Stat. tit. 70, § 70-1210.568","heading":"Statewide system of alternative education programs -","body":"Implementation contingency - Verification of expenditure levels.\n\nA. 1. Beginning with the first semester of the 1996-1997\n\nschool year, the State Board of Education shall implement a\n\nstatewide system of alternative education programs which shall be\n\nphased-in within seven (7) years. The statewide system shall\n\ninclude but not be limited to Alternative Approaches grant programs,\n\nfunded pursuant to Section 1210.561 of this title, and alternative\n\nacademies or alternative programs implemented pursuant to this\n\nsection.\n\n2. Beginning with the first semester of the 2020-2021 school\n\nyear, the State Board of Education shall implement a statewide\n\nsystem of alternative education. The statewide system shall include\n\nalternative education programs implemented pursuant to this section.\n\nB. All school districts of this state serving students in\n\ngrades seven through twelve shall provide alternative education\n\nprograms that conform to the requirements of statutes and rules\n\napplicable to alternative education. A program shall:\n\n1. Allow class sizes and student/teacher ratios which are\n\nconducive to effective learning for at-risk students;\n\n2. Incorporate appropriate structure, curriculum, and\n\ninteraction and reinforcement strategies designed to provide\n\neffective instruction;\n\n3. Include an intake and screening process to determine\n\neligibility of students;\n\n4. Demonstrate that teaching faculty are appropriately\n\ncertified teachers;\n\n5. Demonstrate that teaching faculty have been selected on the\n\nbasis of a record of successful work with at-risk students or\n\npersonal and educational factors that qualify them for work with at-\n\nrisk students;\n\n6. Reflect appropriate collaborative efforts with state\n\nagencies and local agencies serving youth;\n\n7. Provide courses that meet the academic curricula standards\n\nadopted by the State Board of Education and additional remedial\n\ncourses;\n\n8. Offer individualized instruction;\n\n9. State clear and measurable program goals and objectives;\n\n10. Include counseling and social services components;\n\n11. Require a plan leading to graduation be developed for each\n\nstudent in the program which will allow the student to participate\n\nin graduation exercises at the sending school or district after\n\nmeeting the requirements of the school district as specified in the\n\nindividual graduation plan for that student; provided, the\n\ngraduation plan required by this paragraph shall not be separate\n\nfrom the plan required by Section 1210.508-4 of this title;\n\n12. Offer life skills instruction;\n\n13. Provide opportunities for hands-on arts education to\n\nstudents, including artist residency programs coordinated with the\n\nOklahoma Arts Council;\n\n14. Provide a proposed annual budget;\n\n15. Be appropriately designed to serve middle school, junior\n\nhigh school and high school students in grades seven through twelve\n\nwho are most at risk of not completing a high school education for a\n\nreason other than that identified in Section 13-101 of this title;\n\nand\n\n16. Allow students in the alternative education program, who\n\notherwise meet all of the participation requirements, to participate\n\nin vocational programs and extracurricular activities at the sending\n\nschool or district, including but not limited to athletics, band,\n\nand clubs.\n\nC. The alternative education program of a school district shall\n\nbe operational and serving students by September 1 of each school\n\nyear.\n\nD. 1. Each alternative education program of a school district\n\nshall receive funding based on the average daily membership (ADM) of\n\nstudents served by an alternative education program in the prior\n\nschool year according to the annual statistical report conducted by\n\nthe State Department of Education. The per-student funding amount\n\nshall be based on the funding available for the program each fiscal\n\nyear.\nh alternative education program of a school district\n\nshall receive funding based on the average daily membership (ADM) of\n\nstudents served by an alternative education program in the prior\n\nschool year according to the annual statistical report conducted by\n\nthe State Department of Education. The per-student funding amount\n\nshall be based on the funding available for the program each fiscal\n\nyear.