Stat. tit. 70, § 70-21-106","heading":"Expiration and renewal of license - Bond - Fees -","body":"Private School Fund - Delinquent renewal fees.\n\nA. A license issued pursuant to Section 21-101 et seq. of this\n\ntitle shall expire annually on June 30. Such license shall be\n\nrenewed annually with the complete renewal application and any and\n\nall appropriate fees due prior to expiration on or before June 1 of\n\neach year. Licenses shall be renewed by the Oklahoma Board of\n\nPrivate Vocational Schools if the Board determines that such school\n\nremains in compliance with the standards or other requirements set\n\nby the Board. The license of any school licensed by the Board to\n\nprovide postsecondary education or other limited offering may be\n\nrevoked if the school is found to be in violation of the Oklahoma\n\nStatutes, the minimum standards established by the Board or if an\n\naccreditation organization or other governmental entity's approval,\n\nmaterial to the continuity of the school, is revoked.\n\nB. If a school is accredited by an accrediting organization\n\napproved by the U.S. Department of Education for multiple years, a\n\nsustained license may be obtained annually during the period of the\n\nmulti-year accreditation.\n\nC. A license of a school shall not be effective unless the\n\nprivate school has filed with the Board a corporate surety bond or a\n\ncertificate of deposit in a manner and in an amount as is required\n\nby the Board.\n\nD. Private schools or applicants shall pay the following base\n\nfees to the Board:\n\n1. One Thousand Two Hundred Dollars ($1,200.00) per license\n\nshall be paid for the issuance of an initial license for a school,\n\nseminar, or workshop to provide postsecondary education or other\n\nvocational-technical education or training pursuant to the\n\nprovisions of Section 21-101 et seq. of this title;\n\n2. Three Hundred Dollars ($300.00) shall be paid for the\n\ninitial license of each new branch. A branch's renewal fee shall be\n\nbased on the tuition it collected;\n\n3. For each renewal of a license, a fee based on the tuition\n\ncollected by a school, workshop or seminar from residents of\n\nOklahoma or other persons present in Oklahoma, as shown in the\n\ncurrent financial statement of the school. If a school, workshop or\n\nseminar does not provide adequate details of its Oklahoma tuition,\n\nthen the renewal fee shall be based on the nationwide tuition\n\nreported. For each main and branch school, seminar or workshop, the\n\nrenewal fees shall be calculated based upon the level of net tuition\n\nin the immediate prior calendar year as follows:\n\nOKLAHOMA OR NATIONWIDE TUITION INCOME RENEWAL FEE\n\n$50,000.00 or less $ 700.00\n\n$50,000.01 to $250,000.00 $ 800.00\n\n$250,000.01 to $500,000.00 $ 950.00\n\n$500,000.01 to $1,000,000.00 $1,100.00\n\n$1,000,000.01 to $3,000,000.00 $1,300.00\n\n$3,000,000.01 and above $1,500.00;\n\n4. Solicitor license:\n\na. Two Hundred Dollars ($200.00) during the first\n\nlicensing period of a school, seminar or workshop, for\n\neach license,\n\nb. One Hundred Dollars ($100.00) for the second and\n\nconsecutive licensing periods of the school, seminar\n\nor workshop, for each license applied for or renewed;\n\n5. A review fee for a revised or replacement catalog or changes\n\nto an approved catalog, catalog addendum(s) or a combination of a\n\ncatalog and catalog addendum(s) per campus included in the catalog\n\nor addendums to be charged as follows:\n\na. One Hundred Dollars ($100.00) for the review of a\n\nrevised or replacement catalog that does not include a\n\nprogram change or addition, or\n\nb. One Hundred Fifty Dollars ($150.00) for the review of\n\nthe related catalog, catalog addendum or a combination\n\nof a catalog and catalog addendum that adds or revises\n\na program of study consisting of multiple courses;\n\n6. A review fee of Fifty Dollars ($50.00) shall be paid in\n\naddition to the review fee provided for in paragraph 5 of this\n\nsubsection whenever a main or branch private school changes\n\nlocation;\nifty Dollars ($150.00) for the review of\n\nthe related catalog, catalog addendum or a combination\n\nof a catalog and catalog addendum that adds or revises\n\na program of study consisting of multiple courses;\n\n6. A review fee of Fifty Dollars ($50.00) shall be paid in\n\naddition to the review fee provided for