Stat. tit. 70, § 70-16-111","heading":"Local textbook committee - Examination copies, teacher","body":"editions and software copies - Adoptions of textbooks - Textbook\n\norders.\n\nA. Except as otherwise provided for in subsection E of this\n\nsection, the superintendent of schools of each school district in\n\nthe state shall appoint a local textbook committee consisting of not\n\nfewer than three nor more than nine members. Each committee shall\n\nhave one lay member, with the remainder of the members being\n\nteachers employed in the public schools of the district, a majority\n\nof whom shall be classroom teachers. The superintendent of schools\n\nor a designee who shall be a principal or a curriculum specialist\n\nshall serve as chairperson of the local textbook committee.\n\nB. Upon the written request of any duly appointed local\n\ntextbook coordinator, the publisher of a textbook selected by the\n\nState Textbook Committee shall furnish at least one examination copy\n\nof the textbook and the teacher edition of the textbook, if one is\n\npublished, and a copy of software for purposes of complete\n\ndemonstration and review, if available, to the school district so\n\nthat the local textbook committee may examine any or all new\n\nadoptions in the subjects taught or to be taught in schools in the\n\ndistrict.\n\nC. Except as otherwise provided for in subsection E of this\n\nsection, on or before a date to be fixed by the State Board of\n\nEducation, each local textbook committee shall adopt textbooks only\n\nfrom the list of textbooks selected by the State Textbook Committee\n\nin a manner as shall be prescribed by the State Board of Education.\n\nIn order for the local textbook committee to adopt a textbook that\n\nwas not reviewed by the State Textbook Committee, the local textbook\n\ncommittee shall conduct a review process in a manner prescribed by\n\nthe State Board of Education. Each local textbook committee shall\n\nserve without compensation and shall cease to exist when local\n\nadoptions have been completed and shall be replaced by another local\n\ntextbook committee appointed in the same manner as provided for in\n\nthis section.\n\nD. Except as otherwise provided for in subsection E of this\n\nsection, on or before a date to be fixed by the State Board of\n\nEducation, the superintendent of each school district shall submit\n\nto the State Board of Education a textbook plan outlining the\n\nestimated number of textbooks needed by the school district and the\n\ntotal amount of money to be expended by the district for textbooks\n\nincluding the allocated funds and any additional supplemental funds\n\nto be expended. The superintendent or textbook coordinator\n\nappointed by the superintendent shall place orders from the proper\n\ndepository or depositories for all of the textbooks needed as\n\noutlined in the textbook plan by the district for the ensuing year.\n\nThe superintendent of a school district or textbook coordinator may\n\norder any textbooks placed on the official list of textbooks. If\n\nthe order exceeds the allocation for each school district as\n\nprovided in Section 16-114a of this title any additional funds\n\nexpended shall be reported on the statement of expenditures for the\n\ndistrict.\n\nE. 1. If a school district makes the election as provided for\n\nin subsection B of Section 16-114a of this title, the district shall\n\nnot be required to appoint a local textbook committee, adopt\n\ntextbooks, submit a textbook plan, or expend money on the purchase\n\nof textbooks during any fiscal year as provided for in this\n\nsubsection.\n\n2. The provisions of paragraph 1 of this subsection shall cease\n\nto be effective during the fiscal year which begins on the July 1\n\nimmediately succeeding the legislative session during which the\n\nmeasure appropriating monies to the State Board of Education for the\n\nfinancial support of public schools is enacted as law and such\n\nappropriation amount is at least Fifty Million Dollars\n\n($50,000,000.00) greater than the amount of money appropriated to\n\nthe State Board of Education for the financial support of public\nn the July 1\n\nimmediately succeeding the legislative session during which the\n\nmeasure appropriating monies to the State Board of Education for the\n\nfinancial support of public schools is enacted as law and such\n\nappropriation amount is at least Fifty Million Dollars\n\n($50,000,000.00) greater than the amount of money appropriated to\n\nthe State Board of Education for the financial support of public\n\nschools for the fiscal year ending June 30, 2019.
