Stat. tit. 70, § 70-1210.544","heading":"Alternative governance arrangements - Assumption of","body":"control by State Board of Education\n\nA. Notwithstanding any other provision of law, the State Board\n\nof Education shall establish a process to identify schools in the\n\nstate that are listed as in need of improvement in accordance with\n\n20 U.S.C., Section 6301 et seq. A school district board of\n\neducation with a school identified as being among the schools in the\n\nstate that are in need of improvement shall implement a locally\n\ndeveloped, evidence-based intervention model for the school site\n\ndetermined by the Board to be low performing\n\nB. 1. Consistent with 20 U.S.C., Section 6301 et seq., for\n\nschools that are identified for school improvement by the Board for\n\nfour (4) consecutive years, the district board of education shall\n\nseek support from the State Department of Education. Such support\n\nmay include academic intervention, professional development,\n\nrestructuring of the governance arrangement of the school or any\n\nother plan that is reasonably calculated to improve student academic\n\nachievement in the school . State support plans shall be designed\n\nto provide a substantial assurance of enabling the school to\n\nappropriately serve all students. If after two (2) years of\n\nimplementing the state support plan, improvements to student\n\nachievement remain insufficient and, in accordance with 20 U.S.C.\n\nSection 6301 et seq., the school continues to be identified by the\n\nBoard as low performing, the Board may exercise the option of\n\nassuming control of the school as provided for in this subsection.\n\n2. If the Board assumes control of a school, the Board shall\n\nretain all funds that otherwise would have been allocated to the\n\nschool district based on the average daily membership of the school\n\nwhich shall be used to operate the school.\n\nC. 1. A district board of education for a district with an\n\naverage daily membership of more than 30,000 which implements an\n\nalternative governance arrangement as provided for in this section\n\nmay utilize the following procedures, upon approval of the district\n\nboard and concurrence of the executive committee of the appropriate\n\nlocal bargaining unit:\n\na. any teacher not retained at the school site shall be\n\ngiven status as a full-time substitute teacher within\n\nthe school district for a period of not to exceed two\n\n(2) years,\n\nb. if the teacher is not offered a contract teaching\n\nposition at a school in the district within the two-\n\nyear period specified in subparagraph a of this\n\nparagraph, the district board shall be authorized to\n\nnot reemploy the teacher, and\n\nc. the district board shall designate trained, certified,\n\ninstructional staff to provide teacher support,\n\ndevelopment and evaluation, which may include\n\ncertified personnel other than administrators.\n\n2. Any actions taken pursuant to this subsection shall not be\n\nsubject to the Teacher Due Process Act of 1990. The decision by the\n\ndistrict board for renewal or nonrenewal shall be final.\n\n3. For purposes of this subsection, a full-time substitute\n\nteacher shall perform the duties assigned by the district\n\nsuperintendent and shall continue to receive the same salary,\n\nbenefits and step increases that the teacher would otherwise be\n\nentitled to for the time period the teacher serves as a full-time\n\nsubstitute.\n\nD. 1. Each school district subject to the provisions of\n\nsubsection B of this section shall submit a plan for compliance with\n\nthis section to the State Department of Education, in a manner\n\nprescribed by the Department.\n\n2.
