Except as otherwise provided for in subsection B of this\n\nsection and elsewhere in this section, to be eligible to participate\n\nin the Oklahoma Higher Learning Access Program and to qualify for an\n\naward which includes payment of an amount equivalent to resident\n\ntuition or other tuition pursuant to Section 2604 of this title for\n\nthe first semester or other academic unit of postsecondary\n\nenrollment, a student shall:\n\n1. Be a resident of this state or be enrolled in a school\n\ndistrict located in this state that serves students who reside in\n\nboth this state and an adjacent state pursuant to a contract as\n\nauthorized in Section 5-117.1 of this title;\n\n2. Be a United States citizen or lawfully present in the United\n\nStates. A student who is not a United States citizen or lawfully\n\npresent in the United States shall not be eligible to participate in\n\nthe Oklahoma Higher Learning Access Program and to qualify for an\n\naward notwithstanding the provisions of Section 3242 of this title.\n\nThe provisions of this paragraph shall not apply to any student who\n\nwas enrolled in the Oklahoma Higher Learning Access Program prior to\n\nthe end of the 2006-2007 school year;\n\n3. Have a record of satisfactory compliance with agreements\n\nexecuted pursuant to Section 2605 of this title;\n\n4. a. Have graduated within the previous three (3) years\n\nfrom a high school accredited by the State Board of\n\nEducation or the Oklahoma School of Science and\n\nMathematics with a minimum 2.5 cumulative grade point\n\naverage on a 4.0 scale for all work attempted in\n\ngrades nine through twelve,\n\nb. Have graduated within the previous three (3) years\n\nfrom a high school not accredited by the State Board\n\nof Education with a minimum 2.5 cumulative grade point\n\naverage on a 4.0 scale for all work attempted in\n\ngrades nine through twelve and have achieved a\n\ncomposite score of 22 or higher on the ACT test, or\n\nc. Have satisfactorily completed within the previous\n\nthree (3) years an educational program that was\n\nprovided through a means other than a public or\n\nprivate school and have achieved a composite score of\n\n22 or higher on the ACT test;\n\n5. Have completed the curricular requirements for admission to\n\nan institution within The Oklahoma State System of Higher Education.\n\nStudents shall also have attained a 2.5 grade point average in the\n\ncore curriculum courses. Students who attended a high school which\n\ndid not offer all the core curriculum courses or students who were\n\neducated by other means and were not offered all the core curriculum\n\ncourses shall be allowed to satisfy this curriculum requirement by\n\nparticipating in a program approved by the Oklahoma State Regents\n\nfor Higher Education for remediation of high school curricular\n\ndeficiencies;\n\n6. Have satisfied admission standards as determined by the\n\nOklahoma State Regents for Higher Education for first-time-entering\n\nstudents for the appropriate type of institution, or, if attending a\n\nprivate institution, have satisfied admission standards as\n\ndetermined by the private institution. No student participating in\n\nthe Oklahoma Higher Learning Access Program shall be admitted into\n\nan institution of higher education by special admission standards;\n\n7. Have secured admission to, and enrolled in, an institution\n\nwhich is a member of The Oklahoma State System of Higher Education,\n\na postsecondary vocational-technical program offered by a technology\n\ncenter school that meets the requirements to be eligible for federal\n\nstudent financial aid, or a private institution of higher learning\n\nlocated within this state and accredited pursuant to Section 4103 of\n\nthis title; and\n\n8. a. Have established financial need according to the\n\nprovisions of subsection D of Section 2605 of this\n\ntitle and standards and provisions promulgated by the\n\nOklahoma State Regents for Higher Education,\nuirements to be eligible for federal\n\nstudent financial aid, or a private institution of higher learning\n\nlocated within this state and accredited pursuant to Section 4103 of\n\nthis title; and\n\n8. a. Have established financial need according to the\n\nprovisions of subsection D of Section 2605 of this\n\ntitle and standards and provisions promulgated by the\n\nOklahoma State Regents for Higher Education,\n\nb. If the student was adopted between birth and twelve\n\n(12) years of age while in the permanent custody of\n\nthe Department of Human Services, in the court-ordered\n\ncustody of a licensed private nonprofit child-placing\n\nagency, or federally recognized Indian tribe, as\n\ndefined by the federal Indian Child Welfare Act of\n\n1978, have established financial need according to the\n\nprovisions of paragraph 1 of subsection E of Section\n\n2605 of this title and standards and provisions\n\npromulgated by the Oklahoma State Regents for Higher\n\nEducation,\n\nc. If the student was adopted between thirteen (13) and\n\nseventeen (17) years of age while in the permanent\n\ncustody of the Department of Human Services, in the\n\ncourt-ordered custody of a licensed private nonprofit\n\nchild-placing agency, or federally recognized Indian\n\ntribe, as defined by the federal Indian Child Welfare\n\nAct of 1978, have established financial need according\n\nto the provisions of paragraph 2 of subsection E of\n\nSection 2605 of this title and standards and\n\nprovisions