All contracts with publishers shall be signed by the\n\nchairperson and secretary of the State Textbook Committee on behalf\n\nof the state. Each contract shall stipulate the price at which each\n\ntextbook will be sold to the State of Oklahoma, and that all copies\n\nsupplied to the State of Oklahoma will be equal to or better than\n\nthe official copy filed with the secretary of the Committee. The\n\nState Textbook Committee may approve the substitution of a later\n\nedition in lieu of the textbook originally selected. The publisher\n\nshall stipulate in the contract that:\n\n1. The price for which the textbook is to be furnished will be\n\nthe lowest at which the same textbook will be sold or offered for\n\nsale for the purpose of securing a state or local selection or\n\nadoption elsewhere in the United States during the six (6) months\n\nprior to the date of the execution of the contract;\n\n2. It will reduce the contract price of the textbook, if the\n\nprice of the same textbook is reduced below such contract price\n\nelsewhere in the United States, and that it will file with the\n\nsecretary of the Committee a sworn statement of such reduction made\n\nelsewhere;\n\n3. If it prepares any supplementary or abridged or special\n\neditions of any of the textbooks, and shall sell such editions\n\nelsewhere at a lower price than that stipulated in the contract, it\n\nwill file copies of any and all such editions, together with the\n\nprices thereof, with the secretary of the Committee;\n\n4. It has not entered into any understanding, agreement or\n\ncombination to control the prices or restrict competition in the\n\nsale of textbooks;\n\n5. It will furnish the textbooks to the State of Oklahoma\n\nduring the term of the contract in such amounts as may be required;\n\nand\n\n6. It will furnish for a like period in lieu of the\n\ncorresponding textbooks under contract any other books listed in any\n\nannual statement subsequently filed by it during the term of the\n\ncontract to any school district at the lowest new prices contained\n\nin such statement, and that it will maintain said prices uniformly\n\nthrough the state.\n\nB. Textbooks selected by the State Textbook Committee may be\n\npurchased by school districts at the prices for which contracts have\n\nbeen awarded, pending the effective dates of the contracts.\n\nC. The chairperson and secretary of the State Textbook\n\nCommittee, on the advice and consent of the attorney for the State\n\nDepartment of Education, may, with the consent of the holders of\n\nstate textbook contracts, change any contract to conform with the\n\nprovisions of Section 16-102 of this title.\n\nD. As requested by a school district or the Oklahoma School for\n\nthe Blind, all publishers who enter into contracts with the State\n\nTextbook Committee shall be required to furnish the Committee with\n\nelectronic files in a file format from which Braille and other\n\naccessible versions of the instructional materials can be produced.\n\nThe file format in which electronic instructional materials files\n\nare provided to the Committee shall be in a format prescribed by\n\nfederal law or regulations promulgated by the United States\n\nDepartment of Education which requires national standards for\n\nelectronic files to be used for production of accessible\n\ninstructional materials.
