Stat. tit. 70, § 70-11-103.6a","heading":"Review of adopted subject matter standards –","body":"College- and career-ready English Language Arts and Mathematics\n\nstandards – Student assessments.\n\nA. Beginning with the 2014-15 school year, each area of subject\n\nmatter standards, except for standards for career and technology\n\neducation adopted pursuant to Section 14-103 of this title, shall be\n\nadopted by the State Board of Education and shall be subject to\n\nlegislative review and approval as provided for in Section 4 of this\n\nact. The subject matter standards shall be implemented statewide by\n\nevery public school district in this state. The subject matter\n\nstandards shall be thoroughly reviewed by the State Board every six\n\n(6) years according to and in coordination with the existing subject\n\narea textbook adoption cycle. After review, the State Board shall\n\nadopt any revisions in such subject matter standards deemed\n\nnecessary to achieve further improvements in the quality of\n\neducation for the students of this state. Any revisions adopted by\n\nthe State Board of Education shall be subject to review and approval\n\nas provided for in Section 4 of this act. The adoption of subject\n\nmatter standards or revisions to the standards by the State Board of\n\nEducation pursuant to this section shall not be promulgated as rules\n\nand shall not be subject to Article I of the Administrative\n\nProcedures Act.\n\nB. 1. In addition to the requirements set forth in subsection\n\nA of this section, on or before August 1, 2016, the State Board of\n\nEducation, in consultation with the State Regents for Higher\n\nEducation, the State Board of Career and Technology Education and\n\nthe Oklahoma Department of Commerce, shall adopt subject matter\n\nstandards for English Language Arts and Mathematics which are\n\ncollege- and career-ready and will replace current standards. To be\n\nconsidered college- and career-ready, the standards shall be\n\nevaluated by the State Department of Education, the State Regents\n\nfor Higher Education, the State Board of Career and Technology\n\nEducation and the Oklahoma Department of Commerce and be determined\n\nto be such that the standards will address the goals of reducing the\n\nneed for remedial coursework at the postsecondary level and\n\nincreasing successful completion of postsecondary education. The\n\nsubject matter standards and corresponding student assessments for\n\nEnglish Language Arts and Mathematics shall be solely approved and\n\ncontrolled by the state through the State Board of Education.\n\n2. Upon the effective date of this act, the State Board of\n\nEducation shall begin the process of adopting the English Language\n\nArts and Mathematics standards and shall provide reasonable\n\nopportunity, consistent with best practices, for public comment on\n\nthe revision of the standards, including but not limited to comments\n\nfrom students, parents, educators, organizations representing\n\nstudents with disabilities and English language learners, higher\n\neducation representatives, career technology education\n\nrepresentatives, subject matter experts, community-based\n\norganizations, Native American tribal representatives and business\n\ncommunity representatives.\n\n3. Until the statewide student assessments for English Language\n\nArts and Mathematics are implemented as provided for in paragraph 1\n\nof subsection C of this section, the State Board of Education shall\n\nimplement the subject matter standards for English Language Arts and\n\nMathematics which were in place prior to the revisions adopted by\n\nthe Board in June 2010.\n\n4. Upon the effective date of this act, the State Board of\n\nEducation shall seek certification from the State Regents for Higher\n\nEducation that the subject matter standards for English Language\n\nArts and Mathematics which were in place prior to the revisions\n\nadopted by the Board in June 2010 are college- and career-ready as\n\ndefined in the Federal Elementary and Secondary Education Act (ESEA)\ntate Board of\n\nEducation shall seek certification from the State Regents for Higher\n\nEducation that the subject matter standards for English Language\n\nArts and Mathematics which were in place prior to the revisions\n\nadopted by the Board in June 2010 are college- and career-ready as\n\ndefined in the Federal Elementary and Secondary Education Act (ESEA)\n\nFlexibility document issued by the United States Department of\n\nEducation and referenced in Option B of Principle 1: College and\n\nCareer-Ready Expectations for All Students. The State Regents shall\n\nprovide the Board a detailed description of the certification\n\nprocess and results, including a list of deficiencies if the State\n\nRegents conclude that the standards are not college- and career-\n\nready. The Board shall post all documents, materials, reports,\n\ndescriptions and correspondence produced by the State Regents or\n\nused by the State Regents in the certification process on the\n\nwebsite for the State Department of Education.\n\nC. 1. On or before the 2017-18 school year, the State Board of\n\nEducation, in consultation with the State Regents for Higher\n\nEducation, the State Board of Career and Technology Education and\n\nthe Oklahoma Department of Commerce, shall direct the process of the\n\ndevelopment of annual high-quality statewide student assessments for\n\nEnglish Language Arts and Mathematics as provided for in Section\n\n1210.508 of this title that align with the college- and career-ready\n\nsubject matter standards developed pursuant to subsection B of this\n\nsection.\n\n2. The statewide student assessments for English Language Arts\n\nand Mathematics shall continue to assess standards and objectives\n\nfound in the subject matter standards for English Language Arts and\n\nMathematics which were in place prior to the revisions adopted by\n\nthe Board in June 2010 and the test blueprints shall continue to\n\nalign to the standards and objectives found in such subject matter\n\nstandards for English Language Arts and Mathematics until the new\n\nassessments are implemented as provided for in paragraph 1 of this\n\nsubsection.