Stat. tit. 70, § 70-1210.301","heading":"Definitions","body":"As used in this act:\n\n1. \"Gifted and talented children\" means those children\n\nidentified at the preschool, elementary and secondary level as\n\nhaving demonstrated potential abilities of high performance\n\ncapability and needing differentiated or accelerated education or\n\nservices. For the purpose of this definition, \"demonstrated\n\nabilities of high performance capability\" means those identified\n\nstudents who score in the top three percent (3%) on any national\n\nstandardized test of intellectual ability. Said definition may also\n\ninclude students who excel in one or more of the following areas:\n\na. creative thinking ability,\n\nb. leadership ability,\n\nc. visual and performing arts ability, and\n\nd. specific academic ability.\n\nA school district shall identify children in capability areas by\n\nmeans of a multicriteria evaluation. Provided, with first and\n\nsecond grade level children, a local school district may utilize\n\nother evaluation mechanisms such as, but not limited to, teacher\n\nreferrals in lieu of standardized testing measures;\n\n2. \"Gifted child educational programs\" means those special\n\ninstructional programs, supportive services, unique educational\n\nmaterials, learning settings and other educational services which\n\ndifferentiate, supplement and support the regular educational\n\nprogram in meeting the needs of the gifted and talented child;\n\n3. \"Department\" means the State Department of Education;\n\n4. \"Board\" means the Oklahoma State Board of Education; and\n\n5. \"Act\" means Sections 1210.301 through 1210.307 of this\n\ntitle.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f43c396d9f8aa4295c279afac867a10e13a002333370ff1c21ca0aed0ac5e07b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-1210.285","next":"us-ok/okla.-stat.-tit.-70-70-1210.302"},"notice":"GroundRules: Original legal text.
