Stat. tit. 70, § 70-1210.277","heading":"Confidentiality - Parental consent to screening -","body":"Records.\n\nThe results of individual student screening shall be\n\nconfidential, except that information and results shall on request\n\nbe made available to parents either visually or in written form and\n\nto professional personnel involved in the education of the students,\n\nas determined by the Board. Provided, however, students shall not\n\nbe subjected to individual evaluation without prior written parental\n\npermission except for re-evaluations required pursuant to the IDEA.\n\nIn no case shall the results of any individual student screening or\n\nevaluation by center personnel be made a part of the student's\n\npermanent in-school records. Such individual student records shall\n\nbe destroyed when the information contained therein is no longer\n\nnecessary for carrying out the purposes of this act or when the\n\nstudent reaches the age of eighteen (18), whichever is earlier.\n\nProvided, however, on written request of a parent or legal guardian,\n\nsuch information may be forwarded to a center serving a receiving\n\nschool district. Educational screening and evaluations shall be\n\nmaintained in accordance with the federal regulations for\n\nconfidentiality under the Family Educational Rights and Privacy Act\n\nand the IDEA.
