Stat. tit. 70, § 70-1210.303","heading":"Duties and responsibilities of Department of","body":"Education.\n\nA. In administering this act the Department of Education shall\n\nprovide:\n\n1. The necessary State Department of Education staff with a\n\nprimary responsibility for:\n\na. developing educational programs for gifted and\n\ntalented children,\n\nb. assuring appropriate assessment and evaluation\n\nprocedures for use by school districts of this state,\n\nand\n\nc. enforcing compliance with the provisions of Sections\n\n1210.301 through 1210.308 of this title by school\n\ndistricts;\n\n2. The procedures for educational screening, needs analysis and\n\nprescriptive programming for gifted and talented children by\n\nRegional Education Service Center personnel and others approved by\n\nthe Department;\n\n3. In-service training for selected teachers, administrators,\n\ncollege personnel, parents and interested lay persons;\n\n4. Assistance in the development of new programs and the\n\nprojection of program alternatives for the eventual provision of\n\nhigh quality programs for all identified gifted and talented\n\nchildren;\n\n5. Recommendations to the State Board of Education concerning\n\nqualifications of teachers for gifted and talented children;\n\n6. Recommendations for degree programs and short course\n\nseminars for the preparation of teaching personnel for gifted and\n\ntalented children;\n\n7. Selected procedural safeguards for all potentially\n\nidentifiable and identified gifted and talented children;\n\n8. Auditing of gifted and talented education programs in\n\ntwenty-five (25) districts selected at random each year to determine\n\ncompliance with the provisions of Sections 1210.301 through 1210.308\n\nof this title as well as program monitoring and auditing for\n\ndistricts with extraordinary numbers of identified students,\n\nidentified students who as a group are not representative of racial\n\nand socioeconomic demographics of district student population,\n\nunusual budget reports, inappropriate implementation policies or\n\nquestionable gifted child programming; and\n\n9. Any other programs, services, supplies or facilities\n\nnecessary to implement the provisions of this act.\n\nB. State Aid to a district shall be reduced by an amount equal\n\nto twice the amount of that portion of State Aid generated by the\n\ngifted and talented weight for each student the district has\n\nidentified as gifted and talented for purposes of Section 18-201 of\n\nthis title and for whom, upon audit by the State Department of\n\nEducation, the district has not demonstrated that the depth,\n\nbreadth, and pace of the curriculum have been and continue to be in\n\ncompliance with the provisions of Sections 1210.301 through 1210.308\n\nof this title. The penalty prescribed in this section shall be\n\nenforced by reducing State Aid to the district during the next\n\nschool year following the audit or completion of an appeal in the\n\namount of the penalty. A district shall be subject to loss of State\n\nAid pursuant to this subsection only upon verification of the\n\ndistrict's failure to provide appropriate programs and services for\n\nidentified gifted and talented students through an audit by the\n\nState Department of Education.
