A school district, charter school, virtual charter school,\n\nstate agency, public library, or institution of higher education\n\nwithin The Oklahoma State System of Higher Education may offer\n\ndigital or online library database resources to students in\n\nkindergarten through twelfth grade only if the vendor, person, or\n\nentity providing the resources verifies that all the resources\n\ncomply with the provisions of subsection B of this section.\n\nB. Digital or online library database resources offered by\n\nschool districts, charter schools, virtual charter schools, state\n\nagencies, public libraries, or universities to students in\n\nkindergarten through twelfth grade shall have safety policies and\n\ntechnology protection measures that:\n\n1. Prohibit and prevent a user of the resource from sending,\n\nreceiving, viewing, or downloading materials that are child sexual\n\nabuse material or obscene materials, as defined in Section 1024.1 of\n\nTitle 21 of the Oklahoma Statutes, or materials that depict child\n\nsexual exploitation, as defined in Section 843.5 of Title 21 of the\n\nOklahoma Statutes; and\n\n2. Filter or block access to child sexual abuse material or\n\nobscene materials, as defined in Section 1024.1 of Title 21 of the\n\nOklahoma Statutes, or materials that depict child sexual\n\nexploitation, as defined in Section 843.5 of Title 21 of the\n\nOklahoma Statutes.\n\nC. Notwithstanding any contract provision to the contrary, if a\n\nprovider of digital or online library resources fails to comply with\n\nthe requirements of subsection B of this section, the school\n\ndistrict, public charter school, state agency, public library, or\n\ninstitution of higher education shall withhold further payments, if\n\nany, to the provider pending verification of compliance.\n\nD. If a provider of digital or online library database\n\nresources fails to timely verify that the provider is in compliance\n\nwith the safety policies and requirements of subsection B of this\n\nsection, the school district, public charter school, state agency,\n\npublic library, or institution of higher education shall consider\n\nthe provider's act of noncompliance a breach of contract.\n\nE. No later than December 1 of each year, libraries shall\n\nsubmit to the Speaker of the Oklahoma House of Representatives and\n\nPresident Pro Tempore of the Oklahoma State Senate an aggregate\n\nwritten report on any issues related to provider compliance with\n\ntechnology protection measures required by subsection B of this\n\nsection.\n\nF. Employees of school districts, charter schools, virtual\n\ncharter schools, state agencies, public libraries, and universities\n\nshall not be exempt from prosecution for willful violations of state\n\nlaw prohibiting indecent exposure to obscene material or child\n\nsexual abuse material as provided in Section 1021 of Title 21 of the\n\nOklahoma Statutes.\n\nG.
