By no later than December 31, 2016, the State Board of\n\nEducation shall adopt a statewide system of student assessments in\n\ncompliance with the Elementary and Secondary Education Act of 1965\n\n(ESEA), as reauthorized and amended by P.L. No. 114-95, also known\n\nas the Every Student Succeeds Act (ESSA).\n\n2. The statewide student assessment system adopted by the Board\n\npursuant to this subsection shall be aligned with the Oklahoma\n\nAcademic Standards as adopted by the Board and which prepare\n\nstudents for college and careers.\n\nB. 1. The Board shall issue a request for proposals for the\n\nselection of assessments to be administered to students in grades\n\nthree through twelve as a part of the statewide student assessment\n\nsystem adopted by the Board pursuant to this section.\n\n2. The Board shall adopt assessments from the selected\n\nproposals that were submitted pursuant to paragraph 1 of this\n\nsubsection. The adopted assessments shall be administered by the\n\nBoard for a period that is in coordination with the six-year subject\n\narea textbook adoption cycle unless the vendor does not fulfill the\n\nterms of the contract or fails to comply with or violates the terms\n\nof the contract. The Board shall administer the assessments\n\nbeginning with the 2017-2018 school year.\n\nC. The statewide student assessment system adopted by the Board\n\npursuant to this section shall include assessments that:\n\n1. Are aligned with the Oklahoma subject matter standards as\n\nadopted by the Board;\n\n2. Provide a measure of comparability among other states;\n\n3. Yield both norm-referenced scores and criterion-referenced\n\nscores;\n\n4. Have a track record of statistical reliability and accuracy;\n\nand\n\n5. For assessments administered in high school, provide a\n\nmeasure of future academic performance.\n\nD. For the 2016-2017 school year, the Board shall administer\n\nassessments in:\n\n1. English Language Arts or reading and mathematics in grades\n\nthree through eight and at least once in high school, during the\n\ngrade span of nine through twelve;\n\n2. Science not less than once during each grade span of three\n\nthrough five, six through nine, and ten through twelve; and\n\n3. United States History not less than once during the grade\n\nspan of nine through twelve.\n\nE. 1. Beginning with the 2017-2018 school year, the statewide\n\nstudent assessment system shall include assessments in:\n\na. English Language Arts and mathematics in grades three\n\nthrough eight and at least once in high school, during\n\nthe grade span of nine through twelve,\n\nb. science not less than once during each grade span of\n\nthree through five, six through nine, and ten through\n\ntwelve, and\n\nc. United States History, with an emphasis on civics, not\n\nless than once during the grade span of nine through\n\ntwelve.\n\n2. Beginning with the 2017-2018 school year, the statewide\n\nstudent assessment system may include:\n\na. assessments in reading, writing, and mathematics in\n\ncertain grades as determined by the Board, and\n\nb. contingent upon the availability of funds, an\n\nadditional nationally recognized college- and career-\n\nreadiness assessment or assessments as recommended by\n\nthe State Department of Education which will be\n\nadministered to students in high school at no cost to\n\nthe student.\n\nF. 1. Beginning with students entering the ninth grade in the\n\n2017-2018 school year, each student shall take the assessment or\n\nassessments included in the statewide student assessment system\n\nadopted by the Board pursuant to subsection A of this section in\n\norder to graduate from a public high school with a standard diploma.\n\nAll students shall take the assessment or assessments prior to\n\ngraduation, unless otherwise exempt by law.\n\n2. Beginning with students entering the ninth grade in the\n\n2017-2018 school year, each student, in addition to taking the\n\nassessment or assessments included in the statewide student\nt to subsection A of this section in\n\norder to graduate from a public high school with a standard diploma.\n\nAll students shall take the assessment or assessments prior to\n\ngraduation, unless otherwise exempt by law.\n\n2. Beginning with students entering the ninth grade in the\n\n2017-2018 school year, each student, in addition to taking the\n\nassessment or assessments included in the statewide student\n\nassessment system adopted by the Board pursuant to subsection A of\n\nthis section, shall meet any other high school graduation\n\nrequirements adopted by the Board pursuant to Section 5 of Enrolled\n\nHouse Bill No. 3218 of the 2nd Session of the 55th Oklahoma\n\nLegislature in order to graduate from a public high school with a\n\nstandard diploma.