Stat. tit. 70, § 70-17-206","heading":"Election to participate in alternative retirement plan","body":"or Teachers Retirement Plan System of Oklahoma.\n\nA. An eligible employee shall have thirty (30) days from such\n\neligible employee's initial date of hire or the date the alternate\n\nretirement plan is adopted by the participating institution,\n\nwhichever is later, to make a one-time irrevocable written election\n\nto participate in the alternate retirement plan or the Teachers'\n\nRetirement System of Oklahoma. If an eligible employee fails to\n\nmake an election within the thirty-day period such eligible employee\n\nshall participate in the Teachers' Retirement System of Oklahoma.\n\nIf an eligible employee makes the election to participate in the\n\nalternate retirement plan such eligible employee shall not\n\nparticipate in the Teachers' Retirement System of Oklahoma nor make\n\nemployee contributions to the Teachers' Retirement System of\n\nOklahoma and the participating institution shall not make employer\n\ncontributions to the Teachers' Retirement System of Oklahoma except\n\nas otherwise required by Section 17-201 et seq. of this title. If\n\nan eligible employee elects to participate in the Teachers'\n\nRetirement System of Oklahoma, then the eligible employee shall make\n\nemployee contributions to the Teachers' Retirement System of\n\nOklahoma and the participating institution shall pay the employer\n\ncontributions of such eligible employee to the Teachers' Retirement\n\nSystem of Oklahoma for the month that the eligible employee was\n\nhired through the month that the election is made and as long as the\n\neligible employee participates in the Teachers' Retirement System of\n\nOklahoma.\n\nB. An eligible employee who elects to participate in the\n\nalternate retirement plan shall be ineligible for participation in\n\nthe Teachers' Retirement System of Oklahoma. Ineligibility to\n\nparticipate in the Teachers' Retirement System of Oklahoma shall\n\ncontinue so long as such eligible employee remains employed by a\n\nparticipating institution. If such eligible employee assumes a\n\ndifferent position, which is governed by a state retirement system\n\nother than the alternate retirement plan authorized in Section 17-\n\n201 et seq. of this title, the eligible employee shall be subject to\n\nthe retirement system rules applicable to that new position.\n\nHowever, such eligible employee shall not be eligible for service\n\ncredit in the Teachers' Retirement System of Oklahoma for service\n\nperformed while participating in an alternate retirement plan.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a59651e3920ee8428d2377780954178d0188d384f39f0159d33eba9f39e8fcd2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-17-205","next":"us-ok/okla.-stat.-tit.-70-70-17-207"},"notice":"GroundRules: Original legal text.
