Stat. tit. 70, § 70-24-165","heading":"Short title — Federal Education Guidance Disclosure Act","body":"— Online publication.\n\nA. This act shall be known and may be cited as the \"Federal\n\nEducation Guidance Disclosure Act\".\n\nB. Within five (5) days of receiving a guidance document from\n\nthe United States Department of Education, the State Department of\n\nEducation shall publish the guidance document on an Internet website\n\ndesignated by the State Superintendent of Public Instruction unless\n\nthe guidance document contains sensitive or confidential information\n\nnot legal to disclose due to privacy laws.\n\nC. 1. The State Department of Education shall create the\n\ndesignated Internet website for publication described in subsection\n\nB of this section no later than ninety (90) days after the effective\n\ndate of this act.\n\n2. The State Department of Education shall include hyperlinks\n\non the Internet website, in a conspicuous manner, that provide\n\naccess to the guidance documents received pursuant to subsection B\n\nof this section.\n\nD. If a guidance document is rescinded by the United States\n\nDepartment of Education, the State Department of Education shall\n\nmaintain the rescinded guidance document at the location described\n\nin subsection C of this section and indicate within fifteen (15)\n\ndays of such rescission:\n\n1. That the document has been rescinded; and\n\n2. The date the document was rescinded.\n\nE. For purposes of this section, \"guidance document\" means a\n\nfederal agency statement of general applicability, other than a rule\n\nthat has the force and effect of law promulgated in accordance with\n\nthe notice and comment procedures under 5 U.S.C., Section 553, that\n\nis designated by an agency official as setting forth a policy or\n\ninterpretation on a statutory, regulatory, or technical issue. A\n\nguidance document may include, but is not limited to, a memorandum,\n\nnotice, bulletin, directive, letter, or no-action letter.
