A school district in which a student is enrolled or is in\n\nthe process of enrolling in may request the student’s education\n\nrecords from any school district in which the student was formerly\n\nenrolled to ascertain safety issues with incoming students and\n\nensure full disclosure. A district that receives a request for the\n\neducation records of a student who formerly was enrolled in the\n\ndistrict shall forward the records within three (3) business days of\n\nreceipt of the request. The records shall include the student’s\n\ndisciplinary records. Disciplinary records shall include but not be\n\nlimited to all information that relates to a student assaulting,\n\ncarrying weapons, possessing illegal drugs, including alcohol, and\n\nany incident that poses a potential dangerous threat to students or\n\nschool personnel. The forwarding and disclosure of disciplinary\n\nrecords or other education records to a school district in which a\n\nstudent seeks or intends to enroll shall be in accordance with the\n\nannual notification requirements and provisions of the Family\n\nEducational Rights and Privacy Act of 1974 (FERPA).\n\nB. Each school district shall be required to release\n\nnondirectory educational records to the agencies listed in Section\n\n620.3 of Title 10 of the Oklahoma Statutes. The release of any\n\nrecords shall be in accordance with the provisions of FERPA. The\n\nterm \"nondirectory educational records\" shall be those records\n\nmaintained by the school regarding a child who is or has been a\n\nstudent at the school which are categorized as private or\n\nconfidential records pursuant to FERPA.\n\nC. The State Board of Education shall promulgate rules for\n\nmonitoring school districts for compliance with this section and\n\nproviding sanctions for noncompliance with this section. The Board\n\nshall inform school districts of their statutory responsibilities\n\nfor compliance with FERPA.
