The board of education of each technology center school\n\ndistrict in this state shall provide a health insurance plan for the\n\nemployees of the technology center school district. Technology\n\ncenter school districts may obtain health and dental insurance\n\ncoverage as provided for in the Oklahoma Employees Insurance and\n\nBenefits Act or may obtain other health insurance coverage. Any\n\ntechnology center district that does not participate in the health\n\nand dental insurance plans offered through the Oklahoma Employees\n\nInsurance and Benefits Act shall obtain health insurance coverage\n\nfor the employees which provides open enrollment, and provide for\n\nthe continuation of health insurance coverage, including\n\nsupplemental Medicare insurance coverage, for those district\n\nemployees who retire from said district after September 30, 1991,\n\nwith a vested benefit in the Teachers' Retirement System of\n\nOklahoma. A retired person who begins receiving benefits from the\n\nTeachers' Retirement System of Oklahoma after September 30, 1991,\n\nwho retires from a technology center school district that provides\n\nother health insurance coverage, and who elects to continue said\n\nhealth insurance coverage shall pay to the technology center school\n\ndistrict the premium rate for the health insurance minus an amount\n\nequal to the premium rate of the Medicare supplement or the amount\n\ndetermined pursuant to subsection (4) of Section 1316.3 of Title 74\n\nof the Oklahoma Statutes, whichever is less, which shall be paid by\n\nthe Teachers' Retirement System of Oklahoma to the technology center\n\nschool district. The technology center school district shall remit\n\nto the health insurance coverage provider the total premium due less\n\nany uncollected amounts payable from retired technology center\n\nschool district employees or their qualified survivors.\n\nB. A technology center school district that participates in\n\nhealth insurance coverage other than the health insurance plan\n\noffered by the Oklahoma Employees Insurance and Benefits Act shall\n\nnot be required to pay any portion of the premium for the employees\n\nor the dependents of the employees of said school district. Unless\n\na school district negotiates an agreement with its employees\n\nregarding health insurance pursuant to Sections 509.1 through 509.9\n\nof this title, and to the extent that the agreement provides for the\n\nmembers of the recognized bargaining unit, a technology center\n\nschool district that participates in health insurance coverage other\n\nthan the health insurance plan offered by the Oklahoma Employees\n\nInsurance and Benefits Act is prohibited from acquiring additional\n\nor supplemental health or dental insurance for any board member,\n\nsuperintendent or any other employee which is not available to all\n\nemployees of said district, and said technology center school\n\ndistrict shall not pay a greater portion of the employee or\n\ndependent premium for any health or dental insurance plan or plans\n\nprovided by said technology center school district on behalf of any\n\nboard member, superintendent or employee than that portion paid on\n\nbehalf of all participating employees of said district.\n\nC. If a technology center school district obtains health\n\ninsurance coverage from a source other than through the Oklahoma\n\nEmployees Insurance and Benefits Act, the employees of the\n\ntechnology center school district who would be eligible to\n\nparticipate in the health and dental plans may require the board of\n\neducation of the technology center school district to call an\n\nelection to allow said employees to vote as to whether the\n\ntechnology center school district shall participate in the health\n\nand dental insurance plans offered through the Oklahoma Employees\n\nInsurance and Benefits Act. Upon the filing with the board of\n\neducation of a petition calling for such an election which is signed\nchool district to call an\n\nelection to allow said employees to vote as to whether the\n\ntechnology center school district shall participate in the health\n\nand dental insurance plans offered through the Oklahoma Employees\n\nInsurance and Benefits Act. Upon the filing with the board of\n\neducation of a petition calling for such an election which is signed\n\nby no less than thirty percent (30%) of the eligible employees of\n\nthe technology center school district, the board of education shall\n\ncall an election for the purpose of determining whether the\n\ntechnology center school district shall participate in the health\n\nand dental insurance plans offered through the Oklahoma Employees\n\nInsurance and Benefits Act. The election shall be held within\n\nthirty (30) days of the filing of the petition. If a majority of\n\nthose eligible employees voting at the election vote to participate\n\nin the health and dental insurance plans offered through the\n\nOklahoma Employees Insurance and Benefits Act, the board of\n\neducation of the technology center school district shall apply for\n\nsuch participation within thirty (30) days of the election.\n\nD. If a technology center school district does not have any\n\nhealth insurance coverage of the type required by this section, that\n\ntechnology center school district shall immediately be enrolled in\n\nthe health and dental insurance plans offered through the Oklahoma\n\nEmployees Insurance and Benefits Act.\n\nE. A carrier providing health insurance coverage for employees\n\nof a technology center school district health insurance group which\n\nreplaces a previous carrier for such technology center school\n\ndistrict employees shall provide coverage for each retired employee\n\nwho is receiving a benefit or terminates employment with a vested\n\nbenefit from the Teachers' Retirement System of Oklahoma and who is\n\nenrolled in the health insurance group by the previous carrier at\n\nthe time the previous carrier providing health insurance coverage is\n\nreplaced. Notwithstanding any provision in this section to the\n\ncontrary, any person who retires pursuant to the provisions of the\n\nTeachers' Retirement System of Oklahoma prior to May 1, 1993, or\n\nterminates service with a vested benefit, pursuant to the provisions\n\nof the Teachers' Retirement System of Oklahoma prior to May 1, 1993,\n\nmay continue to participate in the health and dental plans\n\nauthorized by the provisions of the Oklahoma Employees Insurance and\n\nBenefits Act.\n\nF. In the event a technology center school district ceases to\n\nexist, the assets and duties of said technology center school\n\ndistrict are transferred to one or more other technology center\n\nschool districts, said other technology center school district or\n\ndistricts do not agree to employ all of the former employees of the\n\ntechnology center school district that is ceasing to exist, and said\n\nformer employees who are not being reemployed have rights under\n\nfederal or state law to continue group insurance coverage, the\n\nannexing technology center school district having the largest\n\ngeneral fund revenue for the most recent preceding fiscal year for\n\nwhich data is available shall provide group insurance coverage to\n\nsaid former employees not being retained during the period as\n\nrequired by law.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e2cdb933d857568600679ccb4381c7556ea461a10c49b77e5a102287ef5d13fb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-14-108","next":"us-ok/okla.-stat.-tit.-70-70-14-108.2"},"notice":"GroundRules: Original legal text.
