Stat. tit. 70, § 70-24-100.4","heading":"School Safety and Bullying Prevention Act -","body":"Discipline of child - Prohibition of bullying at school and online –\n\nPolicy requirements.\n\nA. Each school district board of education shall adopt a policy\n\nfor the discipline of all children attending public school in that\n\ndistrict, and for the investigation of reported incidents of\n\nbullying. The policy shall provide options for the discipline of\n\nthe students and shall define standards of conduct to which students\n\nare expected to conform. The policy shall:\n\n1. Specifically address bullying by students at school and by\n\nelectronic communication, if the communication is specifically\n\ndirected at students or school personnel and concerns bullying at\n\nschool;\n\n2. Contain a procedure for reporting an act of bullying to a\n\nschool official or law enforcement agency, including a provision\n\nthat permits a person to report an act anonymously. No formal\n\ndisciplinary action shall be taken solely on the basis of an\n\nanonymous report;\n\n3. Contain a requirement that any school employee that has\n\nreliable information that would lead a reasonable person to suspect\n\nthat a person is a target of bullying shall immediately report it to\n\nthe principal or a designee of the principal;\n\n4. Contain a statement of how the policy is to be publicized\n\nincluding a requirement that:\n\na. an annual written notice of the policy be provided to\n\nparents, guardians, staff, volunteers and students,\n\nwith age-appropriate language for students,\n\nb. notice of the policy be posted at various locations\n\nwithin each school site, including but not limited to\n\ncafeterias, school bulletin boards, and administration\n\noffices,\n\nc. the policy be posted on the Internet website for the\n\nschool district and each school site that has an\n\nInternet website, and\n\nd. the policy be included in all student and employee\n\nhandbooks;\n\n5. Require that appropriate school district personnel involved\n\nin investigating reports of bullying make a determination regarding\n\nwhether the conduct is actually occurring;\n\n6. Contain a procedure for providing timely notification to the\n\nparents or guardians of a victim of documented and verified bullying\n\nand to the parents or guardians of the perpetrator of the documented\n\nand verified bullying;\n\n7. Identify by job title the school official responsible for\n\nenforcing the policy;\n\n8. Contain procedures for reporting to law enforcement all\n\ndocumented and verified acts of bullying which may constitute\n\ncriminal activity or reasonably have the potential to endanger\n\nschool safety;\n\n9. Require training for administrators and school employees as\n\ndeveloped and provided by the State Department of Education in\n\npreventing, identifying, responding to and reporting incidents of\n\nbullying. The training shall be completed the first year an\n\nadministrator or school employee is employed by a school district,\n\nand then once every fifth academic year;\n\n10. Provide for an educational program as designed and\n\ndeveloped by the State Department of Education and in consultation\n\nwith the Office of Juvenile Affairs for students and parents in\n\npreventing, identifying, responding to and reporting incidents of\n\nbullying;\n\n11. Establish a procedure for referral of a person who commits\n\nan act of bullying to a delinquency prevention and diversion program\n\nadministered by the Office of Juvenile Affairs;\n\n12. Address prevention by providing:\n\na. consequences and remedial action for a person who\n\ncommits an act of bullying,\n\nb. consequences and remedial action for a student found\n\nto have falsely accused another as a means of\n\nretaliation, reprisal or as a means of bullying, and\n\nc. a strategy for providing counseling or referral to\n\nappropriate services, including guidance, academic\n\nintervention, and other protection for students, both\n\ntargets and perpetrators, and family members affected\n\nby bullying, as necessary;\n\n13. Establish a procedure for:\non for a student found\n\nto have falsely accused another as a means of\n\nretaliation, reprisal or as a means of bullying, and\n\nc. a strategy for providing counseling or referral to\n\nappropriate services, including guidance, academic\n\nintervention, and other protection for students, both\n\ntargets and perpetrators, and family members affected\n\nby bullying, as necessary;\n\n13. Establish a procedure for:\n\na. the investigation, determination and documentation of\n\nall incidents of bullying reported to school\n\nofficials,\n\nb. identifying the principal or a designee of the\n\nprincipal as the person responsible for investigating\n\nincidents of bullying,\n\nc. reporting the number of incidents of bullying, and\n\nd. determining the severity of the incidents and their\n\npotential to result in future violence;\n\n14. Establish a procedure whereby, upon completing an\n\ninvestigation of bullying, a school may recommend that available\n\ncommunity mental health care, substance abuse or other counseling\n\noptions be provided to the student, if appropriate; and\n\n15. Establish a procedure whereby a school may request the\n\ndisclosure of any information concerning students who have received\n\nmental health, substance abuse, or other care pursuant to paragraph\n\n14 of this subsection that indicates an explicit threat to the\n\nsafety of students or school personnel, provided the disclosure of\n\nthe information does not violate the requirements and provisions of\n\nthe Family Educational Rights and Privacy Act of 1974, the Health\n\nInsurance Portability and Accountability Act of 1996, Section 2503\n\nof Title 12 of the Oklahoma Statutes, Section 1376 of Title 59 of\n\nthe Oklahoma Statutes, or any other state or federal laws regarding\n\nthe disclosure of confidential information.\n\nB. In developing the policy, the district board of education\n\nshall make an effort to involve the teachers, parents,\n\nadministrators, school staff, school volunteers, community\n\nrepresentatives, local law enforcement agencies and students. The\n\nstudents, teachers, and parents or guardian of every child residing\n\nwithin a school district shall be notified by the district board of\n\neducation of its adoption of the policy and shall receive a copy\n\nupon request. The school district policy shall be implemented in a\n\nmanner that is ongoing throughout the school year and is integrated\n\nwith other violence prevention efforts.\n\nC. The teacher of a child attending a public school shall have\n\nthe same right as a parent or guardian to control and discipline\n\nsuch child according to district policies during the time the child\n\nis in attendance or in transit to or from the school or any other\n\nschool function authorized by the school district or classroom\n\npresided over by the teacher.\n\nD. Except concerning students on individualized education plans\n\n(IEP) pursuant to the Individuals with Disabilities Education Act\n\n(IDEA), P.L. No. 101-476, the State Board of Education shall not\n\nhave authority to prescribe student disciplinary policies for school\n\ndistricts or to proscribe corporal punishment in the public schools.\n\nThe State Board of Education shall not have authority to require\n\nschool districts to file student disciplinary action reports more\n\noften than once each year and shall not use disciplinary action\n\nreports in determining a school district's or school site's\n\neligibility for program assistance including competitive grants.\n\nE. The board of education of each school district in this state\n\nshall have the option of adopting a dress code for students enrolled\n\nin the school district. The board of education of a school district\n\nshall also have the option of adopting a dress code which includes\n\nschool uniforms.\n\nF. The board of education of each school district in this state\n\nshall have the option of adopting a procedure that requires students\n\nto perform campus-site service for violating the district's policy.\n\nG. The State Board of Education shall:\nd\n\nin the school district. The board of education of a school district\n\nshall also have the option of adopting a dress code which includes\n\nschool uniforms.\n\nF. The board of education of each school district in this state\n\nshall have the option of adopting a procedure that requires students\n\nto perform campus-site service for violating the district's policy.\n\nG. The State Board of Education shall:\n\n1. Promulgate rules for periodically monitoring school\n\ndistricts for compliance with this section and providing sanctions\n\nfor noncompliance with this section;\n\n2. Establish and maintain a central repository for the\n\ncollection of information regarding documented and verified\n\nincidents of bullying; and\n\n3.
