Whenever the State Board of Education determines that an\n\nelementary school district, as defined in Section 5-103 of Title 70\n\nof the Oklahoma Statutes, has failed to meet financial requirements\n\nfor school districts or accreditation standards which negatively\n\naffects education or could result in the elementary school district\n\nnot being able to operate for the remainder of the year, the Board\n\nmay issue an administrative order placing the elementary school\n\ndistrict under full state intervention. Prior to an order for full\n\nstate intervention being issued by the Board, the State Department\n\nof Education shall notify the elementary school district that full\n\nstate intervention is likely. The elementary school district shall\n\nhave the opportunity to appear before the State Board of Education\n\nby filing a request within fifteen (15) days of receipt of the\n\nnotice. At the meeting, the elementary school district\n\nadministration, school patrons, and board of education members shall\n\nhave an opportunity to provide information to the Board. The Board\n\nmay issue an order calling for full state intervention which shall\n\nbecome effective immediately unless the order is stayed by a court\n\nof competent jurisdiction. The order shall be effective for not\n\nmore than two (2) school years. The order may be extended upon\n\nreview of the Board. Any appeal of the order shall be made to the\n\ndistrict court of the county in which the elementary school district\n\nis located.\n\nB. Full state intervention by the State Board of Education may\n\ninclude:\n\n1. Developing and imposing a corrective action plan for the\n\nelementary school district;\n\n2. Appointing a superintendent to serve the elementary school\n\ndistrict; and\n\n3. Selection of a federally recognized Indian tribe within the\n\nState of Oklahoma to provide direct oversight of the elementary\n\nschool district or to assume complete control of the elementary\n\nschool district, provided the elementary school district is within\n\nthe boundaries of the tribe's jurisdiction.\n\nC.
