Stat. tit. 70, § 70-17-202","heading":"Definitions","body":"The following words and phrases as used in this act shall have\n\nthe following meanings unless a different meaning is clearly\n\nrequired by the context:\n\n1. \"Participating institution\" means only the entities that\n\ncomprise a comprehensive university pursuant to Section 17-101 of\n\nthis title and which:\n\na. maintain an alternate retirement plan pursuant to the\n\nprovisions of this act, and\n\nb. employ eligible employees;\n\n2. \"Alternate retirement plan\" means any employee retirement\n\nplan that is created solely to provide benefits for eligible\n\nemployees, as defined in this section, for periods of service on or\n\nafter July 1, 2004. Such retirement plan shall be a plan meeting\n\nthe requirements of Section 401(a) of the Internal Revenue Code of\n\n1986, as amended, operated pursuant to the provisions of this act;\n\n3. \"Board of regents\" means the board or body designated by the\n\nOklahoma Constitution or by this title as the board of regents or\n\ngoverning board of a comprehensive university that is a\n\nparticipating institution;\n\n4. \"Eligible employee\" means any employee of a participating\n\ninstitution who (a) was initially appointed or hired after June 30,\n\n2004, and (b) meets the eligibility requirements of the alternate\n\nretirement plan of the participating institution that employs the\n\neligible employee. However, the term \"eligible employee\" does not\n\ninclude a person whose employment is incidental to his or her\n\neducational program or whose employment is not continuous. Such\n\neligible employees shall be eligible to participate in the alternate\n\nretirement plan if they make a one-time irrevocable written election\n\npursuant to this act; and\n\n5. \"One-time irrevocable written election\" means a one-time\n\nelection made pursuant to this act by an eligible employee that\n\nshall be in writing and irrevocable and shall cover all future\n\nservice with a participating institution regardless of a break in\n\nservice.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0e74613e618971d95bd4a3940a3dfa2bbdcf3b685e948ae80d1875facce04eab","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-17-201","next":"us-ok/okla.-stat.-tit.-70-70-17-203"},"notice":"GroundRules: Original legal text.
