Any school district which willfully operates school buses\n\ncontrary to the rules and regulations prescribed by the State Board\n\nof Education shall forfeit its State Aid for the time of\n\nnoncompliance. All State Aid funds shall be withheld from any\n\nschool district that does not comply with the standards of the State\n\nBoard of Education for accrediting.\n\nB. Any school district that willfully pays a teacher less than\n\nthe minimum salary required by law including the five percent (5%)\n\nincrements for special education or alternative education shall\n\nforfeit a portion of its State Aid equal to the amount that the\n\nteacher was underpaid. The amount to be forfeited shall be deducted\n\nfrom the State Aid payment following confirmation of the\n\nunderpayment by the State Department of Education.\n\nC. 1. No more than fifty percent (50%) of the funds\n\napportioned to school districts under the provisions of this article\n\nshall be paid by the state unless and until there has been filed\n\nwith the State Board of Education on forms prescribed by such Board\n\nan itemized sworn account of the expenditures and revenues of the\n\nschool district during the next preceding fiscal year and a teacher\n\npersonnel report for the current year.\n\n2. All State Aid paid to a district whose district budget, as\n\nfiled with the State Auditor and Inspector, shows that the\n\nappropriations of the district, plus the State Aid and other cash\n\nfunds for which the district qualifies, will not enable it to\n\nmaintain a full term of school as defined by this article, shall be\n\ncredited against the State Aid of the district or districts to which\n\nthe first district shall be annexed, if annexation is required. It\n\nis intended that the balance of any unexpended State Aid or other\n\nrevenue originally allocated to an annexed district shall be paid to\n\nthe receiving district.\n\nD. School districts receiving State Aid shall not spend any of\n\nthese funds except by regularly issued warrants. The warrants shall\n\nbe issued against properly approved encumbrances in the manner\n\nprovided by law. All encumbrances shall be approved by the board of\n\neducation of the school district at a regular meeting or a special\n\nmeeting called for that purpose. All original copies of\n\nencumbrances as represented by purchase orders, shall be filed in\n\neither numerical or alphabetical order, with the original paid\n\ninvoice or invoices attached, accompanied by a signed and dated\n\nreceiving copy verifying receipt of goods or services. It shall be\n\nunlawful to register or pay the warrant unless such warrant conforms\n\nto the statutes regulating the allowance and issuance thereof. Said\n\ntreasurer shall purchase, by treasurer's check, all warrants issued.\n\nE. All board of education members, employees, or other\n\nofficials of school districts required to make reports to the State\n\nBoard of Education or other agencies under the provisions of this\n\narticle, and all persons lawfully charged with the duty of making\n\nrecords of original entry, such as teachers' registers,\n\ntransportation records, and financial records, which form the basis,\n\nin whole or in part, of said reports, shall exercise the highest\n\ndegree of diligence, accuracy, and good faith in making said records\n\nand reports reflect the truth. Teachers' registers shall be marked\n\ndaily in ink, by the teacher or principal in charge of rooms or\n\ngroups of pupils. Provided, the State Board of Education may\n\nauthorize alternate systems of accounting for pupils' attendance in\n\ndistricts using data processing methods.\n\nF. The State Board of Education shall revoke the certificate of\n\nany teacher, principal, or superintendent who knowingly or willfully\n\nviolates any of the provisions of this article.\n\nG. Any official involved in the execution of this article who\n\nshall fail or refuse to carry out any of the provisions thereof\n\nshall be liable on his official bond, if any, for the monetary\ndata processing methods.\n\nF. The State Board of Education shall revoke the certificate of\n\nany teacher, principal, or superintendent who knowingly or willfully\n\nviolates any of the provisions of this article.\n\nG. Any official involved in the execution of this article who\n\nshall fail or refuse to carry out any of the provisions thereof\n\nshall be liable on his official bond, if any, for the monetary\n\ndamages resulting from said failure to act, and in addition thereto\n\nshall be subject to removal from office for neglect of duty under\n\nthe provisions of law relating to the removal of public officials.\n\nH. Any person or firm who shall knowingly or willfully violate\n\nany of the provisions of this article shall be guilty of a\n\nmisdemeanor. Any public official or public employee violating any\n\nof the provisions of this article shall be subject to the penalties\n\nfor a misdemeanor and in addition thereto shall forfeit his position\n\nor office. Any officer or employee of the State Board of Education\n\nwho knowingly or willfully apportions or disburses any monies\n\nappropriated by this article contrary to the provisions of this\n\narticle shall be subject to the penalties for a misdemeanor and in\n\naddition shall forfeit his office or position.\n\nI. The State Board of Education shall prescribe the form of all\n\nrecords, reports and applications for State Aid necessary to the\n\nproper administration of this article, and it shall be the duty of\n\nall, school district superintendents, and boards of education of\n\nschool districts to make such reports fully and completely at the\n\ntime and in the manner prescribed by the State Board of Education.\n\nThe State Board of Education shall also have authority and it shall\n\nbe its duty to promulgate rules and regulations, not inconsistent\n\nwith the provisions hereof, relative to the distribution of funds\n\nand for the administration of this article. Such regulations and\n\nrules shall apply alike to all school districts.\n\nJ.