\n\n3. For students who start the ninth grade prior to or during\n\nthe 2016-2017 school year, school districts shall adopt a plan that\n\nestablishes the assessment or assessments those students are\n\nrequired to take in order to graduate from a public high school with\n\na standard diploma. The plan may also include any or all of the\n\nother high school graduation requirements adopted by the Board\n\npursuant to Section 5 of Enrolled House Bill No. 3218 of the 2nd\n\nSession of the 55th Oklahoma Legislature that those students will be\n\nrequired to meet in order to graduate from a public high school with\n\na standard diploma.\n\n4. The Board shall promulgate rules to ensure that students who\n\ntransfer into an Oklahoma school district from out-of-state after\n\nthe junior year of high school shall not be denied the opportunity\n\nto be awarded a standard diploma due to differing testing\n\nrequirements.\n\nG. In order to provide an indication of the levels of\n\ncompetency attained by the student in a permanent record for\n\npotential future employers and institutions of higher education,\n\nschool districts shall report on the high school transcript of the\n\nstudent the highest-achieved score on the assessment or assessments\n\nincluded in the statewide student assessment system adopted by the\n\nBoard pursuant to subsection A of this section and any business- and\n\nindustry-recognized endorsements attained.\n\nH. Students who do not perform at a proficiency level on\n\nassessments shall be remediated as established in the assessment\n\nrequirements adopted by the Board pursuant to Section 5 of Enrolled\n\nHouse Bill No. 3218 of the 2nd Session of the 55th Oklahoma\n\nLegislature, subject to the availability of funding.\n\nI. 1. All assessments required by this section shall measure\n\nacademic competencies in correlation with the subject matter\n\nstandards adopted by the Board pursuant to Sections 11-103.6 and 11-\n\n103.6a of this title and referred to as the Oklahoma Academic\n\nStandards. The State Board of Education shall evaluate the subject\n\nmatter standards to ensure the competencies reflect high standards,\n\nare specific, well-defined, measurable, and challenging, and will\n\nprepare elementary students for next-grade-level course work and\n\nsecondary students for postsecondary studies at institutions of\n\nhigher education or technology center schools without the need for\n\nremediation. All subject matter standards shall reflect the goals\n\nas set forth in Section 11-103.6 of this title and of improving the\n\nstate average of college entrance exam scores.\n\n2. The State Department of Education shall annually evaluate\n\nthe results of the assessments. The State Board of Education shall\n\nensure that preliminary results for all statewide assessments are\n\nreported to districts no later than June 20 of each year and are\n\npresented in a manner that yields detailed, diagnostic information\n\nfor the purpose of guiding instruction and student remediation. As\n\nimprovements are made to the assessments required by this section,\n\nthe Board shall seek to increase the depth of knowledge assessed for\n\neach subject. The State Board of Education shall seek to ensure\norted to districts no later than June 20 of each year and are\n\npresented in a manner that yields detailed, diagnostic information\n\nfor the purpose of guiding instruction and student remediation. As\n\nimprovements are made to the assessments required by this section,\n\nthe Board shall seek to increase the depth of knowledge assessed for\n\neach subject. The State Board of Education shall seek to ensure\n\nthat data yielded from the assessments required in this section are\n\nutilized at the school district level to inform instruction,\n\nprofessional development, school improvement, and remediation for\n\nstudents.\n\n3. The Commission for Educational Quality and Accountability\n\nshall determine the cut scores for the performance levels on all\n\nstatewide assessments. The Commission shall conduct an ongoing\n\nreview to compare the statewide assessment content and performance\n\ndescriptors with those of other states. Upon receipt of the review,\n\nthe Commission may adjust the cut scores as necessary.