Stat. tit. 70, § 70-13-101","heading":"Special education and related services for children","body":"with disabilities - Cooperative programs - Funding - Duty to provide\n\nspecial services.\n\nThe several school districts of Oklahoma are hereby authorized\n\nto provide special education and related services necessary for\n\nchildren with disabilities as hereinafter defined. Two or more\n\nschool districts may establish cooperative programs of special\n\neducation for children with disabilities when such arrangement is\n\napproved by the State Board of Education. Funds may be expended for\n\nschool services for an additional period during the summer months\n\nfor approved programs for qualified children with disabilities,\n\nprovided their individualized education program (I.E.P.) states the\n\nneed for extended school year special education and related\n\nservices. Children with disabilities shall mean children, as\n\ndefined in the Individuals with Disabilities Education Act (IDEA),\n\nP.L. No. 105-17, who are three (3) years of age.\n\nProvided, on and after July 1, 1991, children from age birth\n\nthrough two (2) years (0-36 months) of age who meet the eligibility\n\ncriteria specified in Section 13-123 of this title, shall be served\n\npursuant to the provisions of the Oklahoma Early Intervention Act.\n\nThe attendance of said children in special education classes shall\n\nbe included in the average daily membership computations for State\n\nAid purposes.\n\nThe State Board of Education is authorized to modify and\n\nredefine by regulation the eligibility definitions whenever such\n\nmodification is required to receive federal assistance under the\n\nIndividuals with Disabilities Education Act (IDEA), P.L. No. 105-17.\n\nRules developed pursuant to Section 18-109.5 of this title shall\n\nprovide for such modification and revised definitions.\n\nIt shall be the duty of each school district to provide special\n\neducation and related services for all children with disabilities as\n\nherein defined who reside in that school district in accordance with\n\nthe Individuals with Disabilities Education Act (IDEA), P.L. No.\n\n105-17. This duty may be satisfied by:\n\n1. The district directly providing special education for such\n\nchildren;\n\n2. The district joining in a cooperative program with another\n\ndistrict or districts to provide special education for such\n\nchildren;\n\n3. The district joining in a written agreement with a private\n\nor public institution, licensed residential child care and treatment\n\nfacility or day treatment facility within such district to provide\n\nspecial education for children who are deaf or hard-of-hearing,\n\nchildren who are blind or partially blind or other eligible children\n\nwith disabilities; or\n\n4. Transferring eligible children and youth with disabilities\n\nto other school districts which accept them and provide special\n\neducation and related services for such children, with the district\n\nin which the child resides paying tuition therefor as hereinafter\n\nprovided. For those students who transfer pursuant to the\n\nprovisions of the Education Open Transfer Act, the receiving school\n\ndistrict shall assume all responsibility for education and shall\n\ncount the student for federal and state funding purposes according\n\nto the provisions of subsection B of Section 13-103 of this title.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f5d9ab170bf05138200c87409c9d46eb006ad9f9bea1916fe8c8e3ed7b6cedcb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-1210.907","next":"us-ok/okla.-stat.-tit.-70-70-13-101.1"},"notice":"GroundRules: Original legal text.
