Stat. tit. 70, § 70-13-124","heading":"General administration, supervision and monitoring of","body":"programs and activities receiving federal and state funds -\n\nContinuation of certain existing services - Coordination of\n\nfinancial resources - Restricted use of monies.\n\nA. The State Department of Education is hereby designated as\n\nthe lead agency for general administration, supervision and\n\nmonitoring of programs and activities receiving federal funds under\n\nPart C of the Individuals with Disabilities Education Act (IDEA) and\n\nstate funds appropriated for early intervention services. To ensure\n\ncompliance with Part C of the Individuals with Disabilities\n\nEducation Act (IDEA) and its implementing regulations, the State\n\nDepartment of Education is authorized to monitor and enforce any\n\nobligations imposed on agencies participating under Part C of the\n\nIDEA.\n\nB. In accordance with Part C of the Individuals with\n\nDisabilities Education Act (IDEA), the State Department of Education\n\nshall administer the Interagency Coordinating Council for Early\n\nChildhood Intervention which shall advise and assist the lead agency\n\nin fulfillment of its responsibilities.\n\nC. The State Department of Education, the State Department of\n\nHealth, the Department of Human Services, the Department of Mental\n\nHealth and Substance Abuse Services and other publicly funded\n\nservices shall continue to provide all services within their\n\nrespective statutory and constitutional responsibilities to the\n\neligible population except as otherwise provided in Section 13-101\n\nof this title. State and local interagency agreements will\n\ndelineate responsibility for local and regional procedural\n\nsafeguards, provision of service and related issues. Funds provided\n\nfor implementation of the Oklahoma Early Intervention Act, Sections\n\n13-121 through 13-129 of this title, shall not be used to satisfy a\n\nfinancial commitment for services which would have been paid for or\n\nprovided by another public or private source, but shall be utilized\n\nsolely for the enactment of Part C of the Individuals with\n\nDisabilities Education Act (IDEA) and the Oklahoma Early\n\nIntervention Act. Such funds may be used whenever considered\n\nnecessary to prevent delay in the receipt of appropriate early\n\nintervention services by the infant or toddler or family in a timely\n\nfashion. Funds provided for implementation of the Oklahoma Early\n\nIntervention Act may be used to pay the provider of services pending\n\nreimbursement from the agency which has the ultimate responsibility.\n\nD. Pursuant to the requirements of Part C of the Individuals\n\nwith Disabilities Education Act (IDEA), all financial resources from\n\nfederal, state, local and private sources shall be coordinated to\n\nfund early intervention services. In order to determine the most\n\neffective utilization and achieve coordination, a joint funding plan\n\nshall be submitted to the Governor, the Speaker of the House of\n\nRepresentatives, and the Senate President Pro Tempore by the State\n\nDepartment of Education, the State Department of Health, the\n\nDepartment of Human Services and the Department of Mental Health and\n\nSubstance Abuse Services on or before October 1. The individual\n\ncomponents of such plan as they relate to individual agencies shall\n\nbe incorporated annually into each affected agency's budget request\n\nin accordance with the provisions of Section 34.36 of Title 62 of\n\nthe Oklahoma Statutes. Such plan shall include, but not be limited\n\nto:\n\n1. Utilization of State Aid funds appropriated to the State\n\nBoard of Education for the purpose of providing early intervention\n\nservices or provided pursuant to the State Aid Formula for special\n\neducation services and related services to children with\n\ndisabilities;\n\n2. Publicly funded personnel and programs in the State\n\nDepartment of Education, the State Department of Health, the\n\nDepartment of Human Services and the Department of Mental Health and\nding early intervention\n\nservices or provided pursuant to the State Aid Formula for special\n\neducation services and related services to children with\n\ndisabilities;\n\n2. Publicly funded personnel and programs in the State\n\nDepartment of Education, the State Department of Health, the\n\nDepartment of Human Services and the Department of Mental Health and\n\nSubstance Abuse Services who are currently serving the eligible\n\npopulation;\n\n3. Feasibility of utilization of federal Title V funds;\n\n4. Utilization of new state funds as may be appropriated by the\n\nLegislature for fiscal year 1990 for the purpose of early\n\nintervention, and of additional new funds needed to fully implement\n\nearly intervention services in accordance with the State of\n\nOklahoma's implementation of Part C of the Individuals with\n\nDisabilities Education Act (IDEA);\n\n5. Amendments to expansion of the Medicaid State Plan to\n\ninclude early intervention services for eligible children utilizing\n\nstate funds designated for early intervention for the purpose of\n\nmatching federal funds;\n\n6. Feasibility of application for federal funds appropriated\n\npursuant to P.L. 89-313; and\n\n7. Utilization of funds received under Part C of the\n\nIndividuals with Disabilities Education Act (IDEA).\n\nE. The State Department of Education, the State Department of\n\nHealth, the Department of Human Services and the Department of\n\nMental Health and Substance Abuse Services shall be authorized to\n\ntransfer funds enumerated in subsection D of this section to the\n\nOklahoma Early Intervention Revolving Fund created in Section 13-\n\n124.1 of this title to the extent that transfers of such funds are\n\nauthorized by and directed to the fund by the joint funding plan of\n\nthe Oklahoma Early Intervention Act or by state or federal law.\n\nF. Monies appropriated to an affected agency and monies\n\nidentified in the joint funding plan for the purpose of providing\n\nearly intervention services shall be used by the agency exclusively\n\nfor the purpose of providing early intervention services.\n\nG. For purposes of implementing the provisions of the Oklahoma\n\nEarly Intervention Act, the board of education of any school\n\ndistrict in this state may execute an agreement with a city/county\n\nhealth department or county health department to share appropriate\n\nfacilities.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"86da3e7d1210662d6170fd40159e1becef186170f1a7901138921a513d3f125b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-13-123.1","next":"us-ok/okla.-stat.-tit.-70-70-13-124.1"},"notice":"GroundRules: Original legal text.
