Stat. tit. 70, § 70-18-113.2","heading":"Class size limitations - Kindergarten - Penalties -","body":"Exemptions.\n\nA. The provisions of this section shall apply only to\n\nkindergarten.\n\n1. No child shall be included in the average daily membership\n\nof a school district for the purpose of computing and paying state-\n\nappropriated funds if that child is regularly assigned to a teacher\n\nor to a class that includes more than twenty (20) students.\n\n2. If a class or classes in a grade exceed the class size\n\nlimitation provided for in this subsection, the class size\n\nlimitation and penalty shall not apply if:\n\na. the creation of an additional class would cause a\n\nclass to have fewer than ten (10) students; and\n\nb. a teacher's assistant, as defined in Section 6-127 of\n\nthis title, is employed to serve with each teacher in\n\na class that exceeds the class size limitation\n\nprovided for in this subsection.\n\n3. No school district shall be penalized for exceeding class\n\nsize limitations set forth in this section if the limitations are\n\nexceeded beginning after the first nine (9) weeks of the school\n\nyear.\n\n4. Any school district which at the beginning of the school\n\nyear does not have sufficient classrooms to meet the class size\n\nlimitation provided for in this section as determined by guidelines\n\nestablished by the State Board of Education shall not be penalized\n\nfor failure to meet the class size limitations provided for in this\n\nsection if:\n\na. the school district has voted indebtedness, at any\n\ntime within the five (5) years preceding the year the\n\ndistrict exceeds the class size limitations or during\n\nthe year the district exceeds the class size\n\nlimitations, through the issuance of bonds or approval\n\nby voters of issuance of new bonds for more than\n\neighty-five percent (85%) of the maximum allowable\n\npursuant to the provisions of Section 26 of Article X\n\nof the Oklahoma Constitution as shown on the school\n\ndistrict budget filed with the State Equalization\n\nBoard for the current school year and certifications\n\nby the Attorney General prior to February 1 of the\n\ncurrent school year; and\n\nb. on the date of filing of the school district budget\n\nwith the State Equalization Board, the school district\n\nis voting the maximum millage allowable for the\n\nsupport, maintenance and construction of schools as\n\nprovided for in subsections (a), (c), (d) and (d-1) of\n\nSection 9 of Article X of the Oklahoma Constitution\n\nand Section 10 of Article X of the Oklahoma\n\nConstitution.\n\n5. Any school district found to be in violation of the\n\nprovisions of this subsection shall receive a penalty in the State\n\nAid formula as a reduction to State Aid to be determined as follows:\n\na. Multiply each pupil in excess of the class size\n\nmembership limit as provided in this subsection by the\n\ngrade level weight and by the Base Foundation Support\n\nLevel for the current school year, and\n\nb. Multiply each pupil in excess of the class size\n\nmembership limit as provided in this subsection by the\n\ngrade level weight and by the Incentive Aid guarantee\n\nfor the current school year times twenty (20), and\n\nc. Sum the products of subparagraphs a and b of this\n\nparagraph.\n\nB. Any violations of the provisions of this section shall\n\nresult in denial of accreditation in accordance with the\n\nrequirements of Section 3-104.4 of this title.\n\nC. School districts which receive state-appropriated funds\n\npursuant to the provisions of Section 18-112.2 of this title and do\n\nnot comply with the provisions of this section shall be subject to\n\nloss of State Aid for each child in excess of the class size\n\nlimitations specified in this section.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"12c4519d00da3ad91a51c757acaee09e282a7b38e1caa68a18228114768721aa","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-18-113.1","next":"us-ok/okla.-stat.-tit.-70-70-18-113.3"},"notice":"GroundRules: Original legal text.
