Contingent upon the provision of appropriated funds\n\ndesignated for such purpose, students who do not perform\n\nsatisfactorily on the mathematics portion of either the norm-\n\nreferenced or criterion-referenced tests for grades three through\n\neight required pursuant to Section 1210.508 of this title shall be\n\nprovided remediation. The remediation may include but not be\n\nlimited to tutorial instruction after regular school hours, on\n\nSaturdays and during the summer. Such instruction shall not be\n\ncounted toward the one-hundred-eighty-day school year required in\n\nSection 1-109 of this title.\n\nB. Implementation of this section shall be delayed until the\n\ncurrent expenditure per pupil in average daily attendance in public\n\nelementary and secondary schools in unadjusted dollars for the 1998-\n\n99 school year or any school year thereafter for Oklahoma, as\n\nreported by the National Center for Education Statistics annually in\n\nthe Digest of Education Statistics, reaches at least ninety percent\n\n(90%) of the regional average expenditure for that same year, and\n\nfunds are provided. For purposes of this section, the regional\n\naverage expenditure shall consist of the current expenditure per\n\npupil in average daily attendance in public elementary and secondary\n\nschools in unadjusted dollars for each of the following states:\n\nArkansas, Colorado, Kansas, Missouri, New Mexico, Oklahoma, and\n\nTexas, averaged together. By January 1 of each year, the State\n\nBoard of Education shall report whether or not the ninety-percent\n\nexpenditure level has been reached based on information reported\n\nannually in the Digest of Education Statistics by the National\n\nCenter for Education Statistics.
