For all public schools in this state, school shall actually\n\nbe in session and classroom instruction offered:\n\n1. For not less than one hundred eighty-one (181) days;\n\n2. For not less than one thousand eighty-six (1,086) hours each\n\nschool year, if a district board of education adopts a school-hours\n\npolicy and notifies the State Board of Education prior to October 15\n\nof the applicable school year;\n\n3. Beginning with the 2025-2026 school year, for not less than\n\none thousand eighty-six (1,086) hours with a minimum of one hundred\n\nsixty-six (166) days of instruction each school year, if a district\n\nboard of education adopts a school-hours policy and notifies the\n\nState Board of Education prior to October 15 of the applicable\n\nschool year; or\n\n4. Beginning with the 2025-2026 school year, for not less than\n\none thousand eighty-six (1,086) hours each school year, if a\n\ndistrict board of education adopts a school-hours policy, notifies\n\nthe State Board of Education prior to October 15 of the applicable\n\nschool year, and meets the requirements established by the State\n\nBoard of Education pursuant to subsection H of this section.\n\nB. A school district may not count more than thirty (30) hours\n\neach school year that are used for attendance of professional\n\nmeetings toward the one hundred eighty-one (181) days or one\n\nthousand eighty-six (1,086) hours of classroom instruction time\n\nrequired in subsection A of this section.\n\nC. Teachers off contract with an employing district shall not\n\nbe required by the employing school district to attend professional\n\nmeetings unless the teacher is paid additional compensation for the\n\nadditional time. Teachers may be paid additional compensation for\n\nattending professional meetings in excess of their contract term.\n\nSubject to district board of education policy or collective\n\nbargaining agreement, additional paid professional days may be\n\ngranted for individual teachers to attend or participate in\n\nprofessional meetings, staff development training, or National Board\n\ncertification portfolio development as provided for in Section 6-\n\n204.2 of this title.\n\nD. A school district may authorize parent-teacher conferences\n\nto be held during a regular school day. If authorized by the school\n\ndistrict, parent-teacher conferences shall be counted as classroom\n\ninstruction time for no more than six (6) hours per semester, for a\n\ntotal of twelve (12) hours per school year.\n\nE. A school district may maintain school for less than a full\n\nschool year only when conditions beyond the control of school\n\nauthorities make the maintenance of the term impossible and the\n\nState Board of Education has been apprised and has expressed\n\nconcurrence in writing.\n\nF. The State Board of Education shall establish criteria for an\n\nextended-day schedule for schools subject to paragraph 1 of\n\nsubsection A of this section. The criteria shall:\n\n1. Prescribe a lengthened school day within limits determined\n\nnot to be detrimental to quality instruction;\n\n2. Ensure that the schedule is equivalent in annual hours of\n\ninstruction to the one-hundred-eighty-one-day school year specified\n\nin paragraph 1 of subsection A of this section; and\n\n3. Be consistent with the provisions of this section and\n\nSections 1-111 and 1-112 of this title but may result in fewer\n\nannual days of instruction.\n\nG. Notwithstanding the provisions of subsection F of this\n\nsection, a school district board of education subject to paragraph 1\n\nof subsection A of this section may adopt and implement an extended-\n\nday schedule subject to the following requirements:\n\n1. The annual number of hours of instruction shall equal or\n\nexceed one thousand eighty-six (1,086) hours, which is the\n\nequivalent of one hundred eighty-one (181) days of instruction as\n\nspecified in subsection A of this section for six (6) hours each day\n\nas specified in Section 1-111 of this title;\nection may adopt and implement an extended-\n\nday schedule subject to the following requirements:\n\n1. The annual number of hours of instruction shall equal or\n\nexceed one thousand eighty-six (1,086) hours, which is the\n\nequivalent of one hundred eighty-one (181) days of instruction as\n\nspecified in subsection A of this section for six (6) hours each day\n\nas specified in Section 1-111 of this title;\n\n2. The annual number of days of instruction shall equal or\n\nexceed one hundred eighty-one (181) days as specified in subsection\n\nA of this section;\n\n3. The schedule adopted shall be consistent with the provisions\n\nof Sections 1-111 and 1-112 of this title, except that for not more\n\nthan one (1) day per week, a school day shall consist of not less\n\nthan five (5) hours devoted to academic instruction in a regular\n\nclassroom setting;\n\n4. The district shall hold a public hearing prior to the\n\nadoption of an extended-day schedule authorized pursuant to this\n\nsubsection; and\n\n5. The district shall document the impact on student\n\nachievement as determined by the academic performance data score and\n\nany other relevant factors that are a result of implementation of an\n\nextended-day schedule authorized pursuant to this subsection and\n\nprovide an annual report to the State Board of Education of the\n\nresults. If improvement in student achievement cannot be documented\n\nin the report, the district board of education shall revoke\n\nauthorization as provided by this subsection. If the district board\n\nof education does not revoke authorization after student achievement\n\nis not documented in the report, the State Board of Education may\n\ndeny accreditation of any school in violation of this subsection.\n\nH. Beginning with the 2021-2022 school year, a school district\n\nboard of education may adopt a school-hours policy as provided for\n\nby paragraph 4 of subsection A of this section only if it meets or\n\nexceeds the minimum guidelines for student performance and school\n\ndistrict cost savings established by the State Board of Education.