Stat. tit. 70, § 70-1210.307","heading":"Duty to provide programs - Parent notification of","body":"gifted status - School year plans for programs, yearly reports.\n\nA. It shall be the duty of each school district to provide\n\ngifted child educational programs and to serve those children, as\n\ndefined in Section 1210.301 of this title, who reside in that school\n\ndistrict. This duty may be satisfied by:\n\n1. The district directly providing gifted child educational\n\nprograms for such children;\n\n2. The district joining in a cooperative program with another\n\ndistrict or districts to provide gifted child educational programs\n\nfor such children;\n\n3. The district joining in a cooperative program with a private\n\nor public institution within such district; or\n\n4. The district transferring identified gifted and talented\n\nchildren to other school districts which provide the appropriate\n\ngifted child educational programs, provided, no transfer shall be\n\nmade without the consent of the board of education of the receiving\n\nschool district. The district in which the child resides shall\n\nprovide transportation for the transferred student and pay an amount\n\nof tuition equal to the proportion of the operating costs of the\n\nprogram to the receiving district. Transfers authorized by this\n\nsection shall be made under such rules and regulations as the State\n\nBoard of Education may prescribe.\n\nB. Each district shall, regardless of the method used for\n\naccomplishing the duty set forth in subsection A of this section,\n\nnotify in writing the parents of each child identified as gifted of\n\nthe fact that the child has been so identified. The district shall\n\nalso provide each such parent a summary of the program to be offered\n\nsuch child.\n\nC. Beginning with the 1994-95 school year, and each year\n\nthereafter, each board of education shall submit a plan for gifted\n\nchild educational programs as defined in Section 1210.301 of this\n\ntitle to the State Department of Education which shall include:\n\n1. A written policy statement which specifies a process for\n\nselection and assessment of children for placement in gifted and\n\ntalented programs that is consistent for grades one through twelve;\n\n2. A description of curriculum for the gifted child educational\n\nprogram. Such description shall demonstrate that the curriculum is\n\ndifferentiated from the normal curriculum in pace and/or depth and\n\nthat it has scope and sequence;\n\n3. Criteria for evaluation of the gifted child educational\n\nprogram;\n\n4. Evidence of participation by the local advisory committee on\n\neducation for gifted and talented children in planning, child\n\nidentification process and program evaluation;\n\n5. Required competencies and duties of gifted child educational\n\nprogram staff;\n\n6. Number and percentage of students identified by the district\n\nas gifted children pursuant to subparagraph g of paragraph 2 of\n\nsubsection B of Section 18-201 of this title; and\n\n7. A budget for the district gifted child educational programs.\n\nD. The board of education of each school district shall prepare\n\na report which outlines the expenditures made by the district during\n\nthat year for gifted child educational programs pursuant to the\n\nOklahoma Cost Accounting System, as adopted by the State Board of\n\nEducation pursuant to Section 5-135 of this title.\n\nE. The State Department of Education shall, after each school\n\nyear, report to the President Pro Tempore of the Senate and the\n\nSpeaker of the House of Representatives concerning the number of\n\nchildren identified for the programs, number of children served by\n\nthe programs, type of programs provided, type of screening\n\nprocedures utilized, cost analysis of the programs and the estimated\n\nnumber of gifted and talented children unserved by the programs.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"862acec12849d9802363d794cad98ef89b044802d6acb11c7acb1df9b519d819","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-1210.306","next":"us-ok/okla.-stat.-tit.-70-70-1210.308"},"notice":"GroundRules: Original legal text.
