This act shall be known and may be cited as the “Zachary\n\nEckles and Luke Davis Automated External Defibrillators in Schools\n\nAct”.\n\nB. Contingent upon the availability of federal funding or\n\ndonations from private organizations or persons made for this\n\npurpose, each school district shall make automated external\n\ndefibrillators, as defined in Section 5A of Title 76 of the Oklahoma\n\nStatutes, available at each school site in the district. The school\n\ndistrict may also make automated external defibrillators available\n\nat each high school athletic practice or competition in the\n\ndistrict.\n\nC. A school district that makes automated external\n\ndefibrillators available in schools or on school district property\n\npursuant to this section shall use the guidelines set by a\n\nnationally recognized, guidelines-based organization focused on\n\nemergency cardiovascular care in determining placement of automated\n\nexternal defibrillators on school district property and their\n\nroutine maintenance needs.\n\nD. Any school district that makes automated external\n\ndefibrillators available in schools or on school district property\n\nshall be immune from civil liability for personal injury which\n\nresults from the use of the device, except for acts of gross\n\nnegligence or willful wanton misconduct in accordance with Section\n\n5A of Title 76 of the Oklahoma Statutes.\n\nE. The State Department of Education shall develop and make\n\navailable to school districts a list of private organizations or\n\npersons willing to make donations or that have resources available\n\nto schools for this purpose, federal programs or grants, and any\n\nother source of funding that school districts may use to purchase\n\nautomated external defibrillators.