\n\nThe State Board of Education shall promulgate rules, subject to\n\napproval by the Legislature, establishing the minimum guidelines for\n\nstudent performance and school district cost savings.\n\nI. If subject to paragraph 2 of subsection A of this section, a\n\ndistrict board of education or designee may elect to close a school\n\nduring the school day for inclement weather purposes. In such an\n\nevent, the number of hours incurred in classroom instruction time\n\nprior to school closure shall be counted toward the one thousand\n\neighty-six (1,086) hours per year requirement.\n\nJ. 1. Except as provided for in paragraph 2 of this\n\nsubsection, beginning with the 2026-2027 school year a school\n\ndistrict or charter school shall not count days or portions of days\n\nwhen school is closed and virtual instruction is provided toward the\n\none hundred eighty-one (181) days or one thousand eighty-six (1,086)\n\nhours of classroom instruction time required by subsection A of this\n\nsection. For the purposes of this subsection, \"virtual instruction\"\n\nmeans the use of the Internet or other digital information\n\ntransmission systems as a form of instruction.\n\n2. Beginning with the 2026-2027 school year, a school district\n\nor charter school may count up to two (2) days or twelve (12) hours\n\nwhen school is closed and virtual instruction is provided toward the\n\none hundred eighty-one (181) days or one thousand eighty-six (1,086)\n\nhours of classroom instruction time required by subsection A of this\n\nsection only if:\n\na. the Superintendent of Public Instruction has approved\n\nthe virtual instruction plan submitted by a school\n\ndistrict board of education or charter school\n\ngoverning board. A school district board of education\n\nor charter school governing board shall approve its\n\nvirtual instruction plan, publish the plan on the\n\nwebsite for the school district or charter school, and\nA of this\n\nsection only if:\n\na. the Superintendent of Public Instruction has approved\n\nthe virtual instruction plan submitted by a school\n\ndistrict board of education or charter school\n\ngoverning board. A school district board of education\n\nor charter school governing board shall approve its\n\nvirtual instruction plan, publish the plan on the\n\nwebsite for the school district or charter school, and\n\nsubmit it to the Superintendent of Public Instruction\n\nby November 1, 2025. The Superintendent shall approve\n\nor disapprove all submitted virtual instruction plans\n\nby January 31, 2026. A school district board of\n\neducation or charter school governing board shall\n\nreview its virtual instruction plan annually and\n\napprove any necessary revisions for submission to the\n\nSuperintendent of Public Instruction by November 1\n\neach subsequent year, and the Superintendent shall\n\napprove or disapprove submitted plans by January 31\n\neach subsequent year. If a plan is disapproved, the\n\nschool district board of education or charter school\n\ngoverning board may approve a revised plan, publish it\n\non the website for the school district or charter\n\nschool, and submit it to the Superintendent. The plan\n\nshall include a virtual needs assessment which shall\n\naddress availability of technology infrastructure to\n\ndeliver virtual instruction. The plan shall also\n\naddress how the school district or charter school\n\nplans to provide:\n\n(1) instruction to students on an Individualized\n\nEducation Program (IEP),\n\n(2) child nutrition services, and\n\n(3) transportation for students enrolled in\n\ntechnology center school courses or programs,\n\nb. a state of emergency or proclamation has been issued\n\nby the Governor for a specific reason relating to\n\nschool district or charter school operations, and\n\nc. the school district board of education or charter\n\nschool governing board approves the use of virtual\n\ninstruction.\n\n3. The provisions of this subsection shall not apply to\n\nstatewide virtual charter schools or full-time virtual education\n\nprograms operated by a school district.\n\nK. By June 30, 2027, and by June 30 each subsequent year, the\n\nState Department of Education shall publish on its website and\n\nelectronically submit to the Governor, the President Pro Tempore of\n\nthe Senate, and the Speaker of the House of Representatives a report\n\nwith information regarding the use of virtual instruction as\n\nauthorized by subsection J of this section. The report shall\n\ninclude, at a minimum:\n\n1. The school districts and charter schools that closed school\n\nand provided virtual instruction as authorized by subsection J of\n\nthis section and the length of time virtual instruction was\n\nprovided; and\n\n2. The reason for which school was closed and virtual\n\ninstruction was provided.\n\nL. Nothing in this section shall be construed as affecting the\n\nright of an employing school district to require teachers as defined\n\nin Section 6-101.3 of this title to work in excess of the one\n\nthousand eighty-six (1,086) hours required for student instruction.\n\nIn addition, nothing in this section shall be construed to affect\n\nthe Fair Labor Standards Act of 1938 status of any school district\n\nemployee.\n\nM. The provisions of this section shall not prohibit the\n\nOklahoma School for the Blind or the Oklahoma School for the Deaf\n\nfrom adopting an alternative school-hours policy if the Oklahoma\n\nSchool for the Blind or the Oklahoma School for the Deaf notifies\n\nand receives approval from the State Board of Education prior to\n\nOctober 15 of the applicable school year.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9e9fb9b243eeb4b58a5f2b4db07887b438181eca974c85ff9275c71c5fb06999","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-1-108","next":"us-ok/okla.-stat.-tit.-70-70-1-109.1"},"notice":"GroundRules: Original legal text.
