Based upon legislative appropriations, the State Board of\n\nEducation shall determine the textbook allocation to be distributed\n\nto each school district in the state. Each year the textbook\n\nallocation for each school district shall be calculated and\n\ndistributed in July and adjusted in December. The initial\n\nallocation shall be calculated based on the audited end-of-year\n\naverage daily attendance of the preceding school year multiplied by\n\nFifty-five Dollars ($55.00). The initial allocation shall be\n\ncalculated and distributed to each school district in July. The\n\nDecember adjustment shall be calculated by multiplying the audited\n\nfirst nine (9) weeks' average daily attendance for that current\n\nschool year by Fifty-five Dollars ($55.00) and subtracting from that\n\namount the amount of the initial allocation. The adjustment shall\n\nbe calculated in December and distributed to each eligible school\n\ndistrict no later than January 15. A school district shall receive\n\nan adjustment only if the adjustment figure as calculated in this\n\nsection is greater than zero. The State Department of Education\n\nshall retain from the total amount appropriated for textbooks not\n\nless than one percent (1%) of the total amount to be used for the\n\npurpose of making the adjustments. If the amount appropriated,\n\nincluding the retained amount, is not sufficient to fully fund the\n\nadjusted allocation, each school district eligible for an adjustment\n\nshall receive a proportionate reduction in funding. Any unused\n\nportion of the value of textbooks allowed to a school district shall\n\nbe cumulative and may be carried over by the school district to\n\nsubsequent fiscal years, in addition to the allocation it is\n\nentitled to receive during that fiscal year.\n\nB. A school district seeking flexibility in the use of state-\n\nappropriated funding allocated pursuant to this section for\n\ntextbooks shall be required to demonstrate to the State Board of\n\nEducation that the textbooks and instructional materials used by the\n\ndistrict for the subject areas being considered in the current\n\ntextbook adoption cycle are current and appropriate for student\n\nlearning. Subject to the provisions of subsection E of Section 16-\n\n111 of this title, a school district that has received textbook\n\nfunding flexibility approval from the Board may elect to expend any\n\nmonies allocated pursuant to this section for textbooks, including\n\nany monies carried over as authorized pursuant to subsection A of\n\nthis section, for any purpose related to the support and maintenance\n\nof the school district as determined by the board of education of\n\nthe school district.\n\nC. All textbooks distributed to a school district that have\n\nbeen destroyed by fire or other hazard shall be replaced by the\n\nState Board of Education. The total cost of all additional\n\ntextbooks delivered to school districts to replace those destroyed\n\nby fire or other hazard shall not exceed, for the entire state in\n\nany fiscal year, the aggregate sum of One Hundred Thousand Dollars\n\n($100,000.00), which sum shall be reserved for that purpose from any\n\nappropriation made to carry out the provision of this section for\n\nany fiscal year.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6e7bf4016aad549407a27f1405fea1ee6ec707a17f9c6bc8b10f8bdd2a2e923f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-16-114.1","next":"us-ok/okla.-stat.-tit.-70-70-16-115"},"notice":"GroundRules: Original legal text.
