Stat. tit. 70, § 70-26-103","heading":"Definitions","body":"The following words and phrases as used in Section 26-101 et\n\nseq. of this title, unless a different meaning is clearly required\n\nby the context, shall have the following meanings:\n\n1. \"Benefit\" means any of the benefits which may be purchased\n\nor are required to be purchased under the cafeteria plan;\n\n2. \"Cafeteria plan\" means a benefit plan established pursuant\n\nto 26 U.S.C. Section 125;\n\n3. \"Flexible benefit allowance\" means amounts credited by the\n\nschool district for each school district employee for the purchase\n\nof benefits under the cafeteria plan;\n\n4. \"Support personnel\" means full-time employees of a school\n\ndistrict as determined by the standard period of labor which is\n\ncustomarily understood to constitute full-time employment for the\n\ntype of services performed by the employees who are employed a\n\nminimum of six (6) hours per day for a minimum of one hundred\n\nseventy-two (172) days or a minimum of six (6) hours per day for a\n\nminimum of one thousand thirty-two (1,032) hours per year and who\n\nprovide services not performed by certified personnel, which is\n\nnecessary for the efficient and satisfactory functioning of a school\n\ndistrict, and shall include cooks, janitors, maintenance personnel,\n\nbus drivers, noncertified or nonregistered nurses, noncertified\n\nlibrarians, and clerical employees of a school district but shall\n\nnot include adult education instructors or adult coordinators\n\nemployed by technology center school districts;\n\n5. \"Plan year\" means the twelve-month period established by the\n\nschool district for the cafeteria plan;\n\n6. \"School district\" means the public school districts and\n\ntechnology center school districts of this state;\n\n7. \"School district employee\" means certified or support\n\npersonnel as defined in Section 26-101 et seq. of this title.\n\nEmployees of an educational service provider contracted with a\n\nschool district pursuant to subsection G of Section 5-117 of this\n\ntitle who perform functions that would otherwise be performed by a\n\nschool district employee shall be considered employees of a school\n\ndistrict for purposes of the Larry Dickerson Education Flexible\n\nBenefits Allowance Act unless otherwise provided for in the contract\n\nbetween the educational service provider and the contracting school\n\ndistrict;\n\n8. \"Certified personnel\" means a certified person employed on a\n\nfull-time basis to serve as a teacher, principal, supervisor,\n\nadministrator, counselor, librarian, or certified or registered\n\nnurse, but shall not mean a superintendent of a school district; and\n\n9. \"Self-insured\" means a health care program in which the\n\nschool district funds the benefit plans from its own resources\n\nwithout purchasing insurance and which may be administered by the\n\nschool district or by an outside administrator under contract with\n\nthe school district for administrative services.