\n\n2. Of the funding available for alternative education programs\n\neach fiscal year, the State Department of Education shall designate\n\nup to fifteen percent (15%) for districts participating in\n\ncooperative agreements for alternative education services, which\n\nshall be allocated on a pro rata basis as an incentive to each\n\nparticipating district. The incentive amount received by each\n\ndistrict for participating in a cooperative agreement shall not\n\nexceed Six Thousand Dollars ($6,000.00) per fiscal year and shall be\n\nin addition to the per-student funding amount required by paragraph\n\n1 of this subsection. Any funds remaining after allocations\n\nrequired by this paragraph are made shall be distributed to\n\ndistricts in accordance with paragraph 1 of this subsection.\n\n3. Statewide alternative education funding shall not be used to\n\nsupplant existing school district resources or to support programs\n\nthat do not meet all the criteria for the statewide alternative\n\neducation system.\n\nE. All statewide alternative education funds received and\n\nexpended for students participating in an alternative education\n\nprogram shall be reported to the State Department of Education by\n\nmajor object codes and by program classifications pursuant to the\n\nOklahoma Cost Accounting System as adopted by the State Board of\n\nEducation pursuant to Section 5-135 of this title.\n\nF. Elementary school districts, as defined in Section 5-103 of\n\nthis title, may request a waiver by May 15 of each year from the\n\nState Board of Education from the requirements of this section to\n\nimplement and provide an alternative education program. Any request\n\nfor a waiver shall be accompanied by an assurance that the school\n\ndistrict does not have students in need of alternative education\n\nservices. If a school district is granted a waiver, no statewide\n\nalternative education funding shall be allocated to the district.\n\nG. 1. The State Board of Education shall:\n\na. provide initial and ongoing training of personnel who\n\nwill educate at-risk populations through alternative\n\neducation programs,\n\nb. provide technical assistance to school districts to\n\nenhance the probability of success of their\n\nalternative education programs,\n\nc. evaluate state-funded alternative education programs,\n\nd. report the evaluation results of state-funded\n\nalternative education programs, and\n\ne. provide in-depth program analysis and evaluation of\n\nstate-funded alternative education programs.\n\n2. The State Board of Education may create an evaluation\n\nschedule for effective and highly effective programs, requiring them\n\nto be evaluated not less than once every three (3) years.\n\n3. The State Board of Education may contract with a technical\n\nassistance provider in order to meet the requirements of this\n\nsubsection.\n\n4. The State Board of Education shall have the authority to\n\nsuspend funds for an alternative education program that does not\n\nmeet the requirements of subsection B of this section. Provided,\n\nany school district under consideration for suspension of funds may\n\nrequest a hearing before the Board with a review of the evaluation\n\nprior to the Board's final determination.\n\nH. All alternative education programs shall be subject to\n\nstatutes and rules applicable to alternative education, including\n\nany exemptions from statutory or regulatory requirements authorized\n\nby statutes or rule.\n\nI. An alternative education program may be offered by an\n\nindividual school district or may be offered jointly by school\nof the evaluation\n\nprior to the Board's final determination.\n\nH. All alternative education programs shall be subject to\n\nstatutes and rules applicable to alternative education, including\n\nany exemptions from statutory or regulatory requirements authorized\n\nby statutes or rule.\n\nI. An alternative education program may be offered by an\n\nindividual school district or may be offered jointly by school\n\ndistricts that have formed interlocal cooperative agreements\n\npursuant to Section 5-117b of this title. Any school district\n\nsubmitting a plan for an alternative education program serving fewer\n\nthan ten students shall enter into a cooperative agreement with\n\nanother school district to jointly provide the program unless the\n\nprogram has been granted a waiver from this requirement by the State\n\nBoard of Education. A school district participating in a\n\ncooperative agreement shall be required to send its alternative\n\neducation funding allocation to the cooperative.\n\nJ. Any materials or equipment purchased by a school district\n\nwith revenue received for students participating in an alternative\n\neducation program shall be used only in or directly for the\n\nalternative education program offered by the district or any\n\nsubsequent alternative education program offered to students\n\nenrolled in that district.
