As used in this section:\n\n1. \"Sex\" means the physical condition of being male or female\n\nbased on genetics and physiology, as identified on the individual’s\n\noriginal birth certificate;\n\n2. \"Multiple occupancy restroom or changing area\" means an area\n\nin a public school or public charter school building designed or\n\ndesignated to be used by more than one individual at a time, where\n\nindividuals may be in various stages of undress in the presence of\n\nother individuals. The term may include but is not limited to a\n\nschool restroom, locker room, changing room, or shower room;\n\n3. \"Coach\" means a person employed by a public school district\n\nor public charter school who is involved in the teaching or training\n\nof students participating in a school-sponsored athletic activity;\n\nand\n\n4. \"School-sponsored athletic activity\" means a sporting event\n\nthat is supported and affiliated with the school such as games,\n\nmatches, and tournaments.\n\nB. To ensure privacy and safety, each public school and public\n\ncharter school that serves students in prekindergarten through\n\ntwelfth grades in this state shall require every multiple occupancy\n\nrestroom or changing area designated as follows:\n\n1. For the exclusive use of the male sex; or\n\n2. For the exclusive use of the female sex.\n\nC. Each public school or public charter school in this state\n\nshall provide a reasonable accommodation to any individual who does\n\nnot wish to comply with the provisions of subsection B of this\n\nsection. A reasonable accommodation shall be access to a single-\n\noccupancy restroom or changing room.\n\nD. The provisions of this section shall not apply to\n\nindividuals entering a multiple occupancy restroom or changing area\n\ndesignated for use by the opposite sex when entering in any of the\n\nfollowing circumstances:\n\n1. For custodial, maintenance, or inspection purposes;\n\n2. To render emergency medical assistance; or\n\n3. If a suitable meeting room or area is not available, a coach\n\nmay enter a locker room before, during, or after a school-sponsored\n\nathletic activity, provided:\n\na. all students present are fully clothed,\n\nb. the coach shall be accompanied by at least one\n\nadditional adult at all times, and\n\nc. if the coach is the opposite sex of the students\n\npresent, the coach shall be accompanied by at least\n\none adult of the same sex as the students present.\n\nThe adult shall not be a current high school student.\n\nE. 1. Each school district board of education and public\n\ncharter school governing board shall adopt a policy to provide\n\ndisciplinary action for individuals who refuse to comply with the\n\nprovisions of this section.\n\n2. No school district board of education or charter school\n\ngoverning board shall adopt a policy contrary to the provisions of\n\nthis section.\n\nF. Upon a finding of noncompliance with the provisions of\n\nsubsections B, C, and D of this section by the State Board of\n\nEducation, the noncompliant school district or public charter school\n\nshall receive a five percent (5%) decrease in state funding for the\n\nschool district or public charter school for the fiscal year\n\nfollowing the year of noncompliance.\n\nG. A parent or legal guardian of a student enrolled in and\n\nphysically attending a public school district or public charter\n\nschool shall have a cause of action against the public school\n\ndistrict or public charter school for noncompliance with the\n\nprovisions of subsections B, C, and D of this section.\n\nH.
