Stat. tit. 70, § 70-13-114.3","heading":"Oklahoma Special Education Assistance Fund -","body":"Defraying costs of serving children who resided at Hissom Memorial\n\nCenter - Funding other services - Determination of home district.\n\nA. A local school district may be eligible to receive monies\n\nfrom the Oklahoma Special Education Assistance Fund to defray costs\n\nof serving children who resided at Hissom Memorial Center prior to\n\nDecember 1, 1991, and subsequently established residency in the\n\nschool district if any such children were served by the district\n\nduring the 1991-92 school year including extended school year during\n\nsummer 1992 or the 1992-93 school year including extended school\n\nyear during summer 1993. Contingent upon available funds in the\n\nOklahoma Special Education Assistance Fund, the district shall\n\nreceive funds in the amount of the actual costs of serving each\n\nchild less the district per capita and any other funding received\n\nfor providing services to the child from another state agency upon\n\ntimely submission of a claim for such amount, accompanied by\n\nverification of residency of each child by the school attendance\n\nofficer and verification from the Department of Human Services that\n\neach child formerly resided at Hissom Memorial Center.\n\nB. If funds remain in the Oklahoma Special Education Assistance\n\nFund after satisfaction of all valid claims submitted pursuant to\n\nsubsection A of this section, a local school district may be\n\neligible to receive monies from the Oklahoma Special Education\n\nAssistance Fund if a child with disabilities who is being served in\n\nthat school district:\n\n1. Has been placed in out-of-home placement in an entity\n\ndescribed in subsection D of Section 1-113 of this title;\n\n2. Has been previously institutionalized; or\n\n3. Requires services pursuant to an individualized education\n\nprogram (IEP) pursuant to the Individuals with Disabilities\n\nEducation Act (IDEA) which result in extraordinary costs to the\n\nproviding school district or district of residence. The State Board\n\nof Education may promulgate rules to define extraordinary costs,\n\ntaking into consideration the funding generated by the weighted\n\ncalculations relating to students with special needs as provided in\n\nparagraph 2 of subsection B of Section 18-201.1 of this title.\n\nC. The State Department of Education may prorate any funds\n\nallocated pursuant to the provisions of subsection B of this section\n\nas necessary, and the State Board of Education is authorized to\n\npromulgate rules as necessary to establish priorities in funding for\n\nstudents in this subsection.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"13a0161a3910b4631418cb21adc11f858b031dc8166abdc35ae35aff744e3a72","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-13-114.2","next":"us-ok/okla.-stat.-tit.-70-70-13-114.4"},"notice":"GroundRules: Original legal text.
