Except as otherwise provided, as part of the accountability\n\nsystem developed as provided for in Section 1210.541 of this title,\n\nthe State Board of Education shall prepare annual reports of the\n\nresults of the Oklahoma School Testing Program which describe\n\nstudent achievement in the state, and each school site, pursuant to\n\nthe Elementary and Secondary Education Act of 1965 (ESEA) as\n\nreauthorized by P.L. No. 114-95, also known as the Every Student\n\nSucceeds Act (ESSA), and any related federal regulations.\n\nB. The annual report as required pursuant to subsection A of\n\nthis section shall identify school sites as having one of the\n\nfollowing grades for each indicator, separately, and by a single\n\noverview grade of all indicators, defined according to rules of the\n\nState Board of Education:\n\n1. “A” means schools making excellent progress;\n\n2. “B” means schools making above average progress;\n\n3. “C” means schools making satisfactory progress;\n\n4. “D” means schools making less than satisfactory progress;\n\nand\n\n5. “F” means schools failing to make adequate progress.\n\nC. Each school that has students who are tested and included in\n\nthe school grading system as provided for in this section shall\n\nreceive a school grade, except as follows:\n\n1. A school shall not receive a school grade if the number of\n\nstudents tested and included in the school grading system is less\n\nthan the minimum sample size necessary for statistical reliability\n\nand prevention of the unlawful release of personally identifiable\n\nstudent data. The State Board of Education is directed to establish\n\nthe lowest minimum sample size necessary to meet the requirements of\n\nthis paragraph; and\n\n2. The academic performance of students who are enrolled full-\n\ntime in an online program that is offered by a school district or\n\ncharter school that is not the district of residence or is not\n\nlocated in the district of residence of the student shall be\n\nreported separately by the school district or charter school and\n\nshall not be included when determining the grade of the school site\n\nor charter school.\n\nD. The State Board of Education may adopt alternate systems of\n\naccountability for statewide virtual charter schools, alternative\n\neducation programs as defined in Section 1210.568 of this title, and\n\nschools serving only grades prekindergarten or kindergarten through\n\ntwo.\n\nE. The grade of a school shall be based on a multimeasures\n\napproach to accountability in accordance with the Elementary and\n\nSecondary Education Act of 1965 (ESEA) as reauthorized by P.L. No.\n\n114-95, also known as the Every Student Succeeds Act (ESSA) and any\n\nfederal regulations that include, but are not limited to, the\n\nfollowing indicators:\n\n1. Statewide assessments including the establishment of student\n\nperformance bands;\n\n2. Graduation rates for high schools;\n\n3. Statewide academic measures for elementary and middle\n\nschools;\n\n4. English language proficiency for English learners; and\n\n5. At least one additional statewide measure of school quality\n\nor student success including, but not limited to, school climate,\n\nschool safety, student engagement, educator engagement, and/or\n\nadvanced coursework and postsecondary readiness. Chronic\n\nabsenteeism shall not be included as a statewide measure of school\n\nquality or student success.\n\nF. The grade of an elementary or middle school site shall\n\ninclude, but not be limited to:\n\n1. Up to forty (40) points based on a measure of status for\n\nEnglish language arts (ELA), math, and science;\n\n2. Up to thirty-five (35) points based on growth in ELA and\n\nmath; and\n\n3. Up to ten (10) points based on English language proficiency\n\nassessment (ELPA) progress.\n\nG. The grade of a high school site shall include, but not be\n\nlimited to:\n\n1. Up to fifty-five (55) points based on a measure of status\n\nfor English language arts (ELA), math, and science;\nglish language arts (ELA), math, and science;\n\n2. Up to thirty-five (35) points based on growth in ELA and\n\nmath; and\n\n3. Up to ten (10) points based on English language proficiency\n\nassessment (ELPA) progress.\n\nG. The grade of a high school site shall include, but not be\n\nlimited to:\n\n1. Up to fifty-five (55) points based on a measure of status\n\nfor English language arts (ELA), math, and science;\n\n2. Up to ten (10) points based on English language proficiency\n\nassessment (ELPA) progress;\n\n3. Up to ten (10) points based on the graduation rate; and\n\n4. Up to ten (10) points based on postsecondary opportunities.\n\nFor purposes of this section, postsecondary opportunities shall\n\ninclude advanced placement, International Baccalaureate, dual and\n\nconcurrent enrollment, scoring Silver level or above on American\n\nCollege Testing (ACT) WorkKeys, internships, mentorships and\n\napprenticeships, military readiness as evidenced by being accepted\n\nfor enlistment into any branch of the military within the first year\n\nafter high school graduation or earning a military readiness score\n\non the Armed Services Vocational Aptitude Battery (ASVAB), and\n\nindustry certifications. The Board shall adopt a timeline for\n\nmoving from completion of such opportunities to crediting\n\nachievement of such opportunities.\n\nH. Elementary, middle, and high school sites shall be eligible\n\nfor the following bonus point amounts to be used in the calculation\n\nof the site’s single overview grade:\n\n1. Up to three (3) bonus points if the school site provides in-\n\nperson classroom instruction in excess of the requirements of\n\nparagraphs 1 and 2 of subsection A of Section 1-109 of this title,\n\nnot including in-person classroom instruction time used for\n\nprofessional development or parent-teacher conferences; and\n\n2. Up to two (2) bonus points if the school site’s chronic\n\nabsenteeism rate shows improvement.\n\nI. The annual report shall identify the performance of each\n\nschool as having improved, remained the same, or declined. This\n\nschool improvement rating shall be based on a comparison of the\n\nstudent and school performance data of the current year to the\n\nprevious year data.\n\nJ. The State Department of Education shall annually develop a\n\nschool site report card to be delivered to parents or legal\n\nguardians throughout each school district. The report card shall be\n\nin accordance with the requirements of the Elementary and Secondary\n\nEducation Act of 1965 (ESEA) as reauthorized and amended by P.L. No.\n\n114-95, also known as the Every Student Succeeds Act (ESSA), and\n\ninclude the grade for the school, information regarding school\n\nimprovement, an explanation of school performance, and indicators of\n\nreturn on investment. The report card for each school site shall be\n\npublished annually by the Department on its website, and every\n\nschool district shall provide the school site report card to the\n\nparent or legal guardian of each student enrolled in the school\n\nsite. In order to provide information regarding school performance\n\nfor school report cards issued during the 2016-2017 and 2017-2018\n\nschool years, the Department shall include an explanation of the\n\nchanges to the statewide system of student assessments as required\n\nin Section 1210.508 of this title and how the transition in\n\nassessments may impact school performance. The Department shall\n\nissue school report cards using the 2016-2017 school year assessment\n\ndata that is available.\n\nK. The Legislature may factor in the performance of schools in\n\ncalculating any performance-based funding policy that is provided to\n\npublic school districts.\n\nL. The State Board of Education shall amend the ESSA\n\nconsolidated State plan in accordance with the requirements of the\n\nEvery Student Succeeds Act (ESSA) to replace the measure of chronic\n\nabsenteeism to reflect the provisions of this section. The Board\n\nshall submit the proposed amendment to the United States Department\normance-based funding policy that is provided to\n\npublic school districts.\n\nL. The State Board of Education shall amend the ESSA\n\nconsolidated State plan in accordance with the requirements of the\n\nEvery Student Succeeds Act (ESSA) to replace the measure of chronic\n\nabsenteeism to reflect the provisions of this section. The Board\n\nshall submit the proposed amendment to the United States Department\n\nof Education no later than August 1, 2025.\n\nM.