\n\n4. The State Board of Education, for the purposes of conducting\n\nreliability and validity studies, monitoring contractor adherence to\n\nprofessionally accepted testing standards, and providing\n\nrecommendations for testing program improvement, shall retain the\n\nservices of an established, independent agency or organization that\n\nis nationally recognized for its technical expertise in educational\n\ntesting but is not engaged in the development of aptitude or\n\nachievement tests for elementary or secondary level grades. These\n\nnational assessment experts shall annually conduct studies of the\n\nreliability and validity of the statewide assessments administered\n\npursuant to this section. Validity studies shall include studies of\n\ndecision validity and concurrent validity.\n\nJ. 1. The State Board of Education shall promulgate rules\n\nsetting the assessment window dates for each statewide assessment so\n\nthat the assessments are administered according to recommended\n\ntesting protocols and so that the assessment results are reported\n\nback to school districts in a timely manner. The vendor shall\n\nprovide a final electronic data file of all school site, school\n\ndistrict, and state results to the State Department of Education and\n\nthe Office of Educational Quality and Accountability prior to August\n\n20 of each year. The Department shall forward the final data files\n\nfor each school district and each school site in that district to\n\nthe school district. The Board shall ensure the contract with the\n\nvendor includes a provision that the vendor report assessment\n\nresults directly to the Office of Educational Quality and\n\nAccountability at the same time it is reported to the Board.\n\n2. State, district, and site level results of all assessments\n\nrequired in this section shall be disaggregated by gender, race,\n\nethnicity, disability status, migrant status, English proficiency,\n\nand status as economically disadvantaged, except that such\n\ndisaggregation shall not be required in a case in which the number\n\nof students in a category is insufficient to yield statistically\n\nreliable information or the results would reveal personally\n\nidentifiable information about an individual student. Each school\n\nsite shall notify the student’s parents or legal guardians of the\n\nschool’s performance levels in the Oklahoma School Testing Program\n\nas reported in the Oklahoma Educational Indicators Program at the\n\nend of each school year.\n\nK. The State Board of Education shall be responsible for the\n\nfield-testing and validation of the statewide assessment system\n\nrequired in subsection A of this section.\n\nL. The State Board of Education shall develop, administer, and\n\nincorporate as a part of the Oklahoma School Testing Program other\n\nassessment programs or procedures including appropriate\n\naccommodations for the assessment of students with disabilities as\n\nrequired by the Individuals with Disabilities Education Act (IDEA),\nthe statewide assessment system\n\nrequired in subsection A of this section.\n\nL. The State Board of Education shall develop, administer, and\n\nincorporate as a part of the Oklahoma School Testing Program other\n\nassessment programs or procedures including appropriate\n\naccommodations for the assessment of students with disabilities as\n\nrequired by the Individuals with Disabilities Education Act (IDEA),\n\n20 U.S.C., Section 1400 et seq.\n\nM. For purposes of developing and administering alternate\n\nassessments for students with the most significant cognitive\n\ndisabilities, the State Board of Education shall not be subject to\n\nsubsections D and E of Section 11-103.6a of this title.\n\nN. By December 15, 2026, and annually thereafter, the State\n\nBoard of Education shall electronically submit a report to the\n\nLegislature containing data collected for the most recently\n\ncompleted school year on the number and demographics of students who\n\nwere eligible for advanced mathematics courses, the number and\n\ndemographics of students who were placed in advanced mathematics\n\ncourses, the number and demographics of students placed in\n\nmathematics intervention courses, and the number and demographics of\n\nstudents not placed in advanced mathematic courses or mathematic\n\nintervention courses. The report shall include information on the\n\ntype and format of advanced mathematic courses and the type and\n\nformat of mathematic intervention courses.\n\nO.
