Sections 20 through 22 of this act shall be known and may be\n\ncited as the \"Oklahoma National Guard CareerTech Assistance Act\".\n\nB. As used in this act:\n\n1. \"Technology center school\" means a technology center school\n\nunder the governance of the State Board of Career and Technology\n\nEducation;\n\n2. \"Eligible Guard member\" means a current member of the\n\nOklahoma National Guard in good standing who has a high school\n\ndiploma or who has completed General Educational Development (GED)\n\nrequirements and who has enrolled in a technology center school; and\n\n3. \"Program\" means the Oklahoma National Guard CareerTech\n\nAssistance Program established pursuant to the provisions of this\n\nsection.\n\nC. 1. There is hereby created the Oklahoma National Guard\n\nCareerTech Assistance Program to provide assistance to eligible\n\nGuard members who enroll in a technology center school. Subject to\n\nthe availability of funds, the amount of assistance shall be\n\nequivalent to the amount of tuition for a career and technology\n\nprogram in which the eligible Guard member is enrolled leading to\n\ncertification or licensure, not to exceed a maximum of three (3)\n\nyears.\n\n2. Assistance provided pursuant to this section shall be\n\ngranted without any limitation other than the amount of funds\n\navailable for the program and the number of eligible Guard members\n\nwho apply, subject to any cap established by the Military Department\n\nof the State of Oklahoma.\n\n3. Assistance allowed by this section shall not be allowed for\n\ncourses taken in excess of the requirements for completion of a\n\ntechnology center school program leading to certification or\n\nlicensure.\n\nD. Assistance provided pursuant to this section shall be\n\nallocated to the technology center school from the Oklahoma National\n\nGuard CareerTech Assistance Revolving Fund created pursuant to this\n\nsection.\n\nE. To be eligible to apply for the program, a Guard member\n\nshall:\n\n1. Have at least one (1) year remaining on his or her\n\nenlistment contract at the beginning of any semester for which the\n\nmember applies for assistance pursuant to this section;\n\n2. Agree in writing to complete his or her current service\n\nobligation in the Oklahoma National Guard; and\n\n3. Agree in writing to serve actively in good standing with the\n\nOklahoma National Guard for not less than twenty-four (24) months\n\nafter completion of the last semester for which the member receives\n\nassistance pursuant to this section.\n\nF. To retain eligibility for the program, an eligible Guard\n\nmember shall:\n\n1. Maintain good academic standing and satisfactory progress\n\naccording to standards of the technology center school in which the\n\nmember is enrolled;\n\n2. Maintain the requirements for retention and completion as\n\nestablished by the technology center school in which the member is\n\nenrolled;\n\n3. Maintain a minimum grade point average of 2.0 on a 4.0\n\nscale;\n\n4. Maintain satisfactory participation in the Oklahoma National\n\nGuard; and\n\n5. Possess a Military Occupational Specialty (MOS) or Air Force\n\nSpecialty Code (AFSC) after his or her first semester.\n\nG. An eligible Guard member seeking assistance pursuant to the\n\nprovisions of this section shall submit an application on a form\n\nprescribed by the Military Department of the State of Oklahoma to\n\nthe Educational Service Office of the Military Department prior to\n\nthe semester for which assistance is sought. The eligible Guard\n\nmember's Commander or his or her designee shall confirm a member's\n\nstanding and eligibility to the technology center school in which\n\nthe student is enrolled. The Military Department may establish a\n\ncap on the number of eligible Guard members allowed to participate\n\nper semester per technology center school program.\n\nH. The eligible Guard member's Commander may deny an\nitle 70. Schools Page 668\n\nmember's Commander or his or her designee shall confirm a member's\n\nstanding and eligibility to the technology center school in which\n\nthe student is enrolled. The Military Department may establish a\n\ncap on the number of eligible Guard members allowed to participate\n\nper semester per technology center school program.\n\nH. The eligible Guard member's Commander may deny an\n\napplication submitted by an eligible Guard member for continued\n\nprogram assistance if he or she fails to comply with the provisions\n\nof paragraph 1, 2, 3, 4, or 5 of subsection F of this section.\n\nI. An eligible Guard member who has received program assistance\n\npursuant to the provisions of this section and who fails to comply\n\nwith the provisions of paragraph 4 of subsection F of this section\n\nshall be required to repay an amount to be calculated as follows:\n\n1. Determine the total amount of assistance provided pursuant\n\nto the provisions of this section;\n\n2. Divide the amount determined in paragraph 1 of this\n\nsubsection by twenty-four (24); and\n\n3. Multiply the amount determined in paragraph 2 of this\n\nsubsection by the number of months the member did not fulfill the\n\nrequirements of paragraph 4 of subsection F of this section.\n\nRepayments shall be deposited into the Oklahoma National Guard\n\nCareerTech Assistance Revolving Fund created pursuant to Section 22\n\nof this act.\n\nJ. An eligible Guard member who has received program assistance\n\npursuant to the provisions of this section and who fails to comply\n\nwith the provisions of paragraph 4 of subsection F of this section\n\ndue to hardship circumstances may request a waiver from repayment.\n\nA waiver request shall be submitted in writing to the Adjutant\n\nGeneral.\n\nK. By July 1 annually, the State Board of Career and Technology\n\nEducation shall notify the Adjutant General of the amount of funding\n\navailable in the Oklahoma National Guard CareerTech Assistance\n\nRevolving Fund created pursuant to Section 22 of this act.\n\nL. The State Board of Career and Technology Education shall\n\npromulgate rules to implement the provisions of this act, including\n\ndeadlines for submission of applications required by subsection G of\n\nthis section. The Military Department of the State of Oklahoma\n\nshall promulgate rules and regulations pertaining to the application\n\nprocess and the determination of eligibility for the program. The\n\nBoard and the Department shall coordinate the promulgation of rules\n\nand regulations, respectively.
