The State Board of Career and Technology Education shall\n\nprescribe criteria and procedures for the establishment and\n\ngovernance of technology center school districts, as provided by\n\nSection 9B of Article X of the Oklahoma Constitution, and such\n\ndistricts so established shall be operated in accordance with rules\n\nof the State Board of Career and Technology Education, except as\n\notherwise provided in this title.\n\nB. A technology center school district shall be a body\n\ncorporate and shall possess the usual powers of a corporation for\n\npublic purposes. Its official name shall be designated by the State\n\nBoard of Career and Technology Education, in which name it may sue\n\nand be sued, and be capable of contracting and being contracted\n\nwith, and holding real and personal estate.\n\nC. The governing board of a technology center school district\n\nshall be a board of education consisting of not less than five (5)\n\nnor more than seven (7) members. Except as otherwise provided for\n\nin subsections D and E of this section, all members of the board of\n\neducation shall be elected in a manner prescribed by the State Board\n\nof Career and Technology Education. The State Board shall\n\npromulgate rules prescribing the manner in which the elections\n\nrequired by this subsection are held.\n\nD. In a technology center school district that serves seventy\n\nor more public school districts, the territory of the school\n\ndistrict shall be divided into district zones by the State Board of\n\nCareer and Technology Education. Between August 1 and December 31\n\nof the year following the submission by the United States Department\n\nof Commerce to the President of the United States of the official\n\nFederal Decennial Census, the Board shall reapportion the territory\n\nof the technology center school district into district zones. All\n\nboundaries of district zones shall follow clearly visible,\n\ndefinable, and observable physical boundaries which are based upon\n\ncriteria established and recognized by the Bureau of the Census of\n\nthe United States Department of Commerce for purposes of defining\n\ncensus blocks for its decennial census and shall follow, as much as\n\npossible, precinct boundaries. District zones shall be compact,\n\ncontiguous and shall be as equal in population as practical with not\n\nmore than a five-percent variance between the most populous and\n\nleast populous district zones. The board of education of a\n\ntechnology center school district shall consist of one member\n\nelected from each of the district zones of the school district\n\ncreated pursuant to this subsection. The electors of each district\n\nzone shall elect a person, who is a resident of the district zone,\n\nto represent the district zone on the school board. If during the\n\nterm of office to which a person was elected, that member ceases to\n\nbe a resident of the district zone for which the person was elected,\n\nthe office shall become vacant and the vacancy shall be filled as\n\nprovided in Section 13A-110 of Title 26 of the Oklahoma Statutes.\n\nThe State Board of Career and Technology Education shall promulgate\n\nrules prescribing the manner in which the elections required by this\n\nsubsection are held.\n\nE. In technology center school districts having a population of\n\nmore than two hundred twenty-five thousand (225,000) electors, the\n\nterritory of the district shall be divided into board zones by the\n\nState Board of Career and Technology Education. The board of\n\neducation of the technology center school district shall consist of\n\none member elected from each of the district zones. Beginning July\n\n1, 2024, the board of education shall have the option upon approval\n0) electors, the\n\nterritory of the district shall be divided into board zones by the\n\nState Board of Career and Technology Education. The board of\n\neducation of the technology center school district shall consist of\n\none member elected from each of the district zones. Beginning July\n\n1, 2024, the board of education shall have the option upon approval\n\nof a board resolution, of requiring that the electors of each\n\ndistrict zone shall elect a person who is a resident of the district\n\nzone to represent the district zone on the school board and to not\n\nelect all board members at large, or the community continues to vote\n\nfor the board members at large. If during the term of office to\n\nwhich a person was elected, that member ceases to be a resident of\n\nthe district zone for which the person was elected, the office shall\n\nbecome vacant, and the vacancy shall be filled as provided for in\n\nSection 13A-110 of Title 26 of the Oklahoma Statutes. The State\n\nBoard of Career and Technology Education shall promulgate rules\n\nprescribing the manner in which the elections required by this\n\nsubsection are held.\n\nF. The board of education of a technology center school\n\ndistrict shall have the same powers and duties that boards of\n\neducation of independent school districts have. It may require\n\nnonresident students to pay reasonable tuition fees, which may be\n\npaid for a student by the independent or elementary school district\n\nin which the student resides.