Stat. tit. 70, § 70-11-103.9","heading":"Physical education programs required for","body":"accreditation.\n\nA. Except as otherwise provided for in this section, the State\n\nBoard of Education shall require, as a condition of accreditation,\n\nthat school districts provide to all students physical education\n\nprograms which may include athletics.\n\nB. The Board shall require, as a condition of accreditation,\n\nthat public elementary schools provide instruction, for students in\n\nfull-day kindergarten and grades one through five, in physical\n\neducation or exercise programs for a minimum of an average of sixty\n\n(60) minutes each week. The time students participate in recess\n\nshall not be counted toward the sixty-minutes-per-week physical\n\neducation requirement. Schools may exclude from participation in\n\nthe physical education or exercise programs required in this\n\nsubsection those students who have been placed into an in-house\n\nsuspension or detention class or placement or those students who are\n\nunder an in-school restriction or are subject to an administrative\n\ndisciplinary action.\n\nC. The Board shall require, as a condition of accreditation,\n\nthat public elementary schools provide to students in full-day\n\nkindergarten and grades one through five, in addition to the\n\nrequirements set forth in subsection B of this section, an average\n\nof sixty (60) minutes each week of physical activity, which may\n\ninclude, but not be limited to, physical education, exercise\n\nprograms, fitness breaks, recess, and classroom activities, and\n\nwellness and nutrition education. Each school district board of\n\neducation shall determine the specific activities and means of\n\ncompliance with the provisions of this subsection, giving\n\nconsideration to the recommendations of each school's Healthy and\n\nFit School Advisory Committee as submitted to the school principal\n\npursuant to the provisions of Section 24-100a of this title.\n\nD. The Board shall disseminate information to each school\n\ndistrict on the benefits of physical education programs and shall\n\nstrongly encourage districts to provide physical education\n\ninstruction to students in grades six through twelve. The Board\n\nshall also strongly encourage school districts to incorporate\n\nphysical activity into the school day by providing to students in\n\nfull-day kindergarten and grades one through five at least a twenty-\n\nminute daily recess, which shall be in addition to the sixty (60)\n\nminutes of physical education as required by subsection B of this\n\nsection, and by allowing all students brief physical activity breaks\n\nthroughout the day, physical activity clubs, and special events.\n\nE. Instruction in physical education required in this section\n\nshall be aligned with the subject matter standards as adopted by the\n\nBoard.\n\nF. The physical education curriculum shall be sequential,\n\ndevelopmentally appropriate, and designed, implemented, and\n\nevaluated to enable students to develop the motor and self-\n\nmanagement skills and knowledge necessary to participate in physical\n\nactivity throughout life. Each school district shall establish\n\nspecific objectives and goals the district intends to accomplish\n\nthrough the physical education curriculum.\n\nG. In identifying the essential knowledge and skills, the State\n\nBoard of Education shall ensure that the subject matter standards\n\nfor physical education:\n\n1. Emphasize the knowledge and skills capable of being used\n\nduring a lifetime of regular physical activity;\n\n2. Are consistent with national physical education standards\n\nfor:\n\na. the information that students should learn about\n\nphysical activity, and\n\nb. the physical activities that students should be able\n\nto perform;\n\n3. Require that, on a weekly basis, at least fifty percent\n\n(50%) of the physical education class be used for actual student\n\nphysical activity and that the activity be, to the extent\n\npracticable, at a moderate or vigorous level;\n\n4. Offer students an opportunity to choose among many types of\nearn about\n\nphysical activity, and\n\nb. the physical activities that students should be able\n\nto perform;\n\n3. Require that, on a weekly basis, at least fifty percent\n\n(50%) of the physical education class be used for actual student\n\nphysical activity and that the activity be, to the extent\n\npracticable, at a moderate or vigorous level;\n\n4. Offer students an opportunity to choose among many types of\n\nphysical activity in which to participate;\n\n5. Offer students both cooperative and competitive games;\n\n6. Meet the needs of students of all physical ability levels,\n\nincluding students who have a disability, chronic health problem, or\n\nother special need that precludes the student from participating in\n\nregular physical education instruction but who might be able to\n\nparticipate in physical education that is suitably adapted and, if\n\napplicable, included in the student's individualized education\n\nprogram;\n\n7. Teach self-management and movement skills;\n\n8. Teach cooperation, fair play, and responsible participation\n\nin physical activity;\n\n9. Promote student participation in physical activity outside\n\nof school; and\n\n10. Allow physical education classes to be an enjoyable\n\nexperience for students.\n\nH.
