Stat. tit. 70, § 70-23-106","heading":"Powers of Authority","body":"The Authority is hereby authorized and empowered:\n\n1. To accept, assume and control the television channels\n\nassigned by the Federal Communications Commission to the State of\n\nOklahoma for educational purposes;\n\n2. To adopt bylaws for the regulation of its affairs and the\n\nconduct of its business;\n\n3. To adopt an official seal and alter the same at pleasure;\n\n4. To maintain an office at such place or places within the\n\nstate as it may designate;\n\n5. To sue and be sued in its own name, plead and be impleaded;\n\nprovided, however, that any and all actions, at law or in equity,\n\nagainst the Authority shall be brought in the county in which the\n\nprincipal office of the Authority shall be located, or in the county\n\nof the residence of the plaintiff, or in the county where the cause\n\nof action arose;\n\n6. To construct, maintain, repair and operate television\n\nfacilities which with their access connections are designated\n\nultimately to extend to and include all sections and areas of the\n\nState of Oklahoma;\n\n7. To issue revenue bonds of the Authority, payable solely from\n\ndedicated revenues, for the purpose of paying all or any part of the\n\ncost of needed facilities;\n\n8. To fix and revise from time to time any necessary charges\n\nfor the use of any facilities;\n\n9. To pay for the annual cost of the operation, maintenance and\n\nrepair of such facilities;\n\n10. To pay as and when due the principal and interest on the\n\nrevenue certificates or bonds issued to pay for such facilities;\n\n11. To accumulate and maintain such reserves as are provided\n\nfor in the resolution or trust indenture under which such bonds are\n\nissued or secured;\n\n12. To acquire, hold, or dispose of real and personal property\n\nin the exercise of its powers and the performance of its duties\n\nunder this act;\n\n13. To acquire in the name of the Authority by purchase or\n\notherwise, on such terms and conditions and in such manner as it may\n\ndeem proper, or by the exercise of the right of condemnation in\n\nmanner hereinafter provided, such public or private lands, rights-\n\nof-way, property, rights, easements, and interests, as it may deem\n\nnecessary for carrying out the provisions of this article; and it is\n\nthe intent of the Legislature that all public property damaged in\n\ncarrying out the powers granted by this article shall be restored or\n\nrepaired and placed in its original condition as nearly as\n\npracticable;\n\n14. To designate, except as is provided for herein, the\n\nlocations; and to establish, limit and control such points of\n\ningress to and egress from each facility as may be necessary or\n\ndesirable in the judgment of the Authority to insure the proper\n\noperation and maintenance of such facility;\n\n15. To make and enter into all contracts and agreements\n\nnecessary or incidental to the performance of its duties and the\n\nexecution of its powers under this article, and to employ consulting\n\nengineers, attorneys, accountants, construction and financial\n\nexperts, superintendents, managers, and such other employees and\n\nagents as may be necessary in its judgment, and to fix their\n\ncompensation;\n\n16. To receive appropriations from the State Legislature and\n\naccept from any federal agency grants for or in aid of the\n\nconstruction and operation of any project; provided, the acceptance\n\nof such grants or appropriations will not reduce the amount of\n\nfederal aid for other education in this state; and to receive and\n\naccept aid or contributions from any source of either money,\n\nproperty, labor, or other things of value;\n\n17. To do any and all things necessary to comply with rules,\n\nregulations, or requirements of the Federal Communications\n\nCommission or any other federal agency administering any law enacted\n\nby the Congress of the United States to aid or encourage education;\n\n18. To do all things necessary or convenient to carry out the\n\npowers expressly granted in this article.\nutes - Title 70. Schools Page 902\n\n17. To do any and all things necessary to comply with rules,\n\nregulations, or requirements of the Federal Communications\n\nCommission or any other federal agency administering any law enacted\n\nby the Congress of the United States to aid or encourage education;\n\n18. To do all things necessary or convenient to carry out the\n\npowers expressly granted in this article.\n\nIt shall be unlawful for any member, officer, or employee of the\n\nAuthority to transact with the Authority, either directly or\n\nindirectly, any business for profit of such member, officer, or\n\nemployee; and any person, firm or corporation knowingly\n\nparticipating therein shall be equally liable for violation of this\n\nprovision.\n\nThe term “business for profit” shall include, but not be limited\n\nto, the acceptance or payment of any fee, commission, gift or\n\nconsideration to such member, officer or employee.\n\nAny person found guilty of violating any of the provisions of\n\nthis section shall be guilty of a Class D1 felony offense, and shall\n\nbe punishable by a fine of not less than Five Hundred Dollars\n\n($500.00), and not more than Five Thousand Dollars ($5,000.00), or\n\nby imprisonment as provided for in subsections B through F of\n\nSection 20N of Title 21 of the Oklahoma Statutes, or by both such\n\nfine and imprisonment.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"49cd3263821f45db6c9a2fe9b394a8fb900f8777e28731f34c56494b184343da","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-23-105","next":"us-ok/okla.-stat.-tit.-70-70-23-106.1"},"notice":"GroundRules: Original legal text.
