Stat. tit. 70, § 70-23-104","heading":"The meaning of words and terms","body":"As used in this article, unless the context indicates otherwise:\n\n1. \"State Department of Education\" means that department of the\n\nstate government in which are placed the agencies created or\n\nauthorized by the Constitution and Legislature charged with the\n\nresponsibility of determining the policies and directing the\n\nadministration and supervision of the common school system of the\n\nstate. These agencies are the State Board of Education, the State\n\nSuperintendent of Public Instruction, and such divisions and\n\npositions as may be established by law or by the State Board of\n\nEducation.\n\n2. \"State Board of Education\" means that agency in the State\n\nDepartment of Education which is the governing board of said\n\nDepartment and of the common school system of the state.\n\n3. \"State Superintendent of Public Instruction\" means the\n\nelected offical provided for in Article VI, Section 1 of the\n\nConstitution of Oklahoma, who is the executive officer of the State\n\nBoard of Education.\n\n4. \"Oklahoma State Regents for Higher Education\" means that\n\nbody created by Article XIII-A of the Constitution of Oklahoma to\n\ncoordinate the affairs of all institutions of higher learning\n\nsupported by taxation in the State of Oklahoma.\n\n5. \"Common schools of Oklahoma\" means all private schools and\n\nall schools supported by public taxation, and including elementary\n\nand secondary schools, the first two (2) years of junior college,\n\nnight school, adult and other special classes, and vocational\n\ninstruction.\n\n6. \"Institutions of higher learning\" means all private\n\ninstitutions and all the state universities and colleges which are\n\nsupported by public taxation or otherwise authorized by laws in\n\neffect or enacted hereinafter.\n\n7. \"Authority\" means the Oklahoma Educational Television\n\nAuthority created by Section 23-105 of this article, or, if said\n\nAuthority shall be abolished, the board, body, or commission\n\nsucceeding to the principal functions of said Authority, or to whom\n\nthe power is given by law.\n\n8. \"Facilities\" means channels, all equipment, and properties,\n\nincluding the construction and operation thereof at any given point\n\ntogether with all rights, easements, leases, and interests which may\n\nbe acquired by the Authority for such construction and operation\n\nwhich may be deemed necessary for the accomplishment of the purposes\n\nset forth in Section 23-101 of this article.\n\n9. \"Cost\" as applied to the facilities means the cost of\n\nconstruction including the acquisition of all land, rights-of-way,\n\nproperty, rights, easements, and interest acquired by the Authority\n\nfor such construction; all machinery and equipment, financing\n\ncharges, interest prior to and during construction; engineering and\n\nlegal expenses, plans, specifications, surveys, estimates of cost\n\nand of revenues, other expenses necessary or incident to determining\n\nthe feasibility or practicability of constructing any such\n\nfacilities; administrative expense, and such other expense as may be\n\nnecessary or incident to the construction of the facilities; and the\n\nfinancing of such construction and the placing of the facilities in\n\noperation.\n\n10. \"Owner\" means all individuals, copartnerships,\n\nassociations, or corporations having any title or interest in any\n\nproperty, rights, easements, and interest authorized to be acquired\n\nby this article.\n\n11. \"Oklahoma Educational Television Network\" means the\n\neducational television channels allocated to the state by the\n\nFederal Communications Commission and maintained and operated by the\n\nOklahoma Educational Television Authority.\n\n12. \"Executive Director\" means the Executive Director of the\n\nOklahoma Educational Television Authority, authorized by the\n\nprovisions of Section 3 of this act.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a07854a345ca159f3c94d36bcc5f2de8f273912658d7f8a052431601b284a145","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-23-102","next":"us-ok/okla.-stat.-tit.-70-70-23-105"},"notice":"GroundRules: Original legal text.
