Stat. tit. 70, § 70-27-106","heading":"Short title - Save Women's Sports Act – Requirements –","body":"Causes of action.\n\nA. This act shall be known and may be cited as the \"Save\n\nWomen's Sports Act\".\n\nB. As used in this section:\n\n1. \"School\" means a public school district or public charter\n\nschool in this state or an institution within The Oklahoma State\n\nSystem of Higher Education;\n\n2. \"School athletic association\" shall have the same meaning as\n\nprovided for in Section 27-102 of Title 70 of the Oklahoma Statutes;\n\nand\n\n3. \"Intercollegiate association\" shall mean a national\n\nassociation that sets eligibility requirements for participation in\n\nsports at the collegiate level and that provides the coordination,\n\nsupervision and regulation of the intercollegiate competitions.\n\nC. Athletic teams that are sponsored by a school or sponsored\n\nby a private school whose students or teams compete against a school\n\nshall be expressly designated as one of the following based on\n\nbiological sex:\n\n1. \"Males\", \"men\" or \"boys\";\n\n2. \"Females\", \"women\" or \"girls\"; or\n\n3. \"Coed\" or \"mixed\".\n\nD. Prior to the beginning of each school year, the parent or\n\nlegal guardian of a student who competes on a school athletic team\n\nshall sign an affidavit acknowledging the biological sex of the\n\nstudent at birth. If the student is eighteen (18) years of age or\n\nolder, the student who competes on a school athletic team shall sign\n\nan affidavit acknowledging his or her biological sex at birth. If\n\nthere is any change in the status of the biological sex of the\n\nstudent, the affiant shall notify the school within thirty (30) days\n\nof such change.\n\nE. 1. Athletic teams designated for \"females\", \"women\" or\n\n\"girls\" shall not be open to students of the male sex.\n\n2. Any student who is deprived of an athletic opportunity or\n\nsuffers any direct or indirect harm as a result of a violation of\n\nparagraph 1 of this subsection shall have a cause of action for\n\ninjunctive relief, damages and any other relief available permitted\n\nby law against the school.\n\n3. Any student who is subject to retaliation or other adverse\n\naction by a school, school athletic association or intercollegiate\n\nassociation as a result of reporting a violation of paragraph 1 of\n\nthis subsection to an employee or representative of the school,\n\nschool athletic association or intercollegiate association or to any\n\nstate or federal agency with oversight of schools in this state\n\nshall have a cause of action for injunctive relief, damages and any\n\nother relief available permitted by law against the school, school\n\nathletic association or intercollegiate association.\n\nF. 1. The State Board of Education, the Oklahoma State Regents\n\nfor Higher Education and any school athletic association or\n\nintercollegiate association of which a school is a member shall be\n\nprohibited from entertaining a complaint, opening an investigation\n\nor taking any other adverse action against a school for maintaining\n\nathletic teams or sports for students of the female sex as provided\n\nfor in subsection E of this section.\n\n2. Any school that suffers any direct or indirect harm as a\n\nresult of a violation of paragraph 1 of this subsection shall have a\n\ncause of action for injunctive relief, damages and any other relief\n\npermitted by law against the State Board of Education, the Oklahoma\n\nState Regents for Higher Education, school athletic association or\n\nintercollegiate association.\n\nG. Causes of action authorized by this section shall be\n\ninitiated within two (2) years after the harm occurred. Persons or\n\nassociations that prevail on a claim brought pursuant to this\n\nsection shall be entitled to monetary damages including for any\n\npsychological, emotional and physical harm suffered, reasonable\n\nattorney fees and costs and any other appropriate relief permitted\n\nby law.","path":["OK Code","Title 70"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os70.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ba7cdc762e719575b1a9db2ba3c43648aab170e296da7a6b09aa5c48971db467","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-70-70-27-105","next":"us-ok/okla.-stat.-tit.-70-70-27-200"},"notice":"GroundRules: Original legal text.
