise Services file on an annual basis. The Department and\n\nthe Authority shall each determine the qualifications of the\n\nprospective construction managers and design consultants. The\n\nconstruction managers and design consultants shall be selected at\n\nthe discretion of the Department or the Authority.\n\nB. The Department or the Authority shall issue a solicitation\n\nto construction managers or design consultants capable of providing\n\nthe services desired. The solicitation shall, at a minimum,\n\ncontain:\n\n1. A description and scope of the projects;\n\n2. An estimated construction cost, anticipated starting date,\n\nand completion date the Department or the Authority desires for the\n\nproject;\n\n3. A certification of funds available for the construction\n\nmanager or design consultant fee, including federal, state or other\n\nparticipation;\n\n4. The closing date for construction manager or design\n\nconsultant to give notice of interest; and\n\n5. Additional data the Department or the Authority requires\n\nfrom the construction manager or design consultant. The closing\n\ndate for submission of construction manager or design consultant\n\nnotice of interest for consideration shall be within thirty (30)\n\ndays of the date the notice is issued by the Department or the\n\nAuthority.\n\nC. The Department or the Authority shall review the\n\nqualifications of the entities on the consultant list and shall\n\nselect no less than three and no more than five consultants per\n\ncontract for further consideration. The review shall include\n\nconsideration of the following information:\n\n1. Professional qualifications for the type of work\n\ncontemplated;\n\n2. Capacity for completing the project in the specified time\n\nperiod;\n\n3. Past performance on projects of a similar nature; and\n\n4. Percentage of work to be performed by residents of Oklahoma.\n\nD. The Department and the Authority shall each establish a\n\ncommittee which will evaluate the construction managers or design\n\nconsultants selected for consideration and rank the construction\n\nmanagers or design consultants in order of preference.\n\nE. The Department or the Authority shall enter into\n\nnegotiations with the first-choice consultant. If the Department or\n\nAuthority and the first-choice consultant cannot reach an agreement,\n\ntheir negotiations shall be terminated and negotiations with the\n\nsecond-choice consultant shall commence. If the Department or the\n\nAuthority and the second-choice consultant cannot reach an\n\nagreement, their negotiations shall be terminated and negotiations\n\nwith the third-choice consultant shall commence. If the Department\n\nor the Authority and the third-choice consultant cannot reach an\n\nagreement, then all negotiations shall be terminated. Should the\n\nDepartment or the Authority be unable to negotiate a satisfactory\n\ncontract with any of the three selected consultants, the Department\n\nor the Authority shall reevaluate the proposed work and send out a\n\nnew notice.\n\nF. As provided for in the Transportation Commission rules or by\n\nAuthority resolutions, the Department or the Authority shall perform\n\na written evaluation of the services provided by the consultant.\n\nThis evaluation shall become a part of the Department's and the\n\nAuthority's consultant file. Failure of the consultant to perform\n\nthe prescribed work in a timely and accurate manner shall be grounds\n\nfor exclusion from the list of qualified construction managers or\nhority resolutions, the Department or the Authority shall perform\n\na written evaluation of the services provided by the consultant.\n\nThis evaluation shall become a part of the Department's and the\n\nAuthority's consultant file. Failure of the consultant to perform\n\nthe prescribed work in a timely and accurate manner shall be grounds\n\nfor exclusion from the list of qualified construction managers or\n\ndesign consultants until such time as the consultant can reasonably\n\ndocument and demonstrate performance improvement to the satisfaction\n\nof the Department or the Authority.\n\nG. As provided for in the Transportation Commission rules or by\n\nAuthority resolutions, the Department or the Authority may enter\n\ninto demand services contracts for consultant services to provide a\n\nspecific project work type or activity for unspecified projects or\n\nfacilities on an as-needed basis.
