Subject to the availability of funds, an amount equivalent\n\nto the nonguaranteed resident tuition for which an eligible Oklahoma\n\nHigher Learning Access Program student is obligated at an\n\ninstitution of The Oklahoma State System of Higher Education shall\n\nbe awarded by allocation from the Oklahoma Higher Learning Access\n\nTrust Fund.\n\nB. Subject to the availability of funds, for each eligible\n\nOklahoma Higher Learning Access Program student enrolled at a\n\nprivate institution of higher learning located within this state and\n\naccredited pursuant to Section 4103 of this title, the Oklahoma\n\nState Regents for Higher Education shall award from the Oklahoma\n\nHigher Learning Access Trust Fund an amount equivalent to the amount\n\nof resident tuition for which the student would be eligible if the\n\nstudent were enrolled in a comparable program at a comparable\n\ninstitution of The Oklahoma State System of Higher Education.\n\nComparability shall be determined by the State Regents.\n\nC. Subject to the availability of funds, an amount equivalent\n\nto the tuition for any eligible Oklahoma Higher Learning Access\n\nProgram student enrolled in a public postsecondary vocational-\n\ntechnical program or course for the purpose set forth in Section\n\n2602 of this title shall be awarded by allocation from the Oklahoma\n\nHigher Learning Access Trust Fund. Provided, such allocation shall\n\nnot exceed the amount a student would have received for comparable\n\nenrollment at a two-year institution within The Oklahoma State\n\nSystem of Higher Education.\n\nD. 1. An award allowed by this section shall not be allowed\n\nfor courses or other postsecondary units taken in excess of the\n\nrequirements for completion of a baccalaureate program or taken more\n\nthan five (5) years after the student's first semester of\n\npostsecondary enrollment. The Oklahoma State Regents for Higher\n\nEducation may award the Oklahoma Higher Learning Access Program\n\nbenefits for courses of postsecondary units taken more than five (5)\n\nyears after the student's first semester of postsecondary enrollment\n\nonly in hardship circumstances; provided, however, no Oklahoma\n\nHigher Learning Access Program participant may receive benefits\n\nbeyond a cumulative time period of five (5) years.\n\n2. The Oklahoma State Regents for Higher Education may award\n\nthe Oklahoma Higher Learning Access Program benefits for a student's\n\nfirst semester or other academic unit of postsecondary enrollment\n\ntaken more than three (3) years after the student graduates from\n\nhigh school or completes an educational program equivalent to high\n\nschool graduation as authorized in subsection A of Section 2603 of\n\nthis title or after the student turns twenty-one (21) years of age\n\nas authorized in subsection B of Section 2603 of this title if the\n\nstudent is a member of the Armed Forces of the United States, the\n\nReserve Corps of the Armed Forces of the United States, or the\n\nOklahoma National Guard, and is ordered to active duty or active\n\nduty for special work or training and due to the duty commitment the\n\nstudent is unable to enroll prior to the end of the three-year\n\nperiod or before the student reaches twenty-one (21) years of age.\n\nThe period shall be extended by the length of the term of duty.\n\n3. The Oklahoma State Regents for Higher Education shall\n\nestablish a maximum limit on the number of courses or other\n\npostsecondary units to which Oklahoma Higher Learning Access Program\n\nbenefits will apply.\n\nE. Benefits awarded under the Oklahoma Higher Learning Access\n\nProgram shall be awarded to all eligible applicants without any\n\nlimitation on the number of awards in any year other than the amount\n\nof funds available for the program and the number of eligible\n\napplicants. Subject to the provisions of subsection F of this\n\nsection, if funds are not sufficient to provide awards for all\n\neligible applicants, the Oklahoma State Regents for Higher Education\nccess\n\nProgram shall be awarded to all eligible applicants without any\n\nlimitation on the number of awards in any year other than the amount\n\nof funds available for the program and the number of eligible\n\napplicants. Subject to the provisions of subsection F of this\n\nsection, if funds are not sufficient to provide awards for all\n\neligible applicants, the Oklahoma State Regents for Higher Education\n\nshall make awards on the basis of need. Provided, the Oklahoma\n\nState Regents for Higher Education shall take into consideration\n\nother grants and scholarships received by an eligible applicant when\n\nmaking awards.\n\nF. The Oklahoma State Regents for Higher Education may, at the\n\ntime an award is made on behalf of an Oklahoma Higher Learning\n\nAccess Program student, set aside in the Oklahoma Higher Learning\n\nAccess Trust Fund funds for the full commitment made to such Higher\n\nLearning Access Program student. For all academic years, students\n\nwho have previously received awards under the provisions of the\n\nOklahoma Higher Learning Access Act, Section 2601 et seq. of this\n\ntitle, and who have continued at all times to fulfill the\n\nrequirements for eligibility to receive awards provided pursuant to\n\nthis program shall be given an absolute priority for continued\n\nfinancial support by the Oklahoma Higher Learning Access Program\n\nsuperior to any students who are applying for such benefits for the\n\nfirst time.\n\nG.