in paragraph 5 of this\n\nsubsection whenever a main or branch private school changes\n\nlocation;\n\n7. A review fee of Fifty Dollars ($50.00) shall also be paid\n\nwhenever a school, seminar or workshop is required to provide\n\npreliminary Board review or approval documentation to be forwarded\n\nto an accrediting organization, the U.S. Department of Education or\n\nanother state or federal agency;\n\n8. The payment of the fee required by paragraph 7 of this\n\nsubsection shall be applied as a credit against the subsequent fee\n\nfor a review of a catalog or catalog addendum(s) that is submitted\n\nto include incorporation of the same topic(s) following final\n\napproval of the subject matter by an accreditor or the U.S.\n\nDepartment of Education;\n\n9. Two Hundred Dollars ($200.00) shall be paid by each school\n\nto the Board for attendance at a school workshop or webinar by the\n\nschool's required personnel, although one person may attend to\n\nrepresent multiple, related schools;\n\n10. Two Hundred Dollars ($200.00) for a half-day and Three\n\nHundred Dollars ($300.00) for a full day of optional training; and\n\n11. Forty Dollars ($40.00) by each school, seminar or workshop\n\nfor review of each revised or replacement enrollment agreement\n\nincluding single enrollment agreements to be used by multiple\n\nrelated entities.\n\nE. The base fees authorized by paragraphs 1, 2 and 3 of\n\nsubsection D of this section shall increase by seven percent (7%)\n\nfor the fiscal year ending June 30, 2022.\n\nF. If the annual licensing renewal application is not complete\n\non or before the first day of June each year, the fee for license\n\nrenewal shall become delinquent and the license shall not be renewed\n\nexcept upon payment of an additional late fee. Late fees shall be\n\ndetermined based upon the school's past history of submitting late\n\nfilings. The appropriate late fees shall be paid in full prior to\n\nthe Board's issuance of a renewal license in the following amounts:\n\n1. Two Hundred Fifty Dollars ($250.00) for a first violation;\n\n2. Five Hundred Dollars ($500.00) for a second violation within\n\nten (10) years of the first late filing, whether consecutive or not;\n\nand\n\n3. One Thousand Dollars ($1,000.00) for a third violation\n\nwithin ten (10) years of the first late filing, whether consecutive\n\nor not.\n\nEach violation beyond the third shall result in the school,\n\nseminar or workshop being required to seek new or initial licensure\n\nand only after payment of the full fee for a new license.\n\nG. Twenty-five Dollars ($25.00) for each license application\n\npacket, although packets provided by one or more electronic means\n\nshall be free of charge.\n\nH. In-state site visit fees shall be charged for the purpose of\n\nreviewing compliance with minimum standards or contractual\n\nagreements, facility inspection or complaint investigation. The\n\nfees shall be charged to an applicant, school, seminar or workshop\n\nas follows:\n\n1. Two Hundred Twenty-five Dollars ($225.00) per day when the\n\nsite visit does not require overnight lodging;\n\n2. Four Hundred Fifty Dollars ($450.00) per day if overnight\n\nlodging is required; and\n\n3. Travel fees to multiple entities on the same day may be\n\napportioned or prorated when each visit involves on-site time of\n\nless than three (3) hours.\n\nI. An in-state visit fee shall not be charged:\n\n1. When the Board joins an accrediting organization, the U.S.\n\nDepartment of Education or another state or federal agency with the\n\norganization or agency's site visit to an applicant, school, seminar\n\nor workshop; or\n\n2. For a brief visit to an applicant, school, seminar or\norated when each visit involves on-site time of\n\nless than three (3) hours.\n\nI. An in-state visit fee shall not be charged:\n\n1. When the Board joins an accrediting organization, the U.S.\n\nDepartment of Education or another state or federal agency with the\n\norganization or agency's site visit to an applicant, school, seminar\n\nor workshop; or\n\n2. For a brief visit to an applicant, school, seminar or\n\nworkshop that requires no advance preparation work on the part of\n\nthe Board.\n\nJ. The Board shall be authorized to require reimbursement for\n\nany fees charged by a financial institution or the State Treasurer\n\nfor a returned check or other failed form of payment.\n\nK.