\n\nG. An election to vote on the question of making a levy of not\n\nto exceed five (5) mills on the dollar valuation of the taxable\n\nproperty in a technology center school district under the provisions\n\nof subsection A of Section 9B of Article X of the Oklahoma\n\nConstitution, shall be called by the board of education and\n\nconducted by the county election board of such district in the same\n\nmanner that elections for emergency levies in school districts under\n\nthe provisions of subsection (d) of Section 9 of Article X of the\n\nOklahoma Constitution, are called and conducted. When such levy is\n\napproved by a majority of the electors of the technology center\n\nschool district voting on the question at such election, the levy\n\nshall be made each fiscal year thereafter until repealed by a\n\nmajority of the electors of the district voting on the question at\n\nan election called for such purpose. An election to vote on the\n\nquestion of making a local incentive levy of not to exceed five (5)\n\nmills on the dollar valuation of the taxable property in a\n\ntechnology center school district under the provisions of subsection\n\nB of Section 9B of Article X of the Oklahoma Constitution, may be\n\ncalled by the board of education; and elections on a levy for a\n\nbuilding fund for an area school district under the provisions of\n\nSection 10 of Article X of the Oklahoma Constitution, shall be\n\ncalled by the board of education of such district and conducted by\n\nthe county election board in the same manner that elections for\n\nsimilar levies are called and conducted in independent school\n\ndistricts.\n\nH. Annual estimates of needs of technology center school\n\ndistricts shall be made and approved in the same manner that those\n\nof independent school districts are made and approved. Provided,\n\nthat the State Board of Career and Technology Education shall\n\nprescribe a list of appropriation accounts by which the funds of\n\ntechnology center school districts shall be budgeted, accounted for\n\nand expended. Any such estimate of needs may include an estimate of\n\nfederal funds as probable income from sources other than ad valorem\n\ntax of the district and other than any excise or other tax assessed\n\nby legislative enactment and distributed in lieu of ad valorem\n\ntaxes. If a technology center school district lies in more than one\n\ncounty, the district’s estimate of needs shall be filed with and\nexpended. Any such estimate of needs may include an estimate of\n\nfederal funds as probable income from sources other than ad valorem\n\ntax of the district and other than any excise or other tax assessed\n\nby legislative enactment and distributed in lieu of ad valorem\n\ntaxes. If a technology center school district lies in more than one\n\ncounty, the district’s estimate of needs shall be filed with and\n\napproved by the county excise board of the county designated by the\n\nschool district board of education.\n\nI. Territory may be annexed to or detached from a technology\n\ncenter school district, in accordance with rules prescribed by the\n\nState Board of Career and Technology Education. If the State Board\n\nof Career and Technology Education requires the submission of a\n\npetition in order for an election to be called for the purpose of\n\nannexation or deannexation of territory to a technology center\n\nschool district, such petition shall not be required to bear a\n\nnumber of technology center school district electors’ signatures\n\nwhich exceed fifty percent (50%) of the number of technology center\n\nschool district electors who voted in the last school board election\n\nin the territory proposed to be annexed or deannexed. Provided, the\n\nperiod of time from which the petition is initiated to its time of\n\nfiling with the State Board shall not exceed ninety (90) days.\n\nJ. Schools of technology center school districts shall be\n\nsubject to classification, inspection, and accreditation by the\n\nState Board of Education.\n\nK. The technology center school board of education may\n\ndesignate a county treasurer to serve as treasurer of the school\n\ndistrict or may appoint an independent treasurer.\n\nL. Within four (4) years after the creation of a technology\n\ncenter school district, such school district may, at its discretion,\n\npermit a teacher to transfer any or all accrued benefits upon\n\nemployment including credit for years of service in the previous\n\nschool district by the technology center school district, if the\n\nteacher at the time of hiring is employed as a teacher by an\n\nindependent or elementary school district which is all or partly\n\nwithin the boundaries of the technology center school district or is\n\nemployed as a teacher in a skills center within the boundaries of\n\nthe school district.\n\nM. The board of education of a technology center school\n\ndistrict may convey surplus personal property without consideration\n\nto:\n\n1. A school district that is within the boundary of the\n\ntechnology center school district;\n\n2. A public school offering secondary level education which was\n\ncreated and is operated by this state and that is within the\n\nboundary of the technology center school district;\n\n3. A technology center school district; or\n\n4. The Oklahoma Department of Career and Technology Education\n\nfor the support or delivery of department initiatives.\n\nN. The board of education of a technology center school\n\ndistrict may, without prior approval of the State Board of Career\n\nand Technology Education, approve all plans and specifications for\n\ntechnology center school buildings, additions, and major\n\nmodifications to school buildings that are designed to provide for\n\nthe offering of vocational-technical education programs and services\n\nwhen the cost of the building project is to be paid with local\n\nlevies or state bond monies or both local levies and state bond\n\nmonies.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cd59bb7a411063d1bdde755b6431815f2ea90f490661df5eff0f816452f68c2d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-14-106","next":"us-ok/okla.-stat.-tit.-70-70-14-108.1"},"notice":"GroundRules: Original legal text.
