It is the intent of the Legislature to provide a free public\n\nkindergarten for every five-year-old child in this state.\n\nB. Each day during which a child attends a kindergarten for two\n\nand one-half (2 1/2) hours or more shall be counted as one hundred\n\npercent (100%) of one (1) day of average daily attendance. Each day\n\na kindergarten student is on the membership roll in a school\n\ndistrict shall be counted as one hundred percent (100%) of one (1)\n\nday of average daily membership.\n\nC. It shall be the duty of every school district in this state\n\nto provide and offer kindergarten free of tuition for every child\n\nresiding in the district who attains the age of five (5) years on or\n\nbefore the first day of September during the school year such\n\nkindergarten is offered. The duty to provide and offer kindergarten\n\nmay be satisfied by transferring kindergarten children to other\n\nschool districts which accept them and provide kindergarten for such\n\nchildren, or by contracting for classroom space with a licensed\n\npublic or licensed private child care provider based upon selection\n\ncriteria established by the district.\n\nD. A kindergarten program may be offered jointly by school\n\ndistricts that have formed interlocal cooperative agreements\n\npursuant to Section 5-117b of this title.\n\nE. Beginning with the 2013-2014 school year, it shall be the\n\nduty of every school district in this state to provide and offer a\n\nfull six-hour day of kindergarten free of tuition for every child\n\nresiding in the district who attains the age of five (5) years on or\n\nbefore the first day of September during the school year\n\nkindergarten is offered. The duty to provide and offer kindergarten\n\nmay be satisfied by intra-district transfer to a school offering\n\nfull-day kindergarten, by transferring kindergarten children to\n\nother school districts which will accept them and can provide\n\nkindergarten for such children, or by contracting for classroom\n\nspace with a licensed public or licensed private child care provider\n\nbased upon selection criteria established by the district. A school\n\ndistrict shall be exempt from the provisions of this subsection if\n\nthe school district has voted indebtedness through the issuance of\n\nbonds or approval by voters of issuance of new bonds for more than\n\neighty-five percent (85%) of the maximum allowable, pursuant to the\n\nprovisions of Section 26 of Article X of the Oklahoma Constitution,\n\nat any time within the previous five (5) years.\n\nF. The requirement to attend kindergarten provided in Section\n\n10-105 of this title may be satisfied by attendance in either a\n\nhalf-day or full-day program. Membership in a kindergarten for\n\neither two and one-half (2 1/2) hours or six (6) hours per school\n\nday shall be counted as one (1) day for average daily membership\n\npurposes. For purposes of State Aid, the pupil grade level weight\n\nfor a two-and-one-half-hour day of kindergarten shall be 1.3, and\n\nfor a six-hour full day of kindergarten shall be 1.5.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3fd14d705d7f10943452a3b7e5166a19228fe9386302985a8561cad8c163367c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-18-107.1","next":"us-ok/okla.-stat.-tit.-70-70-18-109.1"},"notice":"GroundRules: Original legal text.
