Stat. tit. 70, § 70-18-109.1","heading":"State Aid Formula - Procedure","body":"The Legislature hereby declares, for the purpose of financial\n\nsupport to school districts through the State Aid Formula, that\n\ngreater equalization of State Aid to school districts will be\n\nattained by the following procedure:\n\n1. For the 1989-90 school year, the real property portion of\n\nthe valuations for those school districts in counties having an\n\nassessment ratio in excess of twelve percent (12%) shall be computed\n\nat a twelve percent (12%) assessment ratio to determine chargeable\n\nvaluations. Beginning with the 1990-91 school year, the real\n\nproperty portion of the valuations for those school districts in\n\ncounties having an assessment ratio in excess of eleven percent\n\n(11%) shall be computed at an eleven percent (11%) assessment ratio\n\nto determine chargeable valuations. Beginning with the 1991-92\n\nschool year, the commercial personal and agricultural personal\n\nproperty portion of the valuations for those school districts in\n\ncounties having an assessment ratio in excess of eleven percent\n\n(11%) shall be computed at an eleven percent (11%) assessment ratio\n\nto determine chargeable valuations. The Oklahoma Tax Commission\n\nshall supply to the State Department of Education the information\n\nnecessary to carry out the provisions of this paragraph.\n\n2. The real property portions of the valuations for those\n\nschool districts in counties having an actual assessment ratio of\n\nless than twelve percent (12%) shall be computed at the actual\n\nassessment ratio in effect for the county as determined by the\n\nOklahoma Tax Commission in order to determine chargeable valuations\n\nfor calculating State Aid to such district if such ratio is at least\n\nnine percent (9%) and the county is certified by the Oklahoma Tax\n\nCommission to have a verifiable revaluation program using property\n\nidentification cards for the applicable assessment year.\n\n3. The real property portion of the valuations for those school\n\ndistricts in counties which have an actual assessment ratio of less\n\nthan twelve percent (12%) and which are not certified by the\n\nOklahoma Tax Commission to have a verifiable revaluation program\n\nusing property identification cards shall be computed at a twelve\n\npercent (12%) assessment ratio to determine chargeable valuations.\n\nFor each school year, the actual assessment ratio shall be the\n\nassessment ratio recommended by the Oklahoma Tax Commission and\n\ncertified by the State Board of Equalization for the applicable\n\nassessment year.\n\n4. The Oklahoma Tax Commission shall certify by October 1, for\n\neach applicable assessment year, to the State Superintendent of\n\nPublic Instruction those counties which have revaluation programs\n\nusing property identification cards. The Oklahoma Tax Commission\n\nshall, as soon as practicable, certify to the State Superintendent\n\nof Public Instruction and the district attorney for the applicable\n\ncounty the date as of which a county implements a verifiable\n\nrevaluation program using property identification cards after\n\nOctober 1 of any year.\n\n5. Any county assessor who fails to have an approved\n\nrevaluation program using property identification cards shall pay a\n\npenalty in the amount of One Hundred Dollars ($100.00) for each\n\ncalendar day beyond October 1 of any year that the county does not\n\nhave a verifiable revaluation program using property identification\n\ncards. The penalty shall be imposed for each calendar day on and\n\nafter October 2 of each year until the county implements a\n\nverifiable revaluation program using property identification cards;\n\nprovided, that such penalty shall be collected from any county\n\nassessor of a county which did not have a verifiable revaluation\n\nprogram using property identification cards as of October 1, 1985,\n\nfor each day from and after July 1, 1986, that the applicable county\n\ndoes not have a verifiable revaluation program using property\n\nidentification cards.\nn program using property identification cards;\n\nprovided, that such penalty shall be collected from any county\n\nassessor of a county which did not have a verifiable revaluation\n\nprogram using property identification cards as of October 1, 1985,\n\nfor each day from and after July 1, 1986, that the applicable county\n\ndoes not have a verifiable revaluation program using property\n\nidentification cards.\n\n6. Upon receipt of certification by the Oklahoma Tax Commission\n\nof the counties having approved revaluation programs, the State\n\nSuperintendent of Public Instruction shall cause notice to be mailed\n\nby return receipt mail to the county assessor, the district\n\nattorney, the county treasurer and the superintendent of each school\n\ndistrict of any county not included in the certification.\n\n7. The district attorney, upon receipt of the notice provided\n\nfor in paragraph 6 of this section, shall immediately institute an\n\naction to collect the One Hundred Dollar ($100.00) penalty for each\n\nday that the county does not have a verifiable revaluation program\n\nusing property identification cards. The district attorney shall be\n\nauthorized to institute a single action in district court pursuant\n\nto which any amount of penalty may be collected for any day the\n\nassessor fails to implement the revaluation program using property\n\nidentification cards. Any amount of such fine collected shall be\n\ndeposited in a special account within the county general fund. Such\n\namounts shall be apportioned to the school districts of the county\n\non the basis of the preceding year's average daily attendance.\n\n8. The district attorney shall initiate action for removal of\n\nthe county assessor from office for malfeasance if the county\n\nassessor has not instituted a verifiable revaluation program using\n\nproperty identification cards within thirty (30) days after the\n\ndistrict attorney receives notice from the State Superintendent of\n\nPublic Instruction. Initiation of an action for the removal of the\n\ncounty assessor for malfeasance as required by this section is a\n\nmandatory duty of the office of the district attorney. If the\n\ndistrict attorney fails to initiate an action within forty (40) days\n\nafter receipt of the notice from the State Superintendent of Public\n\nInstruction, and the county assessor has not implemented a\n\nverifiable revaluation program using property identification cards,\n\nthe district attorney shall pay a penalty of One Hundred Dollars\n\n($100.00) for each day that an action could have been filed for the\n\nremoval of the county assessor and such action has not been filed or\n\nuntil the county assessor implements the revaluation program using\n\nproperty identification cards. The Attorney General shall initiate\n\nan action to collect the penalty from the district attorney pursuant\n\nto the authority of Section 18b of Title 74 of the Oklahoma\n\nStatutes. All penalties collected pursuant to the provisions of\n\nthis paragraph shall be deposited in the special account within the\n\ncounty general fund and apportioned to the school districts of the\n\ncounty on the basis of the preceding year's average daily\n\nattendance.\n\n9. The notice to the superintendents of the various school\n\ndistricts from the State Superintendent of Public Instruction shall\n\nstate that the State Aid formula funds computed for such districts\n\nbased upon the actual assessment ratio valuations in excess of the\n\namount computed upon twelve percent (12%) assessment ratio\n\nvaluations shall be withheld from distribution to the school\n\ndistrict until the office of the county assessor has complied with\n\nthe requirement of a verifiable revaluation program using property\n\nidentification cards.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"defa0fd197206519b63e483f9cb3f5280a893af6bcecebc46330a478ecd83238","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-18-108","next":"us-ok/okla.-stat.-tit.-70-70-18-109.5"},"notice":"GroundRules: Original legal text.
