The parent or guardian of each student enrolled in\n\nkindergarten at a public school in this state shall provide\n\ncertification to school personnel that the student passed a vision\n\nscreening within the previous twelve (12) months or during the\n\nschool year. Such screening shall be conducted by personnel listed\n\non the statewide registry as maintained by the State Department of\n\nHealth, which may include, but not be limited to, Oklahoma licensed\n\noptometrists and ophthalmologists.\n\n2. The parent or guardian of each student enrolled in first or\n\nthird grade at a public school in this state shall provide within\n\nthirty (30) days of the beginning of the school year certification\n\nto school personnel that the student passed a vision screening\n\nwithin the previous twelve (12) months. Such screening shall be\n\nconducted by personnel listed on the statewide registry as\n\nmaintained by the State Department of Health; provided, Oklahoma\n\nlicensed optometrists and ophthalmologists shall be exempt from such\n\nstandards.\n\n3. The parent or guardian of each student who receives a vision\n\nscreening as required by this section shall receive notification\n\nthat a vision screening is not the equivalent of a comprehensive eye\n\nexam.\n\nB. 1. The Infant and Children’s Health Advisory Council\n\ncreated in Section 1-103a.1 of Title 63 of the Oklahoma Statutes\n\nshall make recommendations to the State Commissioner of Health on:\n\na. standards for vision screening and referral; provided,\n\nOklahoma licensed optometrists and ophthalmologists\n\nshall be exempt from such standards,\n\nb. qualifications for initial recognition and renewal of\n\nrecognition of vision screeners,\n\nc. qualifications for initial recognition and renewal of\n\nrecognition of vision screener trainers,\n\nd. qualifications for initial recognition and renewal of\n\nrecognition of trainers of vision screener trainers;\n\nprovided, Oklahoma licensed optometrists and\n\nophthalmologists shall be exempt from any training\n\nrequirements, and\n\ne. grounds for denial, refusal, suspension or revocation\n\nof recognition of vision screeners, vision screener\n\ntrainers and trainers of vision screener trainers.\n\n2. The Department shall:\n\na. establish and thereafter maintain a statewide\n\nregistry, available via the Internet, which shall\n\ncontain a list of approved vision screeners,\n\nb. maintain a list of approved vision screener trainers\n\nand trainers of vision screener trainers,\n\nc. maintain the standards for vision screening and\n\nreferral. Such standards shall permit the use of an\n\nelectronic eye chart as a substitute for a printed eye\n\nchart to assess relative visual acuity. As used in\n\nthis subparagraph, “electronic eye chart” means any\n\ncomputerized or other electronic system, device,\n\nautomated computer program, or method of displaying on\n\nan electronic screen medically accepted and properly\n\nsized optotypes, which may be letters, numbers, or\n\nsymbols, that is used to assess an individual’s visual\n\nacuity. An electronic eye chart shall meet national\n\nstandards of care and shall meet the guidelines\n\nestablished by the 2016 version, or most recent\n\nversion if updated, of the Procedures for the\n\nEvaluation of the Visual System by Pediatricians\n\nproduced by the American Academy of Pediatrics, and\n\nd. subject to availability of funds, maintain a cloud-\n\nbased platform and data management system that is\n\ncompliant with the Health Insurance Portability and\n\nAccountability Act of 1996 and the Family Educational\n\nRights and Privacy Act of 1974 to collect individual\n\nstudent screening results from each school district,\n\nmanage and report on compliance, and act as an\n\nanalytical platform for screening outcomes. The State\n\nDepartment of Education shall share vision screening\n\nresults and any other relevant information with the\n\nState Department of Health for the purpose of\nrivacy Act of 1974 to collect individual\n\nstudent screening results from each school district,\n\nmanage and report on compliance, and act as an\n\nanalytical platform for screening outcomes. The State\n\nDepartment of Education shall share vision screening\n\nresults and any other relevant information with the\n\nState Department of Health for the purpose of\n\nimplementing this subparagraph. The agencies shall\n\nenter into an interagency agreement for the sharing of\n\ninformation as provided by this subparagraph.\n\n3. After notice and hearing, the State Department of Health may\n\ndeny, refuse, suspend or revoke approval to an applicant who has a\n\nhistory of:\n\na. noncompliance or incomplete or partial compliance with\n\nthe provisions of this section or the rules adopted by\n\nthe Commissioner to implement the provisions of this\n\nsection,\n\nb. referring persons to a business in which the applicant\n\nhas a financial interest or a business which is owned\n\nor operated by someone within the third degree of\n\nconsanguinity or affinity of the applicant, or\n\nc. conduct which demonstrates that the applicant is\n\nproviding services in a manner which does not warrant\n\npublic trust.\n\n4. The Commissioner, giving consideration to the\n\nrecommendations of the Council, shall promulgate rules to implement\n\nthe provisions of this section.\n\nC. 1. The parent or guardian of each student who fails the\n\nvision screening required in subsection A of this section shall\n\nreceive a recommendation to undergo a comprehensive eye examination\n\nperformed by an ophthalmologist or optometrist.\n\n2. The ophthalmologist or optometrist shall forward a written\n\nreport of the results of the comprehensive eye examination to the\n\nstudent’s school, parent or guardian, and primary health care\n\nprovider designated by the parent or guardian. The report shall\n\ninclude, but not be limited to:\n\na. date of report,\n\nb. name, address and date of birth of the student,\n\nc. name of the student’s school,\n\nd. type of examination,\n\ne. a summary of significant findings, including\n\ndiagnoses, medication used, duration of action of\n\nmedication, treatment, prognosis, whether or not a\n\nreturn visit is recommended and, if so, when,\n\nf. recommended educational adjustments for the child, if\n\nany, which may include: preferential seating in the\n\nclassroom, eyeglasses for full-time use in school,\n\neyeglasses for part-time use in school, sight-saving\n\neyeglasses, and any other recommendations, and\n\ng. name, address and signature of the examiner.\n\nD. No student shall be prohibited from attending school for a\n\nparent’s or guardian’s failure to furnish a report of the student’s\n\nvision screening or an examiner’s failure to furnish the results of\n\na student’s comprehensive eye examination required by this section.\n\nE. School districts shall notify parents or guardians of\n\nstudents who enroll in kindergarten, first, or third grade for the\n\n2007-08 school year and each year thereafter of the requirements of\n\nthis section.\n\nF. The State Board of Education shall adopt rules for the\n\nimplementation of this section except as provided in subsection B of\n\nthis section.