promulgated by the Oklahoma State Regents\n\nfor Higher Education,\n\nd. If the student was placed in the custody of the\n\nDepartment of Human Services at any time during the\n\neighth, ninth, tenth, or eleventh grade and enrolls in\n\nthe program no later than his or her official date of\n\nhigh school graduation, have established financial\n\nneed according to the provisions of paragraph 3 of\n\nsubsection E of Section 2605 of this title and\n\nstandards and provisions promulgated by the Oklahoma\n\nState Regents for Higher Education, or\n\ne. If the student is the child of a certified classroom\n\nteacher and meets the provisions of paragraph 5 of\n\nsubsection E of Section 2605 of this title. For the\n\npurposes of this paragraph, “certified classroom\n\nteacher” shall have the same meaning as provided in\n\nsubparagraph d of paragraph 5 of subsection E of\n\nSection 2605 of this title.\n\nB. 1. A student shall be eligible to participate in the\n\nOklahoma Higher Learning Access Program and to qualify for an award\n\nwhich includes payment of an amount equivalent to resident tuition\n\nor other tuition pursuant to Section 2604 of this title for the\n\nfirst semester or other academic unit of postsecondary enrollment if\n\nthe student meets all of the following criteria:\n\na. is a child of any person killed after January 1, 2000,\n\nin the line of duty in any branch of the United States\n\nArmed Forces or who died after January 1, 2000, as a\n\nresult of an injury sustained while in the line of\n\nduty in any branch of the United States Armed Forces\n\nand the person who was killed or died filed an\n\nindividual or joint Oklahoma income tax return for the\n\ntax year prior to the year during which the person was\n\nkilled or died,\n\nb. is a resident of this state or is enrolled in a school\n\ndistrict located in this state that serves students\n\nwho reside in both this state and an adjacent state\n\npursuant to a contract as authorized in Section 5-\n\n117.1 of this title,\n\nc. enrolls in an institution within The Oklahoma State\n\nSystem of Higher Education prior to reaching the age\n\nof twenty-one (21),\n\nd. has satisfied admission standards as determined by the\n\nOklahoma State Regents for Higher Education for first-\n\ntime-entering students for the appropriate type of\n\ninstitution, or, if attending a private institution,\n\nhas satisfied admission standards as determined by the\n\nprivate institution. No student participating in the\n\nOklahoma Higher Learning Access Program shall be\n\nadmitted into an institution of higher education by\nards as determined by the\n\nOklahoma State Regents for Higher Education for first-\n\ntime-entering students for the appropriate type of\n\ninstitution, or, if attending a private institution,\n\nhas satisfied admission standards as determined by the\n\nprivate institution. No student participating in the\n\nOklahoma Higher Learning Access Program shall be\n\nadmitted into an institution of higher education by\n\nspecial admission standards,\n\ne. has secured admission to, and enrolled in, an\n\ninstitution which is a member of The Oklahoma State\n\nSystem of Higher Education, a postsecondary\n\nvocational-technical program offered by a technology\n\ncenter school that meets the requirements to be\n\neligible for federal student financial aid, or a\n\nprivate institution of higher learning located within\n\nthis state and accredited pursuant to Section 4103 of\n\nthis title, and\n\nf. executes an agreement pursuant to subsection C of\n\nSection 2605 of this title.\n\n2. A student who is eligible to participate in the program\n\npursuant to this subsection shall not be required to meet the\n\neligibility requirements set forth in subsection A of this section.\n\nC. To retain eligibility while pursuing the program of higher\n\nlearning in which enrolled, the student shall:\n\n1. Meet the requirements for retention and degree completion as\n\nestablished by the institution in which the student is enrolled;\n\n2. Maintain good academic standing and satisfactory academic\n\nprogress according to standards of the Oklahoma State Regents for\n\nHigher Education;\n\n3. Maintain satisfactory academic progress as required for\n\neligibility for federal Title IV student financial aid programs.\n\nThe provisions of this paragraph shall become effective for the\n\n2012-2013 school year;\n\n4. Comply with the standards related to maintenance of\n\neligibility as promulgated by the Oklahoma State Regents for Higher\n\nEducation; and\n\n5. Refrain from conduct that leads to expulsion or suspension\n\nof more than one semester from an institution of higher education.\n\nA student who violates the provisions of this paragraph shall\n\npermanently lose eligibility for program benefits. The provisions\n\nof this paragraph shall become effective January 1, 2008.\n\nD. The Oklahoma State Regents for Higher Education and the\n\nState Board of Career and Technology Education shall promulgate\n\nrules relating to maintenance of eligibility under the Oklahoma\n\nHigher Learning Access Act by a student.\n\nE. It is the intent of the Legislature that students in the\n\nninth grade for the 1992-93 school year who are determined to be\n\neligible Oklahoma Higher Learning Access students pursuant to the\n\nOklahoma Higher Learning Access Act shall be the first students\n\neligible for benefits from the Oklahoma Higher Learning Access Trust\n\nFund.\n\nF.
