If a teacher determines that a student in second, third,\n\nfourth, and fifth grade is performing above grade level in\n\nmathematics by the start of the second quarter of the school year,\n\nthe parent or legal guardian of the student shall be notified of:\n\n1. The math proficiency level of the student;\n\n2. The program of advanced math instruction available for the\n\nstudent; and\n\n3. The potential for the student to participate in a summer\n\nacademy or other program designed to assist the student in excelling\n\nin mathematics.\n\nB. If a teacher determines that a student in second, third,\n\nfourth, and fifth grade is not performing at grade level in\n\nmathematics by the start of the second quarter of the school year,\n\nthe parent or legal guardian of the student shall be notified of:\n\n1. The math proficiency level of the student;\n\n2. The program of math instruction for the student as required\n\npursuant to this act; and\n\n3. The potential need for the student to participate in a\n\nsummer academy or other program designed to assist the student in\n\nattaining grade-level math proficiency.\n\nC. A teacher who determines a student in second, third, fourth,\n\nand fifth grade is exceeding or not meeting grade-level targets for\n\nmathematics may, after consultation with the parent or legal\n\nguardian of the student, recommend that the student participate in\n\nand complete a summer academy or other program.\n\nD. Summer academy programs shall be designed to ensure that\n\nparticipating students successfully complete an advanced\n\nmathematical program or grade-level competencies in mathematics to\n\nenhance next-grade readiness. A summer academy math program shall\n\nbe a program that incorporates the content of a scientifically\n\nresearch-based professional development program administered by the\n\nCommission for Educational Quality and Accountability or a\n\nscientifically research-based math program administered by the State\n\nBoard of Education which is taught by teachers who have successfully\n\ncompleted professional development in the math program. All summer\n\nacademy programs shall consist of a minimum of three (3) consecutive\n\ndays. The State Department of Education shall provide a list of\n\nqualified entities for providing the summer academy programs to all\n\nschools by April 1, 2026.\n\nE. School districts may approve an option for students who are\n\nunable to attend a summer academy. The optional program may\n\ninclude, but not be limited to, an approved private provider of\n\ninstruction, approved computer- or Internet-based instruction, or an\n\napproved program of math instruction monitored by the parent or\n\nlegal guardian of the student. Public school districts shall not be\n\nrequired to pay for the optional program but shall clearly\n\ncommunicate to the parent or legal guardian the expectations of the\n\nprogram and any costs that may be involved.\n\nF. Subject to the availability of funds, beginning one (1) year\n\nafter implementation of this section, the requirements of subsection\n\nC of this section may be expanded to apply to students in first\n\ngrade. Each year thereafter, the requirements may be expanded by\n\none grade level until the requirements apply to kindergarten\n\nstudents through fifth-grade students. Summer academy programs\n\nshall be designed for each grade level. Nothing in this section\n\nshall prevent the State Board of Education or a school district\n\nboard of education from utilizing private, local, or federal funds\n\nto implement the provisions of this section.\n\nG. The State Board of Education shall promulgate rules to\n\nimplement the provisions of this section, which shall include\n\nrequirements for instructional time for summer academy programs,\n\nteacher qualifications, and evaluation of student achievement as a\n\nresult of summer academy programs or other optional programs.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a44ba801b021a06647e57726c5d5f08a301ee544affc526d97833051560e3eb0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-1210.902","next":"us-ok/okla.-stat.-tit.-70-70-1210.904"},"notice":"GroundRules: Original legal text.
