As defined in this act:\n\n1. \"Athlete\" means a secondary-school-age individual who is\n\nparticipating in a sport which is individual- and/or team-based,\n\noutside of school or within school and either competitive or in an\n\norganized practice; and\n\n2. \"Health care provider\" means an individual who is\n\nregistered, certified, licensed or otherwise recognized by the state\n\nto provide medical or psychological treatment and who is trained and\n\nexperienced in the evaluation, management and care of concussions.\n\nB. The State Department of Health shall create a concussion\n\nmanagement section on its website to provide the guidelines\n\nnecessary for each school district board of education and youth\n\nsports organization to develop their own policies and procedures\n\npertaining to, but not limited to:\n\n1. A concussion and head injury information sheet for game\n\nofficials, team officials, athletes, parents or guardians and other\n\npersons having care or charge of athletes of the signs and symptoms\n\nof concussion or head injury and the risk of continuing to practice\n\nor compete in an athletic event or activity after sustaining a\n\nconcussion or head injury;\n\n2. \"Return to Learn\" guidelines for teachers and relevant\n\nschool personnel pertaining to athletes who are returning to the\n\nclassroom after sustaining a concussion or head injury;\n\n3. \"Graduated Stepwise Return to Athletic Participation\"\n\nguidelines for team officials pertaining to athletes returning to\n\npractice or competition after a concussion or head injury; and\n\n4. Links to one or more free online concussion training\n\nprograms as provided by the Centers for Disease Control and\n\nPrevention (CDC), the National Federation of State High School\n\nAssociations (NFHS) or a comparable program or resource.\n\nThe Department shall periodically review the guidelines and update\n\nit accordingly.\n\nC. Each school district board of education and youth sports\n\norganization or association shall develop policies and procedures\n\npursuant to subsection B of this section to inform and educate their\n\nrespective coaches, game officials, team officials, athletes and\n\ntheir parents or guardians of the nature and risk of concussion and\n\nhead injury, including continuing to play after concussion or head\n\ninjury. On an annual basis, information regarding concussion and\n\nhead injuries shall be disseminated to the athlete and his or her\n\nparent or guardian. Acknowledgment and understanding of the\n\ninformation shall be completed by the athlete and the athlete's\n\nparent or guardian and maintained by the school or the youth sports\n\norganization or association prior to the athlete's participation in\n\npractice or competition.\n\n1. On an annual basis, game officials and team officials shall\n\nundergo concussion training provided by the CDC, the NFHS or a\n\ncomparable program or resource. A record of completion of the\n\ntraining course shall be readily available upon request.\n\n2. If any game official or team official responsible for the\n\ncare and safety of an athlete in an athletic event becomes aware or\n\nsuspects an athlete is exhibiting signs, symptoms or behaviors\n\nconsistent with having sustained a concussion or head injury, he or\n\nshe shall remove the athlete from the practice or competition.\n\n3. If an athlete is removed from practice or competition as\n\nprovided in paragraph 2 of this subsection, the athlete shall not,\n\non the same day the athlete is removed, be permitted to return to\n\nthat practice or competition or to participate in any other practice\n\nor competition, unless deemed eligible pursuant to the provisions of\n\nparagraph 4 of this subsection.\n\n4. An athlete who has been removed from participation as\n\nprovided in paragraph 2 of this subsection may not participate until\n\nthe athlete is evaluated by a health care provider and receives\n\nwritten clearance to return to participation from that health care\nto participate in any other practice\n\nor competition, unless deemed eligible pursuant to the provisions of\n\nparagraph 4 of this subsection.\n\n4. An athlete who has been removed from participation as\n\nprovided in paragraph 2 of this subsection may not participate until\n\nthe athlete is evaluated by a health care provider and receives\n\nwritten clearance to return to participation from that health care\n\nprovider. The health care provider may be a volunteer. A health\n\ncare provider, game official or team official, whether volunteer or\n\nemployee, shall not be liable for civil damages for injury, death or\n\nloss to person or property allegedly arising from any act or\n\nomission in providing services or performing duties unless the acts\n\nor omissions constituting gross negligence or willful or wanton\n\nmisconduct.\n\nD. Respective governing boards shall establish the following\n\nminimum penalties for a violation of paragraph 2 of subsection C of\n\nthis section for those individuals set forth in paragraph 1 of\n\nsubsection C of this section:\n\n1. First violation shall be additional concussion recognition\n\nand management education as predetermined by the governing board;\n\n2. Second violation shall be suspension from the sport until\n\nappearance before the governing board; and\n\n3. Monetary fines shall not be considered as a penalty.\n\nE.
