The \"Oklahoma Prevention Needs Assessment Survey\" means the\n\nbiennial mental health prevention survey of public school students\n\nin grades six, eight, ten, and twelve managed by the Department of\n\nMental Health and Substance Abuse Services.\n\nB. Beginning in the 2022-2023 school year, and biennially\n\nthereafter, public schools shall administer the Oklahoma Prevention\n\nNeeds Assessment Survey, or an alternative survey as provided in\n\nsubsection D of this section, for the purpose of providing direction\n\nto schools, school districts, and communities to effectively improve\n\nthe lives of students regarding a variety of issues with a focus on\n\nalcohol, tobacco, other drug use, mental health, academic failure,\n\nand violence.\n\nC. The Department of Mental Health and Substance Abuse Services\n\nshall maintain the Oklahoma Prevention Needs Assessment Survey and\n\nshall provide technical assistance for schools in survey\n\nadministration, reporting, planning, and development of school\n\nmental health prevention and intervention strategies informed by the\n\nsurvey results.\n\nD. If a school or school district chooses to administer an\n\nalternative survey or assessment tool to fulfill the purpose\n\ndescribed in subsection B of this section, it may apply for a waiver\n\nthrough the Department of Mental Health and Substance Abuse\n\nServices.\n\nE. The school district superintendent or his or her designee\n\nshall provide prior written notification to the parents or legal\n\nguardians of students to be administered the Oklahoma Prevention\n\nNeeds Assessment Survey or an alternative survey or assessment tool\n\nadopted pursuant to subsection D of this section. The notification\n\nshall include information to parents and legal guardians that they\n\nmay opt their student out of the survey or assessment tool by\n\nproviding written notice to the school district.\n\nF. Prior to the biennial administration of the Oklahoma\n\nPrevention Needs Assessment Survey, the Department of Mental Health\n\nand Substance Abuse Services shall submit the survey to the\n\nPresident Pro Tempore of the Oklahoma State Senate, the Speaker of\n\nthe Oklahoma House of Representatives, the chairs of the committees\n\nwith responsibility over common education in both houses of the\n\nLegislature, and the chairs of the committees with responsibility\n\nover public health in both houses of the Legislature.\n\nG. The provisions of this section shall be subject to the\n\navailability of federal funding. If federal funding is insufficient\n\nto provide the Oklahoma Prevention Needs Assessment Survey to public\n\nschools on a biennial basis, administration of the survey shall not\n\nbe required.\n\nH.