\n\nD. 1. The State Board of Education shall not enter into any\n\nagreement, memorandum of understanding or contract with any federal\n\nagency or private entity which in any way cedes or limits state\n\ndiscretion or control over the process of development, adoption or\n\nrevision of subject matter standards and corresponding student\n\nassessments in the public school system, including, but not limited\n\nto, agreements, memoranda of understanding and contracts in exchange\n\nfor funding for public schools and programs. If the State Board of\n\nEducation is a party to such an agreement, memorandum of\n\nunderstanding or contract on the effective date of this act, the\n\nState Board of Education shall initiate necessary efforts to amend\n\nthe agreement, memorandum of understanding or contract to comply\n\nwith the requirements of this subsection.\n\n2. Nothing in this section shall be construed to prohibit the\n\nState Board of Education from seeking and being granted a waiver\n\nfrom federal law, provided that the conditions for the waiver do not\n\nrequire the state to cede or limit its discretion or control over\n\nthe process of development, adoption or revision of subject matter\n\nstandards and corresponding statewide student assessments.\n\n3. The State Department of Education may participate in a\n\nmultistate or multigovernmental cooperative pursuant to the\n\nrequirements of the Oklahoma Central Purchasing Act, but shall not\n\nbind the state, contractually or otherwise, to the authority of any\n\nother state, organization or entity which may supersede the\n\nauthority of the State Board of Education.\n\nE. The content of all subject matter standards and\n\ncorresponding student assessments shall be solely approved and\n\ncontrolled by the state through the State Board of Education. The\nahoma Central Purchasing Act, but shall not\n\nbind the state, contractually or otherwise, to the authority of any\n\nother state, organization or entity which may supersede the\n\nauthority of the State Board of Education.\n\nE. The content of all subject matter standards and\n\ncorresponding student assessments shall be solely approved and\n\ncontrolled by the state through the State Board of Education. The\n\nState Board of Education shall maintain independence of all subject\n\nmatter standards referenced in Section 11-103.6 of this title and\n\ncorresponding statewide student assessments and shall not relinquish\n\nauthority over Oklahoma subject matter standards and corresponding\n\nstatewide student assessments. Nothing in this section shall\n\nprohibit benchmarking the state subject matter standards and\n\ncorresponding student assessments with those of other states or\n\nnations to allow comparison of Oklahoma subject matter standards and\n\ncorresponding student assessments with those of other states and\n\nnations.\n\nF. School districts shall exclusively determine the\n\ninstruction, curriculum, reading lists and instructional materials\n\nand textbooks, subject to any applicable provisions or requirements\n\nas set forth in law, to be used in meeting the subject matter\n\nstandards. School districts may, at their discretion, adopt\n\nsupplementary student assessments which are in addition to the\n\nstatewide student assessments.\n\nG. 1. Upon completion of the adoption of English Language Arts\n\nand Mathematics subject matter standards pursuant to subsection B of\n\nthis section, the State Board of Education shall compare such\n\nEnglish Language Arts and Mathematics standards with the English\n\nLanguage Arts and Mathematics standards that were adopted by the\n\nState Board of Education prior to implementation of this act. The\n\nState Board of Education shall consider public comments, the use of\n\nbest practices, evidence and research in the evaluation of both sets\n\nof standards. The State Board of Education shall compare the\n\nstandards in the areas of:\n\na. effective preparation for active citizenship and\n\npostsecondary education or the workforce,\n\nb. subject matter content,\n\nc. sequencing of subject matter content and relationship\n\nto measurement of student performance and the\n\napplication of subject matter standards,\n\nd. developmental appropriateness of grade-level\n\nexpectations, academic content and instructional\n\nrigor,\n\ne. clarity for educators and parents,\n\nf. exemplars tied to the standards,\n\ng. measurability of student proficiency in the subject\n\nmatter,\n\nh. pedagogy,\n\ni. development of critical thinking skills, and\n\nj. demonstration of application of acquired knowledge and\n\nskills.\n\n2. Upon completion of the comparison of the English Language\n\nArts and Mathematics subject matter standards, the State Board of\n\nEducation shall submit to the Governor, the Speaker of the House of\n\nRepresentatives, the President Pro Tempore of the Senate, the\n\nMinority Leader of the House of Representatives and the Minority\n\nLeader of the Senate a report outlining the results of the\n\ncomparison of the standards.\n\nH. All subject matter standards and corresponding statewide\n\nstudent assessments adopted by the State Board of Education shall be\n\ncarefully circumscribed to reflect direct application to subject\n\nmatter proficiency and shall not include standards or assessment\n\nquestions that are designed to collect or measure noncognitive,\n\nemotional or psychological characteristics, attributes or skills of\n\nstudents.\n\nI. Any rule, including but not limited to Rules 210:15-4-1\n\nthrough 210:15-4-3 of the Oklahoma Administrative Code, which\n\nconflicts with the requirements of this section, shall be amended or\n\nrepealed by the State Board of Education as necessary to comply with\n\nthe requirements of this section.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"532c7e9bb0025038af5526ca7de02236e933c4e1b20dd7932a19f0f6869f13b4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-11-103.6","next":"us-ok/okla.-stat.-tit.-70-70-11-103.6a-1"},"notice":"GroundRules: Original legal text.
