Stat. tit. 70, § 70-21-102.1","heading":"Oklahoma Board of Private Vocational Schools -","body":"Director - Powers and duties.\n\nThe Oklahoma Board of Private Vocational Schools is authorized\n\nto:\n\n1. Appoint and fix the compensation of a director who:\n\na. shall employ and fix the duties and compensation of\n\nsuch clerical or other assistants as are reasonably\n\nnecessary to effectuate the provisions of Section 21-\n\n101 et seq. of this title, and\n\nb. may execute contracts on behalf of the Board;\n\n2. Promulgate rules to include but not be limited to the\n\nimplementation of minimum standards for the operation of private\n\nschools and the requirements for application of a school, seminar or\n\nworkshop for a license of state authorization;\n\n3. Approve or disapprove:\n\na. applications for state authorization,\n\nb. other applications for licensing including\n\napplications for sustained licenses,\n\nc. requests for exemption, and\n\nd. requests for a definition exception;\n\n4. Issue a private school license to document state\n\nauthorization or other licensing upon determination that such school\n\nmeets the standards fixed by the Board;\n\n5. Prescribe, except as is otherwise provided by law and\n\nsubject to the provisions of the Administrative Procedures Act, such\n\npenalties as it may deem proper for the enforcement of Section 21-\n\n101 et seq. of this title, not to exceed One Thousand Dollars\n\n($1,000.00);\n\n6. Fix minimum standards through promulgation of rules for\n\nprivate schools, which shall include standards for:\n\na. courses of instruction and training,\n\nb. qualifications of instructors,\n\nc. financial stability,\n\nd. advertising practices, and\n\ne. refund of tuition and fees paid by students for\n\ncourses of instruction or training not completed;\n\n7. Where possible, to regulate degrees offered by distance\n\neducation, make use of the State Regents for Higher Education's\n\ninterstate reciprocity agreements to create a more efficient and\n\ncost-effective means of the regulation of private schools;\n\n8. Make use of interstate reciprocity agreements that\n\nreasonably satisfy the Board's minimum standards to approve state\n\nauthorization or other license application, if such agreements\n\nbecome available for other programs the Board approves for state\n\nauthorization or other license;\n\n9. Require an entity to repay any fees charged to the Board by\n\na financial institution or the State Treasurer for a returned check\n\nor other failed form of payment;\n\n10. Develop and present mandatory annual compliance training to\n\nemphasize standards relating to the operation of a school and\n\nrelicensing processes, and require attendance by a representative of\n\neach school, seminar or workshop;\n\n11. Develop and present or arrange for the presentation of\n\noptional training for schools to emphasize continuing development of\n\nschool personnel and processes and to address emerging issues;\n\n12. Provide all licensing forms free of charge via one or more\n\nelectronic means, but shall charge for the pick up or mailing of a\n\nhard-copy licensing application packet to a person requesting\n\ninformation about private school licensing requirements;\n\n13. Certify an electronic record or the printing of an\n\nelectronically stored record as an original, subject to approval by\n\nthe Oklahoma Archives and Records Commission and when in accordance\n\nwith the record retention and destruction policy of the Board;\n\n14. Conduct announced or unannounced site visits to an\n\napplicant or licensed school or seminar including joint visits with\n\nan accrediting organization or federal or state agency;\n\n15. Invoice a travel fee to conduct site visits to an\n\napplicant, school, seminar or workshop;\n\n16. Collect or require the submission of data, including but\n\nnot limited to:\n\na. admissions,\n\nb. certification scores or passage rates,\n\nc. complaints or grievances,\n\nd. enrollment,\n\ne. funding,\n\nf. graduation,\n\ng. job longevity or retention,\n\nh. job placement,\n\ni. data required to be reported to the U.S. Department of\nschool, seminar or workshop;\n\n16. Collect or require the submission of data, including but\n\nnot limited to:\n\na. admissions,\n\nb. certification scores or passage rates,\n\nc. complaints or grievances,\n\nd. enrollment,\n\ne. funding,\n\nf. graduation,\n\ng. job longevity or retention,\n\nh. job placement,\n\ni. data required to be reported to the U.S. Department of\n\nEducation, any state or federal agency or an\n\naccrediting organization, and\n\nj. other data, as necessary, to carry on the mission or\n\nduties of the Board, or to assist in the state's\n\nworkforce development initiatives; and\n\n17.
