Whenever it appears to any public school teacher that a\n\nstudent may be under the influence of low-point beer as defined in\n\nSection 163.2 of Title 37 of the Oklahoma Statutes, alcoholic\n\nbeverages as defined in Section 506 of Title 37 of the Oklahoma\n\nStatutes or a controlled dangerous substance, as defined in Section\n\n2-101 of Title 63 of the Oklahoma Statutes, that teacher shall\n\nreport the matter, upon recognition, to the school principal or his\n\nor her designee. The principal or designee shall immediately notify\n\nthe superintendent of schools or designee and a parent or legal\n\nguardian of the student of the matter.\n\nNo officer or employee of any public school district or member\n\nof any school board shall be subject to any civil liability for any\n\nstatement, report, or action taken in assisting or referring for\n\nassistance to any medical treatment, social service agency or\n\nfacility or any substance abuse prevention and treatment program any\n\nstudent reasonably believed to be abusing or incapacitated by the\n\nuse of low-point beer, alcoholic beverages or a controlled dangerous\n\nsubstance unless such assistance or referral was made in bad faith\n\nor with malicious purpose. No such officer or employee of any\n\npublic school district, member of any school board, school or school\n\ndistrict shall be responsible for any treatment costs incurred by a\n\nstudent as a result of any such assistance or referral to any\n\nmedical treatment, social service agency or facility, or substance\n\nabuse prevention and treatment program.\n\nB. Every school district shall have and deliver to each\n\nclassroom teacher a written policy that such teachers shall follow\n\nif they have a student who appears to be under the influence of low-\n\npoint beer, alcoholic beverages or a controlled dangerous substance\n\nin their classroom. The written policy shall be developed by the\n\nlocal superintendent of schools and adopted by the local board of\n\neducation. The provisions of subsection A of this section shall be\n\nthe minimum requirements of such written policy. The written policy\n\nshall be filed with the office of the State Superintendent of Public\n\nInstruction within ninety (90) days of the effective date of this\n\nact.
